Struggle for Enacting Legislation on Violence

Abstract

The thesis seeks to explore the both success and failure processes of Elimination of Violence against Women (EVAW) law in Afghanistan. In the success stage, it examines the joint efforts and strategies made between Afghan Government, national women`s rights activists and international partners which ensured the approval of the law by the President in 2009. In the second stage which is the failure stage of the law, the study explores how the efforts failed to get the law approved from the Parliament and the main factors responsible for the failure. The study shows that the law is an outcome of intensive consultations, efforts, cooperation and strategies between Afghan Government, domestic women`s rights activists and international partners including a wide array of stakeholders. It shows that the critical factor behind the successful enactment of the law in the first stage is the supports and pressure of international community and Afghan civil society which encouraged the Government and other domestic groups to contribute supports to the law. The efforts and collaboration ensured the approval of the law by the President in 2009. However, the strategies and policies which had successfully worked in the first stage with the law have failed in the second stage to get the law approved from the Parliament. The main factor behind the failure of EVAW law is the conservative male dominated structure of Afghan Parliament, which reinforces political, social and cultural problems.;이 논문은 아프가니스탄에서의 여성에 대한 폭력철폐법 ( EVAW : Elimination of Violence against Women)의 제정 과정 분석을 통해 이 법이2009년 대통령으로부터 법적인 승인을 가능하게했던 요인과 이후 국회에서 거부되었던 이유를 설명한다. 2009년 여성에 대한 폭력철폐법 (EVAW)이 법적 승인을 받게 된 성공 요인으로는 아프간 정부와 국내 여성인권 단체, 국제협력기구들 간의 공동 노력과 협조가 있었기 때문이다. 이 논문에서 저자는 아프간 사회에 만연한 여성에 대한 폭력을 줄이기 위하여 다수의 이해관계자들간의 철저한 조사와 협력, 그리고 준비된 전략의 결과로 EVAW가 법적 승인을 갖게 된 것이라고 주장한다. 특히 이 법을 지지하는 데 기여한 정부와 국내 단체를 고무시켰던 국제사회와 아프간 시민 단체의 지지와 압력이 중요한 역할을 했음을 밝히고 있다. 그러나 이러한 노력은 아프간 국회가 EVAW 법의 승인을 거부함으로써 난관에 봉착하게 되었다. 이 법의 제정과 관련하여 첫 번째 단계에서 성공했던 노력과 전략이 국회에서 성공하지 못하고 결국 법 제정에 실패하게 된 주 원인은 아프간 국회의 보수적이고 남성중심적인 의원들이 중심을 이루고 있기 때문이다. 이러한 구조적 문제는 아프간에서 성불평등과 여성폭력이 지속되는 악순환을 만들고 있다.
