dc.description.abstractThis research examines the significant human rights issuances of the Supreme Court of the Philippines under its adjudicative, rule-making, and administrative powers from 2008 to 2012 in order to determine a) the extent of judicialization of human rights in the country, and b) whether the Court’s human rights issuances have kept pace with developments in international human rights discourse that civil and political (first generation), social and economic (second generation), and environmental (third generation) human rights should be simultaneously protected and promoted. The findings are a) judicialization of human rights has continued and even expanded during the said period and that b) following the design of the Philippines Constitution, the Court has been quite active in the exercise of its adjudicative power in protecting and promoting first generation human rights. It has also used its other powers, specially its unique rule-making power (which is akin to legislative power), to protect and promote second and third generation human rights. To maximize the role of the Supreme Court in protecting and promoting all categories of human rights, the study recommends the passage of legislation by Congress to provide courts with parameters as to the enforcement of social and economic rights, as well as greater mobilization of the public in terms of filing appropriate cases and lobbying for the enactment of the needed Rules of Court.;본 연구는 필리핀 대법원이 2008년부터 2012년까지 판결권, 규칙제정권, 행정권으로 인권의 사법화를 도모하였는지를 살펴보며 필리핀 국민의 참정권, 사회권, 경제권, 그리고 환경보호권이 국제적 기준에 맞게 보호되고 향상되었는지를 살펴보는 데에 의의를 둔다. 결론적으로 본 연구는 2008년부터 2012년까지 필리핀 내에 인권의 사법화가 계속적으로 진행되어 왔다는 결과를 도출해 냈으며 필리핀의 대법원과 헌법이 판결권 행사를 통해 국민의 시민권과 참정권을 보호하고 도모하고 있다는 것을 보여준다. 그러나 필리핀의 대법원과 헌법은 판결권, 규칙제정권, 행정권 중 특히 규칙제정권의 행사를 통하여 인권을 증진하는 데에 주력하고 있다는 것을 보여준다. 따라서 본 연구는 필리핀 대법원의 역할 극대화와 필리핀 국민의 향상된 인권을 위해서 필리핀 의회가 인권과 관련한 법률을 제정할 것을 권고하는 바 이며 이를 통해 법원이 국민의 사회권과 경제권을 보장하고 국민이 규율 제정에 참여할 수 있는 기회의 창을 넓힐 것을 강조하는 바 이다.-
