Abstract
본 연구의 목적은 법학전문대학원 학생들을 위한 특수목적 영어교육과정을 개발하는 것이다. 이를 위하여 학습자인 법학전문대학원 학생들과 실무자인 변호사들이 사용하고 있는 법률영어의 기능을 심층면접을 통해 탐색하였다. 이를 바탕으로 작성된 설문지로 요구분석을 실시하여 법학전문대학원 학생들을 위한 영어 교수요목을 설계하였다. 본 연구는 서울지역과 전남지역에 재학 중인 법학전문 대학원 학생 5명과 변호사 5명을 대상으로 1차 심층면접을 실시하고 이들 중 희망하는 자 7명을 대상으로 2차 심층면접을 실시하였다. 면접결과는 내용 분석하여 법률영어의 사용현황과 법률영어의 언어영역별 기능을 탐색하였다. 이를 바탕으로 국내 법률상황을 반영하는 법률영어 요구분석을 위한 설문지를 작성하였다. 이후 법학전문대학원생 74명과 변호사 50명을 대상으로 설문조사를 하였으며 총 124부를 최종으로 분석하였다. 수집된 자료는 SPSS프로그램을 사용하여 연구문제에 따라 기술통계, 빈도분석, 요인분석, t검정을 실시하였다. 본 연구의 분석결과를 요약하면 다음과 같다. 첫째, 법학전문대학원 학생들이 영어 수업 시 가장 많이 사용하는 영어활동은 ‘영미법이나 판례 및 관련 자료 읽기’이다. 영어 학습을 하는 동기는 도구적 동기가 우세하였으며 이를 통해 영어 학습이 졸업 후 실제 업무에 활용될 수 있도록 이루어져야 함을 확인할 수 있다. 둘째, 법학전문대학원생들과 변호사들이 공통으로 영어교육에 필요하다고 생각하는 기능은 전문 법률용어와 법률자료를 읽거나 들으면서 정확하게 이해하는 것이다. 특히 법률언어는 상이한 법체계에 대한 인식을 정립하고 이해하는 노력이 매우 중요하기 때문에(Mattila, 2006; Pommer, 2008) 법학전문대학원생들이 이를 훈련할 수 있는 기회를 갖는 것이 필요하다. 쓰기 영역에서는 ‘각종 법률서식 작성하기’와 ‘법률의견서 작성하기’에 대한 필요도가 높게 나타났다. 말하기 영역에서는 국내 법률시장의 특성상 법원에서는 영어가 거의 쓰이지 않기 때문에 의뢰인이나 동료 직원들과의 영어 의사소통에 필요한 일반적인 영어말하기 기능에 대한 필요가 나타났다. 셋째, 집단별로 응답자에 따라 존재하는 차이를 살펴보기 위해 학습자 집단의 경우 인턴근무 경험 유무에 따라, 변호사 집단의 경우 담당업무에 따른 차이를 t검정을 통해 확인하여 보았다. 인턴경험 유무에 따른 차이에서는 ‘법률영어를 쉬운 용어로 풀어서 설명하기’와 ‘문장에서 전문 법률용어를 이해하기’는 인턴경험을 거친 이후 필요도가 상승하였다. ‘법률의견서(legal memo)작성하기’는 인턴근무 전에는 필요성을 낮게 인지하는 편이었으나 인턴근무 후 필요도가 상승하였다. 법학전문대학원생들의 경우 쓰기활동의 대부분을 차지하고 있는 답안 작성활동에서 인턴근무를 통해 법률의견서를 비롯한 실무를 접하게 되면서 실무에 필요한 글쓰기에 대한 필요성을 인식한 것으로 나타났다. ‘시청각 자료 청취이해하기’ 역시 유의미한 차이를 보이는데 이는 빠르게 변화하는 현대사회에서 각 분야에 따라 필요한 정보를 각자 얻기 위한 노력의 일환으로 볼 수 있다. 넷째, 변호사들의 담당업무에 따른 차이를 위한 t검정에서는 다음의 기능에 있어서 자문업무를 담당하는 경우의 변호사들이 소송업무를 담당하는 경우보다 필요도가 유의미하게 높게 나타났다. ‘법률용어를 듣고 이해하기’와 ‘법률 번역하기’, ‘세부사항 파악하기’, ‘각종 법률서식 작성하기’등이 이에 해당하였다. 이처럼 변호사의 담당업무에 따른 차이가 존재하는 것은 변호사가 처한 법률 상황에 따라 법률영어에 대한 요구가 다양하게 존재하고 있음을 반영한 것이다. 이를 바탕으로 본 연구는 법학전문 대학원 학생들을 위한 교수요목을 제안하였다. 읽기능력을 배양하기 위해 짝 활동과 그룹 활동을 통해 법률영어 학습에 필요한 법적 사건을 요약하는 능력뿐만 아니라 법적 판단을 위한 결정을 추출해 내는 논쟁의 과정을 훈련할 수 있도록 하였다. 말하기 영역 역시 통합된 학습이 이루어질 수 있도록 진정성 있는 읽기 자료를 기초로 하여 실제 직업상황에서 발생할 수 있는 상황을 반영한 역할극을 통해 기회를 제공하였다. 법률영어의 글쓰기와 관련하여서는 직업상황과 학습상황에 관한 격차(Bartholomew, 1990; Bock, 1988; Maley, 1994; Morrison & Tshuma, 1994)를 줄이기 위하여 학습자들이 실무상황에서 접하게 될 글쓰기를 단계적으로 미리 훈련할 수 있도록 하였다. 더불어 요구분석에서 두 집단 모두 가장 필요도를 높게 인식한 법률 용어의 이해를 위해 이를 주기적으로 반복적인 훈련을 하도록 배열하였다. 본 연구는 법학전문대학원생들과 변호사들을 대상으로 법률영어의 사용현황과 영어 의사소통 기능들을 탐색하고 이를 바탕으로 요구조사를 실시하여 중요한 기능을 파악하였다는 데 의의가 있다. 이와 더불어 법학전문대학원생들에게 필요한 ESP 교수요목을 제안하였다. 본 연구에서 탐색된 국내 법률시장에서 사용되는 영어의 기능들과 필요도가 향후 ESP 개발에 활용될 수 있기를 기대하며 나아가 법률영어의 장르와 담화분석, ESP 교재개발과 평가에 관한 후속연구가 진행되어야 할 것이다.;This study aims at analyzing needs of law school students and developing a syllabus for an ESP course for the students in Korea. In order to investigate learning needs and target needs, law school students and lawyers were interviewed and surveyed. The questionnaires are based at in-depth interview. The fundamental framework of the questionnaire was used similarly with previous studies, but details was adjusted according to result of the interview. The questionnaires were administered to 74 law school students and 50 lawyers who were in charge of legal cases. The content of the questionnaire was consisted of three units: personal information, learner’s needs about lawyer’s tasks, and open comments about English education for law school students. A separate set of questionnaire was produced for each of the two groups, but the same questions were used in both sets except for those regarding personal information. SPSS Ver.18.0 was used to produce descriptive statistics for the totals, means, frequencies, standard deviations as well as the percentages of the survey items. The degree of importance of 5 notions and 33 functions was ranked based on the mean values. T-test was used to compare the results. The main results obtained from this study are as follows. First, students’ need for English is great in doing legal research and in communicating with others. Secondly, the major motivation for the law school students to learn English is ‘to lead a good life as a lawyer in the future’. Third, In terms of functions, ‘understanding legal terminology’, ‘reviewing provisions of law’, ‘writing a legal memo’, ‘legal translation’ ‘persuading others’, ‘Identifying actions and events’, ‘Evaluating information to determine compliance with standards’ and ‘getting other’s point’ are shown to be considered important. With regards to the notion of ‘research’ and ‘communication with clients’ are deemed important. Other findings include the differences in the importance ranking of function and type of language skills between the two groups. There was a noticeable difference between the learners and the lawyers. These results also show differences depending on categories such as an intern experience, the type of assigned task of a lawyer. The needs of the lawyers and student with intern experience were more specific and detailed than students who haven’t worked in legal setting. This paper also argued law schools do not provide adequate practical skills training to law students to enable graduates to practice law. With the aim of enhancing subject competence and effectively raising student’s proficiency in English, this paper proposes a syllabus tailored for Korean law students. A variety of methods drawn primarily from sources for developing lawyer-client communication skills is used to actively engage students in the learning precess. It can be facilitative in preparing learners for their future career. Also, activities to get leal concept and understand leal terminologies are introduced. The finding from the study serves as an important foundation in developing an ESP program for law school students. It is necessary to extend the area of the genre and discourse analysis of legal English for the further investigation.
