dc.description.abstractThis thesis is an empirical study for review of the systems of judicial actions of the Women and Children Repression Prevention (WCRP) Tribunals in Bangladesh. Its purpose is to determine the feasibility and desirability of applying the WCRP Act 2000 for establishing the WCRP Tribunal in each district. It examines how the WCRP Act and the WCRP Tribunal of Bangladesh reduced repression against women and children. It focuses on three related factors and challenges, namely, (i) internal factors including insufficient number of judges, delay to submission of police investigation reports, absence of proper witnesses, absence of parties in the WCRP Tribunal; (ii) external factors including lack of monitoring and supervision of higher courts and the government, insufficient legal aid on behalf of repressed victims, improper political influence, lack of coordination with multi-departmental actions and lastly, challenges such as lack of logistic support of the WCRP Tribunal, legal aid and counseling as well as lack of modern technology. The empirical analysis in this thesis establishes the basis for a number of proposals for review of the effectiveness and improvements in the WCRP legal mechanism and for combating the three related factors and challenges of the WCRP Tribunals in Bangladesh. The findings in the empirical legal study applies the “does judicial system work” approach based on some feasible and desirable proposals in the WCRP Tribunals’ present conditions. It then concludes that while study experience may offer some actionable recommendations about how to reform the WCRP Tribunal forward greater effectiveness. If such reforms are effectively implemented repression against women and children will gradually improve, thus helping to fulfill the WCRP Tribunals’ original objective.;본 논문은 방글라데시의 ‘여성과 아동에 대한 억압방지(WCRP, Women and Children Repression Prevention) 특별법정’의 사법처리 체계 검토에 대한 실증연구이다. 본 논문은 방글라데시 각 지역에 WCRP 특별법정을 설치하기 위한 WCRP 법 적용의 실행가능성 및 타당성을 밝히는 것을 목적으로 하며, WCRP 법과 WCRP 특별법정이 여성과 아동에 대한 억압을 어떻게 감소시키는지에 대해 분석하고 있다. 특히 다음 세 가지 관련 요인 및 위험 요소들에 초점을 맞추고 있다. (1) 부족한 판사 수, 경찰 수사보고서의 지연, 적절한 증인의 부재, WCRP 특별법정 내 당사자 부재 등의 내적 요인; (2) 상급법원과 정부의 모니터링 및 감독의 결여, 억압 피해자들을 위한 법적 지원 부족, 부적절한 정치적 영향, 각 부처간 코디네이션 부족 등의 외적 요인; (3) 마지막으로 WCRP 특별법정 지원을 위한 실행계획의 부족, 법적 지원 및 상담 부족, 현대 기술 부족 등의 위험요소 등이 있다. 본 논문의 실증 연구는 WCRP 법적 체계의 효과성과 개선을 위한 보고서와 위에서 언급한 세 가지 요인 및 위험 요소들을 관리하기 위해 제출된 제안서들의 검토를 바탕으로 하며, 현재 설치된 WCRP 특별법정의 실행가능성 및 타당성에 기반하여 “사법제도가 작동 하는가(does judicial system work)”라는 접근법을 적용한다. 마지막으로 WCRP 특별법정을 좀더 효과적으로 운영하기 위한 실행 가능한 권고사항을 제안한다. 이러한 개선 사항이 효과적으로 시행될 경우 여성과 아동에 대한 억압적인 상황이 점진적으로 개선될 것이며, 궁극적으로 WCRP 특별법정 본래의 목적을 달성하는데 도움이 될 것으로 기대한다.-
