The Impact of Socio-cultural and Institutional Factors on the Rise of Rape in Cameroon

Abstract

Rape being one of the forms of sexual violence that cuts across class, race, age and gender is on the rise around the world with more women and girls as victims. This research is a case study on Cameroon which was selected as a representative case of Africa where the prevalence of rape is on the rise. Existing national, international instruments and measures to solve this problem have been far from successful. Despite alarming records in Cameroon in particular, there have been few studies that have attempted to analyze this problem in a rigorous way. This study argues that socio-cultural and institutional factors largely explain underreporting and consequently the increasing trend of rape in Cameroon. The findings of this study show that a high proportion of rapists are familiar to their victims and in order to avoid stigmatization, protect self-esteem, preserve family and community solidarity, these cases are often not reported officially or withdrawn from the court. The study also explains how the long, expensive and cumbersome process of seeking justice, the complex and flexible nature of law on rape and inadequate human and material resources all exacerbate the problem.;성폭력의 한 종류인 강간은 계층, 인종, 나이, 성을 불문하고 특히 여성과 여자아이들을 희생자로 만들며 전 세계적으로 증가하고 있다. 본 연구는 강간이 성행하고 있는 아프리카지역을 대표하여 특별히 카메룬의 사례연구를 살펴보려 한다. 현존하는 국가적, 국제적 방침들은 급증하는 성폭행문제를 해결하는 데 성공적이지 않았다. 특히 카메룬의 심각한 강간사건의 증가에도 불구하고, 그 동안 이 문제를 세밀하게 분석한 연구가 적었다. 본 연구는 사회문화적, 법적 그리고 제도적 요소들이 성폭력범죄의 낮은 신고율을 유발하고, 결과적으로 카메룬 내에서 강간이 증가하는 추세에 일조한다고 바라본다. 조사결과에 따르면, 높은 비율로 강간범들이 피해자들과 잘 아는 관계였으며, 많은 강간 사건들이 사회적 낙인을 피하기 위해, 자존감을 보호하기 위해, 가족들을 지키고 공동체의 유대감을 위해서 등의 여러 이유들로 공식적으로 신고되지 않거나 혹은 재판 중에도 판결 전에 법정에서 고소가 취하되는 것으로 나타났다. 본 연구는 정의를 실현하기 위해서 얼마나 길고, 많은 비용이 들며, 번거로운 절차가 필요한지와 복잡하고 유동적인 강간법의 특징 그리고 불충분한 인적, 물적 자원들이 이러한 상황들을 악화시키고 있는지 설명한다
