인터넷 경매에서의 매매 보호 및 상호신뢰를 위한 안전거래 매커니즘에 관한 사례연구

Abstract

With the rapid extension of internet and the development of IT, a variety of business models came to being and the dotcom bubbles have now started cooling down. Among those internet business models, the internet shopping mall has risen most sharply and took a big part of our lives. And furthermore, the internet auction is rising as an e-commerce model which is most effective to show the features of internet and IT. The way that the internet auction was able to build up the best market place, where customer and seller both win-win, was to combine the original flexibility and conference, which it took from the real auction, and the infrastructure of internet. However, various problems have been caused by the growth of internet auction, and the most controversial subject among them was the danger of the trading and safety mechanism. This study focused on the safety trading of the internet auction, analyzed the risk factors of the current internet auction sites through the analysis of practical cases, and examined the counter measure against those factors. We began to precede research on basic facts through defining overall concepts, grouping types, and analyzing market. And then, we pointed out that there was limit to solve the safety problems of internet auction trading on the rise with the existing law, and stated the mediation system of internet auction companies as a solution to explain the probability. On this basis, we examined the safety mechanisms which are in operation on line now with real cases. As the result of cases, as the internet auction market expands and victims rapidly increases, internet auction companies are controlling sanctions of the provisions of contracts and technologies so that both sellers and customers can be protected and fair auctions can be conducted. However, there is no difference among companies in those sanction measures, and the measures are no more than the level of sanction on system or advice. In addition, the adoption of more accurate and advanced safety trading mechanism is short. At several respects, it is important for the mediator of internet auction company to study and introduce diversified safety mechanisms for users continuously with legal complementary measures so that the effective internet auction, that gives benefit to both customer and seller, can be settled down in more expansive form both with mutual confidence and trading stability.;인터넷의 급속한 보급과 IT의 발전으로 인해 인터넷을 통한 다양한 비즈니스 모델들이 출현하였고, 현재는 닷컴 거품이 진정 국면에 접어들고 있다. 이러한 인터넷 비즈니스 모델에 있어 가장 큰 성장세를 보이며 우리 생활의 한 부분을 차지하게 된 것이 인터넷 쇼핑몰 분야이며, 이중에서도 인터넷과 IT의 특징을 가장 효과적으로 살린 전자상거래 모델로 인터넷 경매가 떠오르고 있는 상황이다. 인터넷 경매는 기존의 현실 경매가 갖고 있는 특유의 유동성과 합리성을 차용하고, 여기에 인터넷이라는 인프라를 결합시켜서 소비자와 판매자가 윈윈할 수 있는 최상의 마켓 플레이스를 구축할 수 있었다. 그러나, 이러한 인터넷 경매의 성장과 더불어 다양한 문제점들이 나타나게 되었는데, 그 중 현재 가장 화두로 떠오른 것이 바로 거래상의 위험과 이에 대한 안전 메커니즘 부분이다. 본 연구에서는 이러한 인터넷 경매의 안전 거래 부분에 포커스를 맞추고 이에 대한 실제적인 사례 분석을 통해 현재 인터넷 경매 사이트에서 나타나는 거래 상의 위험요인을 분석하고 이에 대한 대비가 어떻게 이루어지고 있는 지 탐색해 보았다. 먼저 인터넷 경매에 대한 전반적인 개념 정의와 유형 분류, 시장 분석을 통해 기본적인 사항에 대하여 선행연구를 하였다. 이어, 인터넷 경매에 있어서 현재 대두되고 있는 거래상의 안전 문제를 현행법으로 해결함에 있어 한계가 있음을 지적하고, 이를 중개자인 인터넷 경매 업체의 거래 시스템을 해결방안으로 들어 그 개연성을 설명한다. 이를 기초로 실제적인 사례를 들어 현재 인터넷 경매 사이트에서 시행되고 있는 안전거래 메커니즘에 대해 탐색한다. 사례 연구 결과, 인터넷 경매 시장이 확대되면서 이로 인한 각종 피해사례가 급증함에 따라 인터넷 경매 업체는 판매자와 소비자 모두를 거래상의 위험으로부터 보호하고, 정당한 경매 거래가 이루어질 수 있도록 법적 근거가 될 수 있는 약관상의 제재와 기술적인 제재를 통해 중간에서 조율하고 있다. 그러나, 아직까지는 이러한 제재 조치들에 있어 업체간의 차별성이 없고, 시스템 상의 제재와 권고 수준에 머무르는 측면이 많으며, 보다 확실하고 선진적인 안전거래 메커니즘의 적용이 부족한 상황이다. 여러 측면에서 소비자, 판매자에게 모두 득이 될 수 있는 효과적인 전자상거래 아이템인 인터넷 경매가 상호신뢰와 거래안정성을 모두 갖춘 보다 발전적인 형태로 자리잡을 수 있도록 앞으로 법적 측면의 보완과 더불어 중개자인 인터넷 경매 업체 측에서 끊임없이 이용자의 다각적인 안전 메커니즘을 연구, 도입하는 것이 중요하다고 하겠다.
