방송위원회의 지배구조와 방송 · 통신 통합규제기구에 대한 연구

Abstract

With the appearance of various media and services by the convergence of broadcasting and communication that began with the development technology, the border between the spheres of broadcasting and communication has become unclear and the regulation system of the laws on broadcasting and the laws on electricity and communication which had been applied to the respective area do not reflect the changes occurring in the converged environment. Consequently, the necessity for an integrated regulatory agency to control both broadcasting and communication has risen and the role of the Korean Broadcasting Commission and the Ministry of Information and Communication, the two main bodies for the integrated organization, is being paid much attention. Yet, the two organizations have been making conflicts in the process of the establishment of the integrated regulatory agency due to the fundamental thoughts about regulation - the public interest and efficiency. Regarding the approach of the broadcasting committee being in charge of the broadcasting area where the logic of social norm, the public interest, is applied more importantly than the logic of economy, which is fair competition, that is applied in the communication area, this study focuses on the control system of the broadcasting committee to reestablish the concept of ‘public interest’ and propose the direction in the establishment and operation of the committee of broadcasting and communication to be launched soon. For this, this study analyzes the control system of the broadcasting committee on the basis of its purpose establishment and legal status, and raise the necessity to reestablish the concept of ‘public interest’ that is the basis of the establishment of the broadcasting committee through the studies of the cases that affected the convergence of broadcasting and communication.;기술의 발달로부터 시작된 방송통신의 융합으로 다양한 매체와 서비스가 등장하게 되면서 방송과 통신 영역의 경계가 모호해지고 각각에 적용되던 방송법과 전기통신법 등의 규제체계가 융합환경에서의 변화를 반영하지 못하는 상황이 발생하였다. 이에 방송과 통신을 모두 관장하는 통합규제기관의 필요성이 대두되면서 통합기구의 양대 주체인 방송위원회와 정보통신부의 역할이 그 어느 때보다 주목 받고 있다. 그러나 두 기관은 공익성과 효율성이라는 근본적인 규제이념의 차이로 인해 통합규제기구 설립과정에 계속해서 갈등을 빚고 있어 통합기구출범에 난항을 겪고 있다. 본 연구는 상대적으로 공정경쟁이라는 경제논리가 적용되는 통신분야와 달리 공익성이라는 사회적 규범 논리가 보다 중요하게 적용되는 방송분야를 담당하는 방송위원회의 방통융합 접근방식에 대해 방송위원회의 지배구조에 초점을 두어 ‘공익성’개념의 재정립과 함께 향후 출범할 방송통신위원회의 설립과 운영의 나아갈 방향을 제언하는 것에 목적이 있다. 이를 위해 본 연구에서는 방송위원회의 설립목적 및 법적 위상을 토대로 사외이사로서의 방송위원의 역할, 방송위원회 구성원의 법적 신분, 모니터링 시스템, 방송위원회 노조 4가지 측면에서 지배구조를 분석하고 이 같은 지배구조 하에서 발생할 수 있는 방송위원회의 대리인 문제를 도덕적 해이와 역선택 측면에서 살펴보았다. 그리고 실제로 방송위원회의 지배구조가 방송통신융합에 영향을 미친 사례연구를 통해 방송위원회 설립의 근간이 되는 ‘방송의 공익성’ 개념의 재정립 필요성과 함께 현재 설립추진중인 방송통신위원회의 구성에 대하여 전문성, 효율성, 정책의 일관성을 보장할 수 있는 제도적 보완책 및 엄격한 감사 시스템을 제안하여 통합규제기구 도입에 정책적으로 기여할 수 있을 것으로 기대한다.
