dc.description.abstractThe purpose of this study is to examine critically the meaning of the theory of socialist civil society, which is newly discussed today, in the democratic transfomation process of society. The theory of socialist civil society emerges from the critique of statist trends in the democratic project of the exsisting left, on the background of the collapse of real socialism, the crisis of welfare state and the rise of new social movements. Socialist civil society theorists, therefore, suggest a new way of combination of democracy with socialism. This is the strategy of double democratization, which attempts to reform the state and civil society through two interdependent process: the democratization of the state power and the expansion of the autonomy of civil society. Historically, the distinction between civil society and the state is liberalistic terms in explaining its view of society : the former is regarded as the place of acting of free and equal individuals based upon capitalist market economy, while the latter is considered as the universal regulator which projects the order of civil society outside of it. But Marx took issue with this liberalistic view. According to Marx, the essence of civil society is the economic relations between the dominant and the dominated, which creates unequal class relationship. The state, he argues, is only the embodiment of specific interests which realize exclusive Bourgeoisie interests in civil society. Now, Advocators of socialist civil society criticize Marx that he had one-demensional recognition of modern civil society. He never knew that modern civil society has developed into a 'contradictory ensemble process' between capital ism and democracy. With this reason, they consider the civil society to be an autonomous and pluralist sphere and at the same time an realm which consists of multiful antagonism, conflicts and systematic inequalities. The state is no longer the body of expression of class relationship, but the protector of autonomous institutions in civil society. In this context, the strategy of double democratization is suggested to reform the state and civil society through interdependent process of the reconstruction of the state institution and the expansion of autonomy in civil society. Socialist civil society theory can be divided into two branches: one is the two-part model of the state and civil society, the other is a three-part model which separates economy from civil society. Keane proposes the two-part model. He attempts to reform the capitalistic contents of civil society in order to preserve the economic basis of socialist civil society. Keane regards capitalist civil society as an employment society based on paid-labour. Capitalist civil society makes a fetish of work and never provide free time for action. Keane accepts a dualistic society model of Gorz which distinguishes between the realm of necessity and the realm of freedom, and reduces socially necessary work to a minimum so as to maximize each person's free time for action. And Keane insists that the endless expansion of democracy be possible with introduction of relativism as a critique of ideology. Keane's argument has the following limitations. First, the attempt to transform the basis of capitalist civil society is meaningful, but this attempt stays in the ideal utopianism which is not feasible. That's because he does not analyze the relationship between capital and labour which As the essential basis of capitalist contradiction, but merely stresses the alienation of labour. Second, his identification of democracy in civil society with relativism seems to be linked to conservativism which accepts present orders rather than weakens present priviledged power relationship. Cohen and Arato formulate the three-part model of the state- civli society-economy with introduction of the system and lifeworld of Habermas. They distinguish between the logics of the political and economic systems, regulated by administrative power and money, and civil society, or the lifeworld, which is based on that of solidarity and communication. And these three generate the integration of society in their fuctionally interdependent activities. Hence, their democratic project has more self-limited characteristics than that of the two-part model. They suggest discourse ethics as a normative basis of civil society. Arguments of Cohen and Arato have the following problems. The problem is whether capitalist economy can be treated only as a matter of economic rationality. Moreover, dicourse ethics can't fulfill the whole contents of democratic legitimation by narrowing it into procedual meanings excessively. Socialist civil society theory has the significance in terms of its critique of existing statist approach and the proposal of the expansion of democracy into civil society. But the reason why they can't present an alternative beyond the reform of institution in the strategy of double democratization is that they disorganize the internal linkage of the civil society and capitalist economy. In this respect, despite of its attempt to integrate Liberalism and Marxism, socialist civil society theory has the limitations as a liberal leftist.;본연구의 목적은 최근에 새롭게 제기되고 있는 사회주의적 시민사회론이 사회의 민주적 변혁과정에서 지니는 의의를 비판적으로 검토하는 데 있다. 사회주의적 시민사회론은 현존사회주의의 붕괴와 서구에서의 복지국가의 위기, 신사회운동을 배경으로, 기존좌파의 민주주의 프로젝트에서 나타나는 국가주의적 경향을 비판하면서 출현하였다. 따라서 이들은 민주주의와 사회주의 간의 결합방식을 새롭게 제기한다. 그것은 국가에 과도하게 집중되어 있는 권력의 분산을 통한 국가의 민주화와 시민사회에서의 비국가적 행위의 확대와 조정을 통한 시민사회의 민주화라는 이중민주화 (double democratization)전략이다. 역사적으로 볼 때, 국가와 시민사회라는 분석틀은 자유주의 사회관으로, 시민사회는 자본주의적 시장사회를 기반으로 "자유롭고 평등한" 개인들이 활동하는 장소로, 국가는 시민사회의 외부에서 시민사회의 질서를 보호하는 보편적 규제자로 간주되었다. 그러나 이것은 맑스(Marx)에 의해서 비판되고 전도된다. 그에 따르면, 시민사회의 본질은 계급들 간의 불평등을 산출하는 지배-피지배의 경제적 관계에 있으며, 국가 역시 시민사회 내 부르조아 계급의 이해관계를 배타적으로 관철하는 특수이익의 구현체에 불과한 것이었다. 그러나 사회주의적 시민사회론자들은 맑스의 근대시민사회론에 대한 인식이 일면적인 것이었다고 비판한다. 왜냐하면, 근대사회는 자본주의와 민주주의 간의 "모순적 접합과정"(contradictory ensemble process)으로 발전해 왔기 때문이다 따라서 이들에게 시민사회는 자율적이고 다원적인 공간이자 동시에 복수적인 적대와 대립, 그리고 체계적인 불평등으로 구성되는 영역으로 간주된다. 국가도 더 이상 계급관계의 표현물이 아니다. 시민사회의 자율적 제도를 보호하는 것으로 간주된다. 이러한 맥락에서 국가제도의 재구조화와 시민사회의 자율성의 확대라는 상호연관된 과정을 통해 국가와 시민사회를 동시에 변형하려는 이중민주화 전략이 제시된다. 사회주의적 시민사회론은 국가와 시민사회의 이분모델과 시민사회영역에서 경제를 분리시키는 삼분모델로 구분된다. 킨(Keane)에 의해 주장되는 이분모델은 사회주의적 시민사회의 경제적 토대를 확보하기 위해 시민사회의 자본주의적 내용을 변화시키고자 한다. 그가 보는 자본주의적 시민사회는 임금노동에 기초한 고용사회이다. 이 사회는 노동을 물신화하고 인간이 자유롭게 활동할 수 있는 시간을 제공하지 못한다. 따라서 킨(Keane)은 시민사회를 사회주의적 내용으로 채우기 위해 고르즈의 이원화 사회모델, 즉 사회를 필요의 영역과 자유의 영역으로 나눠 자율적 활동의 극대화를 위해 노동시간을 단축하고 삶을 위해 더 많은 시간을 활용할 수 있는 모델을 받아들인다. 또한 시민사회내의 이데올로기 비판의 도구로서 킨(Keane)은 상대주의를 도입해 민주주의의 무한한 확장을 주장한다. 그러나 킨(Keane)의 논의는 다음과 같은 문제점을 지닌다. 첫째, 자본주의적 시민사회의 토대를 변화시키려는 시도는 의미가 있지만, 그 방식은 실현가능성이 없는 관념적 유토피아의 구상에 머무르고 있다. 그 이유는 무엇보다도 그가 자본주의 모순의 근본 토대인 자본-노동관계를 분석하지 않고 단순히 노동의 소외된 측면만을 강조했기 때문이다. 그리고 시민사회에서의 민주주의를 상대주의논리와 연결시킨 것은 기존의 특권적 관계를 약화시키기 보다는 오히려 현존질서를 인정하는 보수주의로 연결될 수 있는 것 같다. 코헨(Cohen)과 아라토(Arato)는 하버마스(Habermas)의 체계와 생활세계 모델을 도입하여 국가-경제-시민사회의 삼분모델을 정식화한다. 이들은 현대사회의 구성을 권력에 의해 매개되는 국가와, 화폐에 의해 매개되는 경제, 그리고 연대와 의사소통에 기반하는 시민사회가 기능적으로 상호의존적 활동을 하면서 사회통합을 가져온다고 본다. 따라서 이들의 민주주의 기획은 이분모델보다 더 자기제한적인(self-limited) 성격을 띠고 있다. 또한 이들은 시민사회의 규범적 기초로 담화윤리(discourse ethics)를 제시한다. 그러나 아라토(Arato), 코헨(Cohen)의 논의 역시 다음과 같은 문제점을 지닌다. 자본주의 경제가 단지 경제적 합리성의 영역으로 국한되어 사고될수 있는가라는 문제다. 또한 담화윤리 역시 지나치게 절차론적 의미로 협소화됨으로써 민주적 정당성의 내용을 채울 수가 없다. 사회주의적 시민사회론은 기존의 국가주의적 접근을 비판하고 시민사회의 다양한 영역으로 민주주의의 확장을 주장했다는 점에 그 의의가 있다. 그러나 이들이 이중민주화 전략속에서 제도개혁 이상의 대안을 내놓지 못한 이유는 무엇보다도 그들이 국가와 시민사회가 자본주의 경제와 맺고있는 내적 연관성을 해체하려했기 때문이다. 이점에서 사회주의적 시민사회론은 자유주의와 맑스주의를 통합하려함에도 불구하고 여전히 "자유주의 좌파"로서의 한계를 갖는다.-
