Bismarck 사회보장제도에 관한 연구

Abstract

본 논문의 목적은 Bismarck 집권기의 사회보장제도 형성에 영향을 끼친 요인들을 정치·경제·사회·문화등의 배경에서 찾아내고, 그것에 의해 Bismarck 사회보장 발달상의 특징을 규명하는 것이다. 이러한 목적을 위한 연구내용으로 Bismarck집권기 (1862-90) 동안의 사회보장 제도를 3대 사회보험입법-의료보험 (1883), 재해보험 (1884), 노령 및 폐질보험(1889) -에만 국한하여, 사회보험입법에 영향을 끼친 배경적 요인들을 고찰하였다. 그리고 사회보험의 입법과정에서 그 배경적 요인들이 어떻게 상호작용했는지 검토하였다. 그 내용을 요약하면 다음과 같다. Bismarck 집권기의 사회보험은 가부장제적 사고를 가진 봉건 Junker귀족들이 기존질서를 유지하기 위해 취했던 권위주의적 국가정책이라는 정치적 요인과 급격한 산업화 과정에서 발생한 사회문제라는 사회구조적 요인, 그리고 강단 사회주의자들을 중심으로 주창된 국가보호 이론이라는 문화적 요인이 상호작용한 결과라 할 _수 있다. 이때 Bismarck 집권기의 사회보장발달에 가장 커다란 영향을 끼쳤던 것은 정치적 요인으로 사회보험입법은 노동자계급을 국가에 결속시키기 위한 사회정책적 도구의 성격을 띠고 도입되었다는 점이 특징이다. 정치적 요인이 가장 크게 작용하는 가운데 도입된 Bismarck사회보장 발달상의 특질은 다음과 같이 세가지로 요약될 수 있다. 첫째 사회보험으로 대표되는 Bismarck 사회보장제도는 강제적인 국가계획에 의해 관주도형으로 성립을 보게 되었다는 것이다. 둘째 국가가 주도했다는 점과 관련하여 그 성립동기가 수단적인 성격을 지니고 있다는 사실이다. Bismarck 사회보험제도의 일차적 목표는 정치안정과 기존질서의 유지이다. 끝으로, 제도적인 면에서 볼때 사회보험은 계급주의적 사회구조를 보험체계의 근간으로 하는 수평적·분산적 구조를 특징으로 한다. Bismarck 사회보험은 국가가 주도한 세계최초의 사회보장정책의 하나로 오늘날까지 제도의 골격이 유지되면서 독일 사회보장제도의 근간을 이루고 있다. 뿐만아니라 세계 사회보장사에 획기적 전환을 가져온 제도로서 세계각국의 사회보장제도 발달에 지대한 영향을 끼쳐왔다. 이러한 점에서 Bismarck 사회보장제도에 관한 연구는 한국적 사회·경제질서에 적합한 사회보장의 유형을 발견하는데 시사하는바 크다 하겠다.;The main objective of this study is to analyze the forces that had caused the development of social security in Bismarck's Germany, based upon political, economic, and socio-cultural conditions, and then to characterize the nature of the development. In this study, social security in Bismarck's Germany(1862-90) is limited to the 3 social insurance legislations-Health Insurance(1883), Accident Insurance(1884), and Old Age and Invalidity Insurance(1889)-, and will be showed interaction of the determinant factors influencing their system. The background forces affecting them can be considered on the 3 factors : the 1st factor is authoritative state policy, the 2nd is industralization and social problems, the 3rd is social movements and academic socialists. This thesis consist of 4chapters. Chapter 1 presents the purpose,scope of the study. Chapter 2 deals with the theoretical background of the development of social security. Chapter 3 analyzes the political, economic, and socio-cultural factors affecting its development in Bismarck's Germany. Chapter 4 brings to an end that the development of social security in Bismarck's Germany in significantly affected by the political factor. Therefore the development of social security in Bismarck's Germany can be characterized by political instrumentalism, which will help us find the most suitable pattern of social security in Korea.
