정치적 이해에 따른 ‘북한여성인권’ 문제제기 맥락에 관한 연구

Abstract

본 연구는 최근 식량난 이후 국내외에서 제기되고 있는 북한여성인권문제가 과연 북한여성인권 개선을 위한 현실적인 논의인가라는 물음에서 시작했다. 북한여성인권 문제는 식량난을 계기로 국제적으로 알려졌지만 식량난 이전에 북한에 여성인권의 문제가 없었던 것은 아니다. 최근 들어 북한여성인권문제가 본격적으로 제기되는 데는 미 의회의 북한인권법안 통과가 기폭제가 되었다. 그런데 이러한 미국을 비롯한 국제사회에서 북한인권문제를 제기하는 것에 대해 기존에 남한에서는 크게 두 가지 입장으로 나눠져 논쟁을 벌여왔다. 먼저 한 입장은 미국이 주장하는 자유권을 중심으로 북한정권의 정치 시민적 권리의 제한에 주로 주목한다. 이와 달리 또 다른 입장은 북한인권은 안으로부터의 시각을 갖고 사회권을 중심으로 봐야 한다고 주장한다. 이들은 전자 입장이 북한정권의 붕괴를 목적으로 북한인권문제를 이용하고 있다고 비판한다. 특히 북핵문제가 발생한 시점에 미국과 연대한 남한 NGO들 사이에서 북한인권문제가 제기된 것과 그 결과 만들어진 입법안들의 내용이 주로 북핵문제와 탈북한 북한주민들의 인권문제에 집중되어 있는 것은 이러한 비판을 뒷받침해주고 있다고 볼 수 있다. 그러나 이들은 구체적으로 어떻게 국제사회에서 북한인권문제를 정치적으로 이용하고 있는지에 대해서는 정확한 논거를 제시하지 못하고 있다. 또한 이들의 거시적․정치적 관점의 비판은 실질적으로 북한 주민개인들의 삶의 개선에 영향을 미친다고 보기 힘들다. 이러한 점에서 본 연구는 국제사회에서 제기하고 있는 북한인권문제가 실제 어떻게 구성되어 제기되고 있는지를 보았다. 이것을 보기 위해 특히, 북한여성인권문제제기를 위해 사용된 북한이주여성 증언이 어떻게 구성되어 사용되었는지를 분석하였다. 본 연구는 북한이주여성들의 증언을 사용해서 구성되고 제기되는 북한여성인권문제제기가 정치적 전략화의 맥락에서 이루어지고 있다는 것을 밝힘으로써, 북한여성인권문제 해결을 위한 실질적 논의의 방식과 그 가능성을 고찰하는 것을 목적으로 했다. 현재 미 의회 청문회와 국제회의를 통해 제기되고 있는 북한인권 문제의 초점은 주로 정치범수용소 문제와 여성들의 인신매매 문제다. 남성들의 경우는 대부분 정치범수용소 경험자들이 국제회의나 청문회에서 증언을 했다. 북한이주남성의 ‘정치범수용소’ 경험은 ‘정치범’이라는 타이틀이 말해주듯이 정치적으로 ‘정의로움’의 수행을 위해 고통을 당한 피해자라는 이미지를 만들어낸다. 따라서 북한이주남성의 증언은 인권의 정치적 전략화의 맥락 속에 있다 하더라도 적어도 낙인을 발생시킨다고 보기 힘들다. 이에 반해 북한이주여성 증언은 북한(이주)여성들의 인신매매와 같은 성적 학대 경험에 주로 초점을 맞추고 있다. 이 때 북한이주여성 증언자들은 소수 여성들로만 구성되어 있다. 이렇게 소수 여성들에 의한 증언 수행의 반복은 다양한 여성들의 경험을 획일화시켜 버린다. 이렇게 문제제기부터 증언자에 대한 낙인 발생까지 문제는 증언의 선정적 유통 방식에 있다. 즉 재중 북한여성들의 인신매매 문제나 북한내부에서 여성들이 당한 성적 수치심에 대한 것만을 부각시키는 특정한 방식의 문제제기는 여성들의 개인적인 수치나 희생을 무시하는 것으로써, 여성이 당한 고통을 대상화하는 남성 중심의 시각이 내재된 문제 표출 방식이라고 볼 수 있다. 또한 이렇게 특정한 문제만을 부각하는 주체들은 ‘북한’이라는 특수한 역사적 사회적 배경에 처해 있는 여성들의 인권문제를 제대로 보고 있지 않다. 북한은 유교식 사회주의 국가로서 가부장제 이데올로기의 토대에 있는 체제이다. 그렇기 때문에 가부장제의 맥락이 식량난을 만나면서 일어난 현재의 북한여성인권문제는 시민 정치권적 측면과 생존권을 포함한 사회문화적 권리가 맥락마다 개입되어야 하고, 또한 그 인권내용들 간에 우선돼야 할 것은 무엇인지 경합해야 하는 등의 문제들이 혼재되어 있다. 따라서 이렇게 혼재된 문제를 외면하고 있는 현재의 북한여성인권문제제기는 실질적인 북한여성인권개선에 도움이 안 되는 빙식으로 이루어져 있다고 할 수 있다. 따라서 본 연구는 90년 중후반부터 지금까지 국제적으로 이슈화되어 문제제기 되고 있는 북한여성인권문제가 실질적인 해결책이 되지 못하고 정치적 패권 다툼의 장에서 이용되고 있다는 것을 밝힘으로써, 북한여성 및 북한이주여성 인권은 어떻게 제기되어야 하며, 앞으로 보다 실질적인 문제제기가 이루어지기 위해서는 어떤 접근 방식이 필요한지를 고민하도록 유도하는데 의의가 있다.;This study started from a question that recent arguments about North Korean women's right both in South Korea and the world are genuine for the improvement of North Korean women. The issue, North Korean women's rights, has not become known to the world until the time of food crisis in North Korea. The issue was not new one, however, there had not been discussions about the problem before the crisis. It was the pass of the North Korean Human Rights Act in the U.S. Congress that made the problem an international issue. There has been an controversy on the North Korean human rights in South Korea in two sides. Some point out unreasonable restrictions of liberty by North Korean government. The others assert that North Korean human rights is to be considered from the perspective viewing the inside of the society. They criticize the opposite position to take advantage of North Korea's situation for the collapse of North Korean government. Their point is supported by the fact that the issue on North Korean human rights was posed at the time that the North Korean nuclear crisis, and the bill for the prohibition of the development of nuclear weapon emphasize on the North Korea's nuclear problem and human rights as well. But they don't present concrete evidence how the issue of North Korean human rights is used for political purposes. It is difficult that their political, macroscopic criticism improve personal lives in North Korea. This study inquires how to constitute the issue of North Korean human rights in international society and analyze testimonies by the north korean women residents are used for the raising questions on the North Korean women rights. This study is intended to explore ways to improve the North Korean women's human rights, arguing testimonies of the north korean women residents are used in consonance with specific political strategies. The hearing of U.S. Congress and international conference on the North Korean human rights problems are focused on the political prisoner’s camp and women traffic. Testimonies of the experience in "political prisoner’s camp" generate the image of victims for '"justice" in suggestion the title of "political prisoner." Therefore, testimonies of the north korean residents are not stigmatized. On the contrary, testimonies of the north korean women residents emphasize on sexual abuse like women traffic. Only a small number of women testify their experiences and repeat their testimonies, which make diverse experiences of North Korean women regarded as a simple and standardized one. The circulation of sensational testimonies is one of the main causes in these problems. They accentuate women-related problems such as North Korean women traffic in China and sexual abuse in North Korea. There is a male-centric viewpoint in this perspective that objectify the sufferings of women. The solution of the problem of women's rights in North Korean need to understand the historical, social context of the country. North Korea is a confucian socialist state based on patriarchal ideology. The problems of North Korean women's right got serious patriarchal situation mixed with food crisis. For this reason, approaches to the problem of North Korean women's human rights should be considered as the civil political rights and social cultural rights including the rights to live. These rights are in conflict with each other in circumstances. Any arguments turned away these complexity cannot be a substantial solution for the improvement of the North Korean women's human rights. This study clarifies the issue of the North Korean women's human rights used for political supremacy in international society from the mid of 1990s. These political arguments are not substantial solutions to improve the North Korean women's human rights. This study suggests to approach different way in the issue for the improvement of the right of North Korean women and residents as well.
