dc.description.abstractThis study investigates how affirmative action has been implemented and applied by actors who have different interest in an individual enterprise. The affirmative action has attempted to attain equal employment by correcting existing discrimination. The United States has used goal and timetables to address employment discrimination. Some critics, however, argue that its system imposes reverse discrimination against men. In addition, individual companies have resisted setting a goal for women and minority due to reasons that it would undermine the personnel system already in effect which hires and promotes according to merit and ability. Consequently, affirmative action is a very controversial and sharply conflicting system. Existing studies on affirmative action have focused mainly on the law, the factors, policies and problems related to establishing an overarching system of affirmative action or government-related issues. Few studies have examined the actual space of political contestation by those directly affected by affirmative action policies. In addition, they do not explain the reasons why the government would enact pro-woman affirmative action policies or the circumstances in which those most concerned and affected by affirmative action policies have sharply conflicting opinions. I would like to focus specifically on how affirmative action is introduced, rejected and challenged by actors in an individual enterprise. Although affirmative action has been in effect in many different enterprises in the U.S. since the early 1970s, many companies in Korea have rejected the introduction of affirmative action on the grounds that it violates the autonomy of the company and decreases productivity. I selected AT&T as my research case study. AT&T was the first American company to develop a systematic model for affirmative action. I referenced books, materials, articles and related documents as well as conducted interviews with persons responsible for developing and introducing this model in order to more concretely understand the process in which affirmative action is implemented. The research findings are as follows: First, women s organizations that emphasized equal employment and foregrounded gender equality for the empowerment of women played a key role in developing pro-woman affirmative action policies with substantial content. Organizations associated with the women s empowerment and human rights movement filed a lawsuit against AT&T which charged the company with job segregation by gender and race. AT&T was also required to conduct surveys that reveal the disparate impact between men and women and make these results public. As a result, AT&T was forced to implement policies that addressed gender inequality in the workplace and actually resulted in equal employment. Second, during the initial period in which AT&T developed and executed a model for affirmative action, the intervention of a pro-woman government administration played a key role in alleviating the resistance of individual company, trade union and male workers. The Company opposed affirmative action on the grounds that it would abolish the personnel system in effect. Male workers rejected affirmative action because they regarded it as reverse discrimination. Trade union also opposed affirmative action by filing suits that charged the system of affirmative action with violating the seniority system already guaranteed by collective bargaining agreements. Due to these factors, it is clear that the process in which affirmative action was implemented took place in a highly contested political space. The state intervention played an important role of weakening those who intensely challenged affirmative action and forcing AT&T to adopt the system. Third, the implementation of an affirmative action policies by AT&T generated both intentional and unintentional effect which had it be continuously implemented despite there were many factors in making the employment status unstable. In terms of intentional effect, AT&T reduced gendered job segregation and employment practice. In terms of unintentional effect, an equal personnel system was implemented, affirmative action policies were introduced in the trade union, differential gendered impact in the workplace was reduced and efforts to build new solidarity between women were forged. In conclusion, I argue that the process by which an individual company implements affirmative action policies in the contested terrain and enacts equal employment policies has both intentional and unintentional effect by actors who have different interest. Specifically, it is clear that women s activities played a key role in changing affirmative action to a pro-woman system and revealing both invisible and visible discrimination against women. I tried to address the shortcomings of existing studies that only partially understood the effect of affirmative action by focusing specifically on the level of the law or the system itself. Also, by including women s various practice both inside and outside the workplace, including struggle within the women s movement, and by explaining the process by which affirmative action was introduced through the context of gender politics, I would expose the problem of gendered power and expand the current area of analysis. ; 이 논문은 적극적 조치가 사기업에서 도입되는 과정을 살펴보면서 사회세력에 의해 이 제도가 어떻게 수용되고 유지되는지를 파악하는 데 연구목적을 두고 있다. 적극적 조치는 차별적인 고용관행을 시정함으로써 남녀 고용평등을 실현하기 위한 제도로 미국은 1960년대부터 직접차별 뿐 아니라 구조화된 간접차별을 교정하기 위해 고용목표 비율의 설정과 이행계획서를 적극적 조치의 실행방법으로 채택해 왔다. 그런데 이와 같은 방법이 남성에게 역차별이라는 비판을 불러 일으켰고 특히 사기업으로부터는 능력에 기초한 인사관행을 무너뜨리는 제도라는 반발을 야기시켰다. 이 논문은 논쟁적이고 행위자간의 이해관계의 대립이 첨예할 수 있는 적극적 조치가 사기업에서 어떠한 과정을 거쳐 도입되고 수용되면서 유지되는지를 밝혀 보고자 하였다. 적극적 조치에 관한 기존 논의는 주로 법·제도 차원의 분석으로 이 제도가 도입되는 정치적인 현실의 장을 상정하고 있지 못하거나 법과 제도, 국가만을 이 제도의 도입과 관련해서 중요한 변수인 것으로 분석하고 있다. 또한 행위자들간의 이해관계의 대립이 첨예한 정책적 사안에 대해 국가가 어떠한 요인에 의해 여성 친화적일 수 있는지에 관해 설명하고 있지 못하다. 이 논문은 이러한 문제인식으로부터 출발해서 적극적 조치가 사기업에서 도입되는 과정을 살펴보면서 어떻게 수용되고 유지되는지를 파악하고자 하였다. 국내에서는 적극적 조치가 기업의 자율성을 침해하고 생산성을 저하시킬 수 있다는 이유로 이 제도의 도입을 반대하고 있는데 반해, 미국은 1970년대 초부터 사기업에서 실행해 오면서 제도화되어 있는 상태이다. 이 논문은 연구대상으로 미국에서 사기업 최초로 적극적 조치 모델을 개발한 AT&T사를 선정했고 연구방법으로는 문헌 연구와 면접을 택하였다. 또한 적극적 조치 모델을 개발하고 실행하는 데 관여했던 관계자와의 면접을 통해 1차 자료를 수집하고 분석함으로써 도입과 수용 과정을 구체적으로 밝히고자 하였다. 연구의 결과 첫째, 적극적 조치가 여성 친화적인 제도로 확대되는 과정에서는 평등을 여성주의의 목표로 표방한 여성단체의 출현과 여성운동의 세력화가 이 제도를 남녀고용평등을 실현하기 위한 내용으로 변화시킨 주요한 요인이었다. 성별 직무분리에 대한 여성의 법적 대응, 간접차별과 결과적 평등 개념을 확산시킨 여성운동의 세력화, 간접차별을 가시화시킨 정부기구의 조사활동, 청문회를 통한 고용 차별의 공론화와 연대활동을 강화하는 여성운동의 사안(agenda) 중심의 통합주의 전략이 사례기업으로 하여금 이 제도를 도입하게 한 요인인 것으로 파악되었다. 둘째, 사례기업이 적극적 조치 모델을 개발하고 실행하는 초기 과정에서는 여성 친화적인 국가 권력의 개입이 기업과 개별 남성, 노동조합으로부터의 반발을 약화시키면서 이 제도를 수용하게 한 요인인 것으로 나타났다. 기업은 적극적 조치의 도입이 능력에 기반한 기업의 인사 관행을 무너뜨려 생산성을 저하한다는 이유로 거부감을 보였고, 남성은 적극적 조치가 실행되는 과정에서 이 제도가 남성에게 역 차별적이라는 이유로 반발하였다. 또한 노동조합은 적극적 조치가 단체협약에서 보장하는 노동자의 선임권(seniority)을 위반한다는 이유로 반대하면서 법적 소송을 제기하였다. 이와 같이 적극적 조치는 여성의 이해, 자본의 이해, 남성의 이해, 노동조합의 계급정치가 상호 대립하고 충돌하는 장에서 실행되었는데 그 과정에서 국가권력의 개입은 이 제도에 반대하는 사회적 세력의 힘을 약화시키면서 사례기업이 적극적 조치를 수용하게 하는 데 주요한 변수로 작용했다. 셋째, 사례기업에서 적극적 조치가 수용되는 과정에서는 사회세력이 고용평등을 실천하고 경험하면서 창출한 의도된 결과와 의도되지 않은 결과에 의해 이 제도가 유지된 것으로 파악되었다. 적극적 조치가 의도했던 결과로 나타난 성별 직무분리의 완화와 고용확보는 이 제도가 의도하지 않았던 결과인 기업의 성 평등적인 인사제도, 노동조합의 적극적 조치 도입, 여성의 간접차별에 대한 도전과 새로운 여성연대의 형성 등과 함께 적극적 조치가 사례기업에서 수용되도록 영향을 미친 요인인 것으로 파악되었다. 결론적으로 사기업이 남녀고용평등을 실천하는 과정은 적극적 조치가 사회세력에 의해 수용되고 행위주체간의 각축이 전개되는 가운데 이 제도가 의도한 결과와 의도하지 않은 결과에 의해 유지되는 것으로 나타났다. 특히 기업 안팎에서 행해진 여성 주체의 다양한 실천활동은 적극적 조치를 여성 친화적인 제도로 변화시키고 작동시킨 요인인 것으로 밝혀졌다. 이 논문은 적극적 조치를 법 제도적 차원에서만 접근하거나 행위 주체가 적극적 조치의 실행에 미친 영향을 부분적으로 파악하는 기존 논의의 한계를 보완하고자 했다. 또한 기업 안팎에서 행해지는 여성의 다양한 실천 행위를 여성운동의 개념에 포괄하고 제도의 도입과정을 성 정치의 맥락에서 설명함으로써 정책 분석에서 성별화된 권력관계의 문제를 제기하여 분석의 영역을 넓혔다는 점에서 연구의의가 있다.-
