Abstract
본 논문은 일제하 조선에서 시행된 기독교관련 법령들의 내용과 그에 대한 조선기독교의 대응을 분석하면서, 일제하 조선기독교 정책의 성격을 법제적인 측면에서 조명한 것이다. 대상이 된 주요 법령들은 ‘포교규칙’(1915, 조선총독부령 제83호), 1908년 ‘사립학교령’(칙령 제62호)을 시작으로 병합 이후의 사립학교규칙들, 그리고 ‘조선민사령’의 공익법인관련 규정과 ‘법인의 설립 및 감독에 관한 규정’(1912, 조선총독부령 제72호)이다. 기독교 포교기관에 대한 법령과 기독교 선교사업의 주력인 사립학교에 대한 법령들과 함께, 이러한 사업과 조직운영의 독립성 내지 지속성과 연관된 법인관련 법제들이라 할 수 있다. 이들 법제들은 행정적인 통제법규들로 기독교의 조직과 사업을 恒時적으로 규율한 것들이다. 따라서 조선기독교에 대한 통제의 일상성을 잘 드러내 준다. 이들 법제들의 母法은 1899년 일본에서 제정된 법령들로, 일본과 서양열강간의 불평등조약이 개정된 시점에서 등장한 것들이었다. 국가신도를 초월적인 위치에 놓은 공인종교체제를 구축한 근대일본은 서구와의 관계에서 천황제 국체론에 대항성을 가진 기독교를 공인할 수밖에 없었다. 그 대신 이들 법제들을 활용하여 기독교세력의 확대를 막고 체재내화하려 한 것이다. 일본 자신의 경험은 그대로 식민지 조선에서 확대재생산되었다. 서양각국이 조선에서 누리던 치외법권 등의 문제가 해결되지 않았던 병합전후의 시기에는 외교적인 교섭을 통해 사립학교에 관한 법제의 이식이 이루어졌다. 치외법권문제와 서양거류지문제가 타결된 후, 1915년에야 기독교 통제법령이 완비되었다. 이식된 모든 법제들은 종교교육의 완전금지에서 단적으로 드러나듯이 母法인 일본법령에 비해 통제성이 강화되어 있었다. ‘포교규칙’과 ‘개정사립학교규칙’으로 기독교의 기관과 학교를 통제하면서 법인설립은 허용하지 않는 것이 1910년대의 기본정책이었다. 식민정책의 전환이 이루어진 1920년대에는 선교사들의 요구를 반영하는 방식으로 관련 법령들이 개정되었다. 포교소 설치허가제를 신고제로 전환하고 사립각종학교에서의 종교교육을 허용하는 개정이 이루어졌지만, 그 외의 부분에서 법제의 내용은 사후통제성이 강화되어 있었다. 이 시기 기독교정책에서 가장 큰 변화라고 할 수 있는 것은 기독교단체에 대한 법인설립의 허용이다. 이로 인해 1910년대에 이식된 법인관련 법제들이 시행되도록 되었지만, 이 역시 선교회법인과 장로교 노회법인에 대한 차별적인 법 적용을 노정한 것이었다. 1930년대 이후 전시체제기로 접어들면서 조선기독교에 대한 통제정책은 더욱 노골화되었다. 1939년 일본의 ‘종교단체법’이 조선에는 시행되지 않는 대신, 성결교가 포교규칙에 의한 포교소 폐지의 형식으로 해산된 것과 같이 기존의 법령들이 확대되어 활용되었다. 장로교 선교회들은 학교사업에서 철수했고, 장로교 노회들의 법인설립은 미완성으로 끝났다. 선교회들의 재산은 敵産으로 당국에 압류되었고, 조선교회들은 1945년 7월 ‘일본기독교조선교단’으로 통합되는 길을 걸었다. 이같은 법제의 운용에 대해 조선기독교의 대응은 때로는 선교회와 조선교회, 교파별로 다르게 나타났다. 선교사들은 일제 전 시기를 통해 식민당국과의 교섭통로를 유지했고 이를 통해 자신들의 입장을 표명할 수 있었다. 선교사들은 때로는 교파간 연합기구의 구성을 통해, 때로는 교파별로 각자의 이해관계를 반영하려 했고, 조선교회의 입장을 정리하고 대변하는 역할도 담당했다. 교섭의 결과는 일본과 서양간의 관계나 일본과 조선 내부의 정치상황 등에 따라 시기적으로 달랐지만, 조선교회와 비교했을 때 선교사들이 식민당국과의 교섭에서 유리한 입장에 있었던 것이 사실이다. 조선교회의 경우 그 대응양상은 주로 장로교회를 통해 드러난다. 장로교 노회들은 1910년대부터 1940년대까지 지속된 법인설립운동의 주역이었다. 또한 노회들은 1920년대 지정학교 승격운동에의 참여를 계기로 중등사립학교에 이사진을 파견하도록 되었고, 이를 기반으로 1930년대 중반 이후 학교인수에 적극적으로 참여했다. 1915년 포교규칙관련 교섭으로 시작된 장로교의 법적인 투쟁은 처음에는 미미했지만 끊임없이 이어졌고 2/3가량의 법인설립과 일부 사립학교의 생존이라는 결과를 낳았다고 할 수 있다. ;This thesis focuses on the legal aspects of the Japanese Imperialism’s policies to the protestant missions and churches in Chosun through analyzing the contents of Christian related laws and the response of Chosun missions and churches to these laws. The main laws that became the subject of the study are ‘The Regulations for Religious Propagation’(1915, Government-General Ordinance No. 83), the regulations on private schools enacted after the Annexation including the 1908’s ‘The Law Regulating Private Schools’(Edict No. 62, 私立學校令), the regulations on corporate bodies of ‘The Chosun Civil Affairs Ordinance’(1912) and ‘The Rules on the Permission and Supervision of Incorporation’(1912, Government-General Ordinance No. 72). These are laws with regard to the Christian propagation organizations, the Christian private schools which were the main force behind the missionary work, and the independency and the consistency of such works and organization. These laws were administrative regulations that monitored Christian works and organizations at all times. Thus, they show the conventional regulation the Japanese colonial authorities had on Chosun Christianity. The roots of these laws lie in the legislations enacted in Japan in 1899, which was when the unequal treaties formerly met between Japan and the Western powers were being revised. During the early Meiji period Japan built an authorized religious system that put State Shinto on a transcendental position. Though the Meiji Government recognized Christianity as a religion that went against State Shinto, they had to approve it officially concerning their relationship with the West. Instead, Japan used these laws as a tool to prevent the expansion of Christianity and absorb it within their religious system. Japan’s such experience expanded on an enlarged scale in colonized Chosun. Around the time of Annexation the extraterritoriality problems related to the Western nations weren’t solved. During this time the laws of mainland Japan on private schools were transplanted into Chosun through diplomatic negotiations. It was not until the foreign settlement problems were solved when the controlling laws on Christianity was completed in 1915. As it is shown in the total prohibition of religious education, the laws in Chosun were far more strengthened and regulating than their Japanese mother laws. Controlling Christian churches and private schools and not allowing the establishment of incorporations through ‘The Regulations for Religious Propagation’ and ‘The Revised Regulations for Private Schools’(1915) were the basic policy in the 1910’s. In the 1920s Japanese colonial policies underwent changes. The Christian related laws were revised in a way of reflecting the requests of the missionaries. Though the previous permitting system of propagation facilities was changed into a reporting system and religious education in private schools was allowed, the contents of the law tightened postcontrol in other sections. The permission of Christian incorporation was the largest change in Christian policies of this time. ‘The Chosun Civil Affairs Ordinance’ and ‘The Rules on the Permission and Supervision of Incorporation’ were finally applied to Christian groups in 1912. However, even such actions were used to expose the discriminative application of law to the mission incorporations and the local presbyteries. As Imperial Japan shifted into a wartime regime after the 1930s, the Christian controlling policies became more conspicuous. Instead of enforcing the 1939’s ‘The Religious Group Law’(宗敎團體法) of Japanese mainland in Chosun, the existing laws were implemented on a wider scale, just like the Holiness Church was dispersed by the abolition of its propagation facilities by the effect of ‘The Regulations for Religious Propagation’. The Presbyterian missions withdrew from their school business and the establishment of local presbytery incorporations remained incomplete. The property of the missions was defined as an enemy property and confiscated by the authorities. The Chosun church was eventually absorbed into ‘The Chosun Church Group of The Japanese Christianity(日本基督敎朝鮮敎團)’ in July, 1945. The response of the Chosun church to the enforcement of these laws differed from each mission, church and denomination. Missionaries kept negotiation lines open with the colonial government and were able to express their position through this. Sometimes forming ecumenical organizations, or Sometimes acting independently depending on each denomination's situation, missionaries tried to protect their interests. They also represented the position of the Chosun church case by case. Results of such negotiations differed from time to time as it was affected by certain factors such as the relationship between Japan and the Western powers and political situations in Japan and Chosun. However, it is true that the missionaries were in an advantageous position compared with the Chosun church in negotiating with the colonial government. In the case of the Chosun church, its reactions were mainly shown by the Presbyterian Church. The local presbyteries played a leading role in the incorporation establishment movement that continued from the 1910s to the 1940s. Furthermore, because of their participation in the ‘Movement for Designated School(指定學校運動),’ the presbyteries dispatched a group of directors to private secondary schools. As a result of this, they actively took part in the Christian private schools takeover after the mid-1930s. The legal battle of the Presbyterian church which started from the negotiations concerning the year 1915’s ‘The Regulation for Religious Propagation’ was insignificant in the beginning, but constantly continued and resulted in the establishment of 2/3 of the incorporations and the survival of some private schools.
