듀이십진분류법 국내법 분야 분류체계 개선방안에 관한 연구

Abstract

전 세계적으로 널리 사용되고 있는 문헌분류체계인 DDC는 서구 위주의 분류표로서 동양 관련 자료의 분류에 어려움이 있다. 이런 문제는 영미법 계통을 따르는 서구와 달리 대륙법 계통을 따르는 동양의 법학 관련 자료를 분류하는데 있어서도 문제점으로 나타났으며 법학전문대학원 도입으로 인한 다양한 주제의 논문 등 연구 성과 산출도 동양 법학 관련 자료의 분류문제를 심화시켰다. DDC를 사용하는 대학도서관이 법학대학의 교육목적을 보다 효율적으로 달성할 수 있도록 하기 위해서는 도서관 소장 법학 관련 자료에 대한 체계적인 조직 및 관리가 필수적으로 선행되어야 하는 만큼 DDC 국내법 분야에 대한 개선안 마련이 요구되고 있다. 이에 본 연구는 이들 국내외 법학 자료에 대한 체계적인 분류를 위해서 DDC 법학부분의 국내법 분야를 개선하여 동서와 양서 모두를 수용하여 분류할 수 있는 DDC 법학 분야의 국내법 개선방안을 제시하였다. 이를 위해 개론서를 바탕으로 법학 분야와 그 체계를 파악하고 표준문헌분류체계인 DDC, LCC, KDC, 법원도서관분류표, NDC를 각각 국내법 분야별로 비교분석하였다. 또한 법학전문대학원이 설치된 전국 25개 대학도서관 분류담당사서를 대상으로 법학분류와 주제접근에 관한 설문조사를 실시하였으며 총 21개 대학이 설문에 회신하여 84%의 응답률을 보였다. 이 중 DDC를 채용하고 있는 15개(72%) 대학도서관의 설문응답지와 DDC 법학 분야 분류표의 항목전개 비교분석을 통해 파악한 현행 분류표의 분류전개 상의 문제점은 다음과 같다. 첫째, 대륙법과 영미법 체계의 법률 용어의 상이함을 해결하고 두 법체계를 모두 수용할 수 있도록 표목조정 및 대륙법 관련 항목을 추가해야 한다. 둘째, 행정법, 형법 등과 같이 주제전개가 미흡한 부분의 세부항목들을 추가해야 한다. 셋째, 형사소송법, 민사소송법과 같이 여러 곳으로 분산되는 비슷한 주제항목은 한곳으로 모아 관련 자료가 분산되지 않도록 해야 한다. 넷째, 행정조직법 아래 포함되어야 할 지방정부가 그와 동일한 계층의 분목에 위치하고 있는 것과 같이 계층적으로 문제가 있는 항목은 논리적으로 재전개해야 한다. 다섯째, 신지식재산권제도, 전자소송과 같은 신법 관련 자료의 증가에 대비하여 중요한 신법들을 수시로 분류표 상에 신설하도록 해야 한다. DDC와 타 분류체계와의 비교분석 및 분류실무자 대상 설문조사 결과 지적된 위와 같은 문제점을 바탕으로 한 주요 개정사항은 다음과 같다. 첫째, 헌법 분야에서 입법학, 국법학을 포함한 헌법의 기본원리에 대한 항목의 신설이 필요하다고 판단되어 이를 적절한 위치의 공 기호인 342.01 쪽에 신설하였다. 둘째, 행정법 분야에서는 행정법 관련 주제항목들이 342 헌법 하에 속해 있는 관계로 주로 행정조직 부분만 미흡하게 전개되고 있어 질서행정법, 급부행정법 등과 같은 행정작용법과 행정쟁송 관련법을 한국의 국내법체계를 반영하여 신설하였다. 셋째, 형법 분야에서는 형사법원을 포함한 형사소송 관련법을 347 소송법 및 법원 쪽으로 이치시켰으며, 타 분류표에 공통적으로 나와 있는 형사정책, 범죄학, 형벌론, 행형학 관련 항목과 어느 나라에서나 존재하는 특별형법 항목도 신설하였다. 넷째, 소송법 및 법원 분야에서는 앞서 언급한 바와 같이 343 형법 하에 전개되어 있는 형사소송 관련법들을 347 소송법 및 법원 요목으로 이치하여 소송법 관련 자료가 한 데 모이도록 하였으며 의학주제 하에 전개되어 있는 법의학 항목을 신설하여 의학 쪽과 양자택일할 수 있도록 하였다. 다섯째, 사법 분야에서는 대륙법에만 있는 법률용어인 채권법, 물권법 항목을 신설하였다. 또한 법 계통 간에 취급범위가 다른 상법에 대해서는 해당 표목에 ‘대륙법에서의 상행위법을 포함한다.’는 주기를 추가하였으며, 상행위법을 포함한 대륙법에서의 상법 분류를 위해 ‘상법전’이라는 표목을 신설하여 ‘대륙법계통의 ‘상법’은 여기에 분류한다.’라는 주기를 포함하도록 했다. 여섯째, 주제항목 전개상 논리적 체계성이 결여된 부문에 대한 수정과 신법관련 자료 증가에 대비하여 관련 상위 주제 하에 새로운 무체재산법, 전자소송법 항목을 신설하였다. 이렇게 마련된 수정 전개표(안)에 대해 학계 및 실무에 있는 정보조직 전문가를 통한 타당성 검증과정을 거쳐 최종적으로 개선방안을 제안하였다. 전문가 평가는 대학의 학계 자료조직 전문가 1명과 법학 전문가 1명, 대학도서관에서 정보조직 실무를 담당하는 전문가 3명을 통해 수행하였으며 이를 위해 본 연구의 국내법 분야의 문제점을 비교분석하여 종합한 결과와 수정 전개표(안)을 평가 자료로 제시하여 이에 대한 의견을 서면을 통해 수렴하였다. 전문가 평가 결과, 학계 전문가와 대학도서관 자료조직 실무자 모두 수정 전개표(안)이 전반적으로 실제 법학 분야의 학문과 지식체계를 세부적으로 잘 반영하고 있으며 영미법과 대륙법 체계를 모두 반영하기 위해 수정전개한 부분에 대해 긍정적으로 평가하였다. 더불어 수정 전개표(안)에 대한 제안을 바탕으로 지역보다 주제를 앞세운 조합방식을 우선적으로 채용할 것을 제시하였으며 세부 주제들을 상위항목의 주기사항에 포함시켜 낭비될 수 있는 분류기호를 삭제하였다. 또한 국내법을 법형식별로 세부적으로 구분하여 이용자들에게 제공한다면 유용할 것이라는 제안을 반영하여 공통보조표인 T.1. 표준세구분표의 ‘-026 법률’하에 법형식별로 세부기호를 추가로 전개하였다. 본 연구에서는 국내법 분야를 대상으로 문헌분류체계 비교분석과 분류담당사서와 학계전문가의 의견을 반영하여 우리 실정에 더욱 적합한 DDC 법학 분야의 수정전개 분류표를 제시하였다.;A Study on Developing Modifications for Dewey Decimal Classification in Municipal Law field There are some problems to classify the eastern literature with DDC which is western oriented method and widely used in the world. DDC treats only Continental-american law, so it is difficult to classify Asian law materials which follows the Continental law. The various themes of law literature which are emerged by the adoption of Korean law school system also makes it is more difficult to classify them appropriately. In order to efficiently achieve the educational purpose of the law school and to service university library users properly, it is essential to organize and manage the whole materials appropriately, so it is required to modify DDC in Municipal Law field. Therefore, this study suggests amendments of municipal law field in DDC, the 23rd edition for appropriately classifying both western and eastern literatures. The research methods are as follows. First, the law fields in municipal law are analyzed with the law introductory books. Second, the problems within the field of municipal law in DDC are scrutinized by comparative analysis among the five classification schemes : DDC, LCC, KDC, NDC and Supreme Court library of Korea classification. Third, the questionnaire on the problem of DDC application to law literatures was sent to 25 librarians who work at the university library which have a law school. 21(84%) librarians replied to the questionnaire and 15(72%) of them are using DDC for classifying the literatures. By comparison with five classification schemes and results of the survey from university librarians, problems of municipal law field are as follows. First, to embrace the legal system of Continental law and Anglo-american law which have different legal theory and to reconcile different legal terms between Continental law and Anglo-american law, the adjustment of headings and the addition of the items which are related to Continental law should be added. Second, detailed classification items should be added to the insufficient subject development part such as administrative law and criminal law. Third, the distributed similar topics to various parts on the classification scheme such as criminal procedure law and civil procedure law should be together in one category. Fourth, classification items in hierarchical problems should be logically redeveloped. Fifth, increasing new law related topics such as new intellectual property rights system and e-litigation, important new laws should be frequently added on the classification schedule. According to these problems, municipal law field in DDC needs extensive amendments as follows. First, some classification items are placed in the empty number, 342.01 for adding the concept of the fundamental constitution including the science of legislation and national law in the field of constitutional law. Second, in the field of administrative law, the part of administrative organization is poorly developed since items related theme belong to the 342 constitutional law. Thus, new concepts related to the law of administrative action and affairs which reflect the Korean municipal law is established. Third, in the field of criminal law, criminal procedure law including criminal courts is moved to 347 procedure law and the courts. Furthermore, criminal policy, criminology, punishment theory, all of which are commonly existed in other classification schedules, and items of special criminal law which exists in every countries' law systems are newly introduced. Fourth, in order for procedure law related literatures to be gathered under one category, all classification items related to criminal procedure law which are placed in 343 criminal law are moved to 347 procedure law and the court. In addition, the forensic medicine which is placed under 614 medical science is newly numbered in under the law category to be classified in the both side. Fifth, in the field of jurisdiction, the law of obligation and reality which exist only in the Continental law is newly introduced. Moreover, in 346.07 commercial law which has different coverage between every legal system, the note 'Class here the commercial activity law in the Continental law' is added and the heading of 'commercial law' is added with the note 'Class here the commercial law in the Continental law'. Sixth, in preparation of the increase of literatures which is related to the new laws, new intangible property laws and e-litigation law are newly placed. Furthermore, the insufficient logical part are amended In order to verify the academic and practical feasibility on the suggested amendments, professionals' review has been implemented and reflected in the amended classification schedule. Professionals' review was conducted by a classification professional who teaches classification theories at university and three university librarians who execute practical works. For the implementation of the validity review, the comparative analysis with five classification schemes of law field and suggested amendments had been sent to professionals as the evaluation object in writing, also their replies collected in writing. According to the results from the professionals' review, suggested amendments well reflect the academic and knowledge system practical law field. In addition, they positively evaluated the amended and developed parts which were to reflect both Anglo-american law and Continental law system. Futhermore, based on the suggestion for amendments, this study suggests that subject-oriented number building method rather than region-oriented one, and eliminate some numbers which could be uselessly wasted by moving the lower level classification items to the upper classification item with the including note. In addition, based on the suggestion that municipal law materials separated by law types would be helpful for users, new classification items of detailed law types were developed under '-026 law' which is placed in Table 1. standard subdivisions. This study suggests the amendment of DDC the 23rd in municipal law field with analysis of comparing classification schemes and reflection of professional and university librarians. Futhermore, this study provides the fundamental foundation for more practically suitable amended DDC in municipal law field.
