Abstract

MP3 기술을 이용하여, 압축된 음악 파일은 놀랄만한 속도로 인터넷을 통해 다운로드될 수 있다. Napster는 MP3 파일을 다운로드 받을 수 있는 가장 유명한 사이트로서, Napster와 RIAA 간의 법정 분쟁은 디지털 환경 속에서 저작권과 지적 재산에 관한 의문을 제기하였다. 새로운 법 조항들이 그 문제를 다루기 위해 만들어졌다. 국제 지적 소유권 기구(WIPO)는 WIPO 저작권 조약과 WIPO 공연과 음반에 관한 조약을 합의했다. 미국은 Digital Millennium Copyright Act를 통과시켰다. 음반업계는 이 Digital Millennium Copyright Ac에 기반하여, 저작권 분쟁에서 승리하였다. 그러나 이러한 판정들이 더 강력하고 추적불가능한 사이트를 가지고 있는 또 다른 "Napster"의 등장을 막지 못할 것이다. 이런 의미에서, 저작권이란 개념은 디지털 시대에 부적합할 수 있고, 이 논문에서 "카피레프트"의 개념을 설명하였다. 본 논문은 Napster와 같은 MP3 유통업체와 음반업계가 공존할 가능성을 모색해본다. 음반업계는 장기적인 관점에서 온라인 음악 사이트를 포용해야 할 것이다. 마지막으로, DRM이나 디지털 워터마킹과 같은 기술적 솔루션들이 디지털 시대의 저작권 법의 법적 헛점을 보완하는 것을 도울 것이다.;By using MP3 technologies, compressed music data files can be downloaded over the Internet at an amazing speed. Napster is the most famous sources for MP3 files, and the litigation between Napster and RIAA posed questions about the copyright and intellectual property in a digital environment. The legal system has finally caught up with reality. Laws have been passed to cope with the problem. WIPO has agreed on the WIPO Copyright Treaty and the WIPO Performance and Phonograms Treaty. The United States has passed the Digital Millennium Copyright Act. Music industry won the copyright war based on the Digital Millennium Copyright Act in the United States. But these rulings cannot eliminate another "Napster" with a more powerful and untraceable site. The concept of copyright may be inappropriate to the digital age, and this thesis explained the concept of the "copyleft". This thesis looks into how MP3 distributors like Napster and the music industry can co-exist. The music industry should embrace the online music sites from the long-term perspective. Lastly, the technical solution such as DRM and digital watermarking will also help to cover the loopholes of copyright laws for the new digital age.
