Granting Legal Refugee Status to North Korean Escapees in China

Abstract

1994년과 1998년 사이, 북한에서는 경제몰락으로 인해 발생한 기아로 적어도 2-3백만 명이 사망했다. 최근 보고서에 따르면, 2천 3백만으로 추정되는 북한인들 중 현재까지 5백만 이상이 사망했다고 한다. 북한 경제가 쇠퇴하면서 많은 북한인들은 식량, 전기, 물 혹은 의약품 같은 생필품조차 없이 살아가고 있으며 이들 중 다수가 살아 남기 위해 중국과 러시아로 탈출하고 있다. 그러나 이 논문은 중국에서의 북한난민의 법적지위 향상을 다루고자 한다. 초기에는 북한인들이 북한과 중국 사이를 자유로이 왕래할 수 있었지만, 이것은 시간이 흐르면서 변하게 되었다. 일단 중국으로 들어간 많은 북한인들은 현재 북한 난민 혹은 망명자로 분류되어 있으며, 언제 잡혀서 송환될지 모르는 두려움 속에서 살아가고 있다. 이러한 탈출자들에게 법적인 지위를 부여하기 위한 국제사회의 끊임없는 탄원에도 불구하고 중국 정부는 이를 계속 거부하고 있다. 지금까지 알려진 바에 따르면, 중국과 북한에서는 중국인들에 의한 인신매매나 북한정부의 고문행위 같은 여러 가지 인권침해가 자행되고 있다고 한다. 이 논문은 중국에서 북한 난민들에게 합법적인 난민으로서의 지위를 부여해야 하는 이유를 제시하고자 한다.;From 1994-1998, it was estimated that at least 2-3 million people died mainly from starvation due to the economic downfall of North Korea. Currently, it has now been reported that more than 5 million out of North Korea's estimated 23 million citizens may have died so far. with the decline of North Korea's economy, many of its citizens live almost virtually without the basic necessities such as food, electricity, water or medical supplies. Because of this, many of these citizens have escaped to China and Russia in order to survive. My thesis will only focus on the necessity of granting North Korean Escapees legal refugee status in China. Initally, many North Korean citizens were able to go back and forth from North Korea to China but this later changed. Upon entering into china, many North Korean citizens, now labeled as North Korean Escapees or North Korean defectors, lived in fear of being captured and repatriated. Despite pleas from the international community for the Chinese government to grant these escapees legal refugee status, they have continued to refuse. It has been found that many human rights violations have been committed against the North Korean Escapees not only in China but in North Korea as well such as human trafficking by Chinese citizens and torture committed by the North Korean government. This thesis proposes to give reasons why North Korean Escapees should be given legal refugee status in China.
