敎員身分保障에 關한 法的考察

Abstract

이 論文은 現行敎育公務員法과 私立學校法을 中心으로 敎員(敎育公務員 및 私立學校敎員)의 身分保障에 관한 法的인 考察을 하려는 것이다. 敎員은 國家의 百年大計와 發展을 推進하는 人材養成의 主役을 擔當하고 있는 敎育의 專門家일 뿐만 아니라 그들은 敎育의 主體로서 敎育의 客體인 學生의 生長發達을 指導하여야 하는 莫重한 任務를 가지고 있으며 特히 敎員의 思考와 言動은 그대로 學生들에게 莫大한 影響을 주는 者이다. 따라서 敎員을 敎育의 專門家로서 把握할 때 身分의 强力한 保障을 하여 有能한 敎員의 確保를 하여야 할 것이고, 또 敎員이 敎育의 主體로서 그 영향의 莫大함을 고려할 때 敎員이 身分에 대한 不安感없이 安心하고 바람직한 敎育을 할 수 있도록 하기 위해 敎員의 優待 및 身分保障制度가 必要不可欠하게 되는 것이다. 敎員의 身分保障이란 本人의 意思에 反하여 身分 내지 職位로부터 一方的으로 排除되지 아니한다는 狹義의 槪念과, 그 밖에 報酬問題等 適正한 勤務條件까지 包含시키는 廣義의 槪念으로 使用된다. 이러한 身分保障을 가장 强力하고도 實效性있게 하는 方法은 法的인 身分保障方法일 것이다. 따라서 우리나라를 包含한 많은 國家에서는 法令을 통해 敎員의 身分을 다른 職種에 從事하는 者보다 强力하게 制度的으로 保障하고 있다. 우리나라의 경우에는 敎員의 社會的 地位는 適正하게 優待되어야 하며 그 身分은 반드시 保障되어야 한다는 敎育法上의 原則的 規定에 근거하여 敎育公務員은 敎育公務員法에서, 私立學校敎員은 私立學校法에서 各各 그들의 身分保障에 관해서 規定하고 있다. 이 硏究는 敎員의 身分은 반드시 保障되어 敎育을 그르치는 일이 없어야 한다는 前提下에 敎育公務員法 및 私立學校法이 과연 敎員의 身分保障을 어느 정도 認定하고 있는가를 살펴보기 위하여 敎員身分保障에 관한 現行法上의 規定을 體系的으로 分析·整理하고 法規定上의 問題點을 考察해 본 것이다. 이 論文의 主要內容은 다음과 같다. 第1章 「序論」에 이어 第2章 「敎員의 身分保障의 意義」에서는 敎員의 特殊性과 身分保障의 必要性·身分保障의 槪念·敎員身分保障制度의 沿革 및 外國의 敎員身分保障制度를 考察함으로써 敎員身分保障의 意義를 理解하려 했다. 第3章 「敎員身分保障의 對象者」에서는 敎育公務員法에서의 敎育公務員과 私立學校法에서의 私立學校敎員의 範疇를 分說해 봄으로써 敎員身分保障의 對象者를 具體的으로 살펴 보았다. 第4章 「敎員身分保障의 內容」에서는 敎員의 身分保障原則·意思에 反한 身分措置를 할 수 있는 경우로서의 當然退職·職權免職·休職·職權降任·職位解除 및 解任制度 等을 分析·整理하고 敎員의 不逮捕特權·懲戒處分·訴請·大學敎員의 任期制 等을 考察하였다. 끝으로 第5章 「結論」에서는 現行法上의 敎員身分保障規定에서의 要約 및 問題點을 밝힌 後 그 是正策을 論究하였다.;This thesis is intended to study the security of teachers' status, centering around the existing Educational Public Officials Law and Private School Law. Teachers are not only the specialists of education who take charge of training for talents but the subjects of education who have to guide the growth of students positively, specially whose thought and conduct have influence greatly on their students. So teachers' position as the specialists and subjects of education, needs the system of status-security first for the purpose of desirable education without any anxiety about their status. In a limited sense, teachers' status-security means that teachers aren't excluded from their status or position unilaterally against their will. In a broad sense, it contains the proper service conition (ex : remuneration) besides the above concept. Therefore many countries, including Korea, are securing teachers' status more powerfully than other workers through their law. In Korea, the status-security of educational public officials is prescribed in the Educational Public Officials Law and that of private school teachers is prescribed in the Private School Law, originating in teachers' courteous treatment or status-security reflected in the Educational Law. This thesis, under the condition that teachers' status must be surely secured not to fail education, aims at the analysis and arrangement of existing regulations about teachers' status-security, the study of legal problems, in order to understand how the Eductational Public Officials Law and the Private School Law are securing teachers' status. This thesis has the following main contents. (l) After Chapter Ⅰ Introduction, in Chapter Ⅱ The Significance of Teachers' Status-Security, the particularity of teachers and the necessity of status-security, the concept of status-security, the history of system for teachers' status-security, and the system for foreign teachers' status-security, are obserbed. (2) In Chapter Ⅲ The Object of Teachers' Status-Security, the category of educational public officials and that of private school teachers are obserbed. (3) In Chapter Ⅳ The Contents of Teachers' Status-Security, the principle of teachers' status-security, the reasonable retirement, the official dismissal, the suspension from office, the removal from office, the official demotion, are analyzed and arranged. (4) In Chapter Ⅴ Conclusion, the problems of existing regulations about teachers' status-security are indicated, and their revisions are considered.
