국내입양사업의 현황분석에 관한 연구

Abstract

본 논문은 늘어나는 국내입양의 필요성에 비추어 한국에서의 입양의 제도적 개선점 및 그 구체적인 방안을 제시하고자 의도했다. 그리하여 우선 국내외적으로 근대적인 입양제도의 발전을 살펴봄으로써 앞으로 국내 입양이 지향해야 할 방향을 찾아보고자 했으며, 아울러 이상적인 입양의 절차와 그 형태를 제시하고 국내입양의 현황과 비교해 봄으로 해서 그 문제점을 파악하고자 했다. 사실상 우리나라에서 입양제도가 발생한 것은 무척 오래된 형편이나 근대적인 의미에서의 기관입양은 1961년 아동복리법이 공포되면서 시작되었다고 할 수 있겠다. 즉 일부 외국기관의 도움을 얻어 출발한 한국기독교양자회나 대한양연회등의 단체가 본격적으로 국내 입양사업에 손을 대기 시작하면서부터 입양제도 자체가 주위의 관심을 얻기 시작했던 것이다. 따라서 본 연구자는 1961년 이후 국내입양제도의 실태를 파악할 수 있다면 현재의 전반적인 국내입양의 실태를 파악할 수 있다는 가정을 가지고 이제까지 비교적 자료가 잘 갖추어진 한국 기독교양자회를 분석대상기관으로 선정하였다. 1963년 이후 1972년까지 10년 동안 대한 기독교양자회에 입양을 신청하여 허락된 인원중 매년 20명씩 총계 200명을 무작위 추출하여 한국 기독교양자회에 비치된 그들에 관한 각종자료를 분석 처리하였다. 그 결과 본 연구를 통하여 얻어진 결론은 대체로 다음과 같은 것들이다. 1) 국내입양사업은 모든면에서 많은 발전을 보이고 있으나 전 국민이 입양사업에 대하여 보다 철저히 이해를 할 수 있도록 적절한 대책을 강구하여야 한다. 2) 성인 중심의 입양제도에서 완전한 아동 중심의 입양제도로의 전환이 시급하다. 3) 국내입양을 전담하고 있는 기관간의 밀접한 횡적유대가 절실히 필요하며 국내입양을 직접 담당할 사회 사업가의 체계적인 훈련 및 교육이 필요하다. 4) 위험한 개인입양을 막고 건전한 기관입양을 도울 수 있는 법적인 뒷받침이 절대 필요하다. 5) 국내입양을 위한 제도적인 통일 및 입양아동과 양부모, 친부모를 위한 효과적인 도움이 개선되어야 한다. 6) 입양되어가지 못하는 아동들을 위한 적절한 대책이 요망된다. 7) 입양제도는 궁극적으로 아동의 행복과 안전을 위한 것이 되어야 하며, 입양기관 및 그 종사자는 이를 위하여 최대의 노력을 기울여야 한다.;The object of this study is to propose the best way of adoption, to suggest of practical suggestion in Korea. So first, the present researcher wants to find the desirable way of adoption in Korea, reviewing historical background of adoption in Korea and other countries. Next, the researcher wants the ideal procedure and way of adoption and to grasps problems through it compare with practice of Korean adoption. It was long time ago to originate of adoption in Korea, but modern agency adoption in Korea have been started in 1961 that was promulgated the Law of Child Welfare. After Christian Adoption Program of Korea and Child Placement Service which was supported by foreign aids handled adoption. It has been mentioned by people in Korea. This research has assumption which researcher can find the actual conditions of adoption in Korea, if she could find the realities of internal adoption after in 1961. So C.A.P.O.K. is taken as subject agency of analysis. The researcher analyzes the data of 200 persons who have applied adoption to C.A.P.O.K. and been accepted in 1963-1972, as 20 persons per year which is placed in C.A.P.O.K. The results of this study are as follows : 1) Internal adoption agencies must consider a proper counter measure of people in Korea in order to understand for child adoption. 2) They must be changed to child-centered adoption from man-centered. 3) Agencies which deals with internal adoption must have close relations each other. 4) Governments must have programs for education and training of social workes in adoption part. 5) Children who were not adopted are protected from all harm to mind and body. 6) Adoption agencies and social workers must make efforts for happiness and safety of adopted children in adopted processes.
