국민연금제도의 도입·시행에 관한 연구

Abstract

본 논문은 국민연금제도의 특이한 도입·실시과정에 대한 관심에서 출발하여, 그 제도가 어떻게 성립되었으며, 어떤 사유로 인해 시행되지 못하고 사장되었는지, 나아가 사장되어 있던 국민연금계도의 시행은 어떻게 가능하였는가 하는 문제제기 하에 연구된 것이다. 이상과 같은 논점아래 본 논문에서는 첫째, 국민연금제도의 도입·시행과정 그리고 이 과정과 밀접하게 연관되어 있는 것으로 생각되는 경제적 상황분석 둘째, 경제적 상황과 어우러져 제도의 변동에 영향을 미친 제도자체 내적요인 세째, '73년의 국민복지연금법과 '86년 개정된 법 간의 차이점 등을 중심으로 국민연금제도 도입에서 표출되는 기초적 동인들에 대한 규명과 그에대한 평가를 시도하였다. 이를 위해 국민연금제도의 도입·시행을 1. 국민복지연금법의 제정과 실시연기 2. 법의 개정과 시행으로 구분하고 각 시기의 상황을 경제적 상황과 사회복지상황 그리고 자체내적 동향으로 나누어 살펴보고, 양 시기간의 비교를 시도하였다. 그 결과 경제적 상황에 국민연금제도 도입의 직접적인 동인으로 작용하였으며 이후의 시행연기에 있어서는 결정적인 제약요인으로 기능하였음을 확인할 수 있었다. 그리고 '86년 이후의 시기에 있어서는 그동안 제약조건으로서 제도시행에 장애요인이 되어오던 경제적 상황이 호전됨으로써 제도의 순조로운 시행을 가능케 하였음을 확인하였다. 한편, 양법편의 성립과정에 대한 비교에서는 모두 그 실시가 대통령의 기자회견이라는 극적인 수단을 통해서 표명되었다는 점과 이를 계기로 극히 단시일내에 입법이 추진되었다는 점 등의 유사점과 제도에 대한 기초연구들이 '73년에는 전무했던데 비해 '86년에는 상당히 축적되어 있었다는 차이점을 발견하였다. 이러한 논의들을 종합하여 ,우리나라의 국민연금제도는 정치권력의 정치적 목적에 바탕한 제도 도입의지를 경제적 상황이 장기간 계약해 오다가 경제적 상황이 호전됨에 따라 시행에 이르게 된 것이라는 결론을 도출하였다. 이러한 형태의 사회보장은 우리나라뿐만 아니라 경계가 주로 제약요인으로 기능할 수 밖에 없는 저개발국들에서 공통적으로 발견될 수 있는 것이라 보여진다.;This study is starting from the interest for the unique process of the introduction of the National Pension System. And it is advanced under these several questions : How was the system established, and by what the system was postponed and was able to executed in 1988? Under these questions, this study is analyzing not only the process of the introduction and execution of the National Pension System and the underlying economic situation, but also the factor causing the variation of system. Besides, it compares the revised law in 1986 with the National Welfare Pension Law established in 1973. For this purpose, the development of the National Pension System is divided into two step; the first is the enactment and suspension of the National Welfare Pension Law and the second is the revise and execution of the law. The situation of each period is also divided into conditions of economic activity and social welfare, and the movement of the law themselves. In addition, this study makes a comparison between the two period in general. The important conclusions of this study are as follows; The economic situation has played an important role in the whole process of the National Pension System. It plays the basic role in the establishment and suspension of the National Welfare Pension Law in 1973. And the reverse turn of the economic situation enables the system to be enforced. By the comparison of the two law's establishment process, the fact that the enforcement of the system was declared samely by the president in a dramatic manner was exposed. But there is important difference in the degree of the accumulation of basic studies about the system. When put together all the research above, the National Pension System in Korea was able to be enforced by the political desire of the presidents, which had been restricted by the economic situation for long. In the less developed countries we can often find out this type of social welfare system.
