Abstract
個人의 私生活領域의 保全에 대한 慾求는 生命體로서의 인간이 갖는 本能에 基因하며 原始社會에서부터 現代社會에 이르기까지 어느 文化圈에서나 항상 存在해 왔다. 다만 프라이버시에 대한 理念的 主張은 18세기 후반에 西歐社會에서 新敎主義 및 初期資本主義의 發生과 더불어 登場했으며 프라이버시權利에의 要求, 즉 프라이버시에 대한 現大的 槪念은 個人晝義 및 自由主義라는 理念에 基礎를 두고 19세기 후반부터 成熟되어 왔다고 볼 수 있다. 프라이버시權利의 生成過程을 고려해 볼 때, 프라이버시 보호의 요구는 個人의 生活領域이 公衆의 눈에 露出되기 쉬운 社會·經濟的 狀況과 密接하게 관련, 전개되어 왔음을 알 수 있다. 더우기 오늘날 情報通信技術이 급격히 發達하여 정보가 人間生活에 必修不可缺한 生産手段으로 등장함에 따라 情報의 蒐集이나 管理段階에서 개인의 정보상의 프라이버시를 保護하는 것이 중요한 法的 課題로 擄頭되었다. 이러한 背景에 비추어 프라이버시라는 槪念은 개인이 속한 사회나 문화의 影響을 강하게 받으며, 또한 프라이버시權利는 人格權 또는 人間다운 生活을 할 權利의 核心에 속한다고 볼 수 있다. 그러나 社會的 存在인 人間은 프라이버시의 完全한 享有률 期待할 수 없을 뿐만 아니라 프라이버시權利의 行使는 다른 基本權과의 調和를 위하여 또는 기타 憲法秩序의 維持를 위하여 일정한 制約을 隨伴한다. 우리나라에서도 프라이버시權利는 私生活의 秘密과 自由를 규정한 헌법 제17조를 주된 根據로 하여 인정되고 있는데 이는 絶對的으로 主張할 수 있는 權利는 아니므로 헌법 제37조 2항에 근거한 立法에 의하여 그에 대한 制限이 許容될 수 있다. 프라이버시權利는 包括的 槪念으로서 多樣한 利益을 포함하는 바, 여기서는 私生活의 秘密과 自由를 區分하여 제3장과 제4장에서 각각 그 限界에 대하여 檢討하였다. 개인은 私生活領域에 속한 사항을 維持, 保全할 권리를 갖는데, 이에 대하여 傳統的으로 大衆媒體에 의한 侵害와 國家機關에 의한 侵害가 問題되어 왔다. 첫 번째로 프라이버시權利가 表現의 自由와 衝突하는 경우에는 公表의 對象이 된 私的 事項의 隱密性, 公表事項의 公益性, 個人의 公的 地位 등을 고려하여 具體的 認定範圍를 결정해야 할 것이다. 이에 따라 개인의 內密한 또는 私的人 사항에 대한 사실의 公開인 경우에도 公衆의 알 權利를 우선 保護하기 위하여 이른바 "혼자 있을 권리"에 대한 침해가 正當化될 수 있다. 두번째로 國家機能의 圖滑린 遂行을 위하여 개인의 사생활 영역에 侵入하거나 그에 속한 정보를 探知하는 行爲가 許容되는 경우가 있다. 예를 들어 개인의 住居나 通信의 不可侵에 대한 침해라도 그것이 國家安保나 秩序維持를 위하여 필요한 것으로서 법률에 규정된 일정한 要件을 갖추어 행해진 경우에 개인은 그에 대한 法的 救濟를 要求할 수 없다고 본다. 또한 개인은 私生活領域에서 일반적 행동의 自由를 갖는데, 이는 사생활을 자유롭게 營爲할 진리로서 人格的 自律性을 前提로 하여 인정된다. 그런데 이러한 私的 活動의 自由라는 문제는 종종 개인의 道德性에 대한 公的 論爭을 불러일으킨다. 즉 他人의 권리를 직접 侵害하지는 않더라도 국가가 政策的 見地에서 개인의 사적 활동의 自由 및 그에 관한 決定에 간섭하는 경우가 있다. 개인의 身體, 性, 結婚, 家族生活에 관한 사항은 代表的인 프라이버시의 利益으로 看做되고 있으나, 비록 이에 관한 개인적 決定이라도 生命權의 保護라는 國家的 利益을 위하여 또는 社會의 逍德律에 反할 수 없음을 理由로 하여 制限될 수 있다. 오늘날 情報化社會의 도래와 함께 여러 가지 逆機能도 나타나고 있는데, 특히 基本的 人權과 관련하여 개인의 정보상의 프라이버시保護라는 문제가 제기되고 있다. 國家나 公共團體 및 私企業體에 의해 이루어지는 個人情報의 募集과 管理活動에 대하여 개인에게 自己情報에 관한 決定權을 인정하는 추세가 있으나, 이 권리는 헌법상 국민의 "알 權利"와 필연적으로 相衛된다. 이에 국민의 알 權利를 충족시키기 위한 情報公開의 필요상 自己情報에 관한 決定權의 행사가 제한될 수 있다. 우리나라에서 프라이버시權利는 비교적 새로운 권리로서 生成中에 있기 때문에 그 구체적 내용 및 한계는 국민의 權利意識, 이에 바탕을 둔 憲法解釋 및 立法活動을 통하여 形成, 補完될 것이라고 본다. 특히 알 權利와 自已情報에 관한 決定權은 모두 積極的·請求權的 성격을 갖기 때문에 情報公開와 私生活保護라는 兩 利益의 調整은 立法에 依存하는 바가 클 것이다.;The desire of preserving one's private life has it's origin on human instinct and has been existed in every culture from the primitive ages to the present. Ideological assertion on privacy, however, appeared with origination of the protestantinism and the capitalism in the Western society in the late of 18th century. Also demand for the right to privacy has been matuered based on the individualism and the liberalism since the late of 19th century. Regarding the generation process of the right to privacy, it can be noticed that demand for the protection of privacy has an intimate connection with the socio-economic situation where personal life can be easily exposed to the public. In addition, as information became indispensable means of production in human lives because of the remakable development of information industry, protection of privacy concerning personal information in collecting and managing data has been presented as one of the main legal tasks. The concept of privacy is strongly affected by community or culture, and the right to privacy is the core of the right to human dignity. However, full enjoyment of privacy can't be expected for human as social beings, and the exercise of the right to privacy gets legitimate restrictions to balance on other fundamental rights and maintain the constitutional order. In Korea, the right to privacy is recognized based on the article 17 of the constitutional law which prescribes secrecy and freedom of individual's private life. However, no one has the absolute right to the privacy and the restrictions of this right are allowable based on the section 2, article 37 of Korean constitutional law. As the concept of the right to privacy is comprehensive and contains various interests, the secrecy and freedom of one's private life are separately dealt with and their limits are examined in the 3rd and 4th chapters in this paper. Whereas individual has the right to keep and preserve personal matters in one's private sphere the disturbance from mass-media and government has been regarded as a problem. First, when the right to privacy conflicts with the right of the press, the concrete extent of recognition of the right to privacy should be decided with consideration of intimacy and public interest of the personal matter which became the subject of public disclosure in addition to status test of public figure. Hence, the invasion of the "right to be let alone" can be justified to protect the public's right to know regarding publication of intimate or private affairs. Secondly, trespass on one's private sphere and detection of personal information can be allowable for the efficient performance of governmental function. For example, when a trespass on the private residence or communication satisfies certain conditions in the law to be recognized as necessary for the state security or the maintenance of public order, one can't claim legal remedies. Also, in private sphere individual has general liberty of personal activities which can be defined as the right to manage private life freely and this right is recognized based on one's automony. However, the matter concerned with this liberty often results in the public debate on the issue of individual's morality, In other words, the disturbance of the liberty of personal activities and decisions can be made with governmental policy even though individual's liberty is not excessive enough to intrude other's fundamental rights directly. The right to decision on person, sex, marriage and family life, which are representative interests of privacy, can be restricted for the state interest in terms of protection of human life or for social morality. Today, various reverse effects result from development of informationized society. Particularly the protection of individual's informational privacy related in fundamental rights has become a principal issue. Against the collection of personal information and the operation of data bank system through public and private sectors, individual's right to control over private information is on the process of achieving legal recognition, but this right inevitably conflicts with the constitutional right to know. Therefore the exercise of the right to control over one's private information can be restricted to satisfy the public's right to know. In Korea, the right to privacy is relatively new in constitutional law and it's concrete contents and limits are expected to be created and supplemented by people's consciousness of the right, interpretation of the laws based on that, and congressional activities. In particular, as both the public's right to know and the individual's right to control over personal information demand positive action of the state, balancing of the two interests is largely dependent on the congressional enactments.
