Charles A. Beard의 미국헌법해석에 관한 고찰

Abstract

미국의 역사상 헌법은 가장 논쟁이 되는 문제중의 하나이다. 대법관들은 그들의 판결에 있어서 헌법을 자신의 성향(性向)에 따라 재해석 하였으며 정치가들은 그들의 이익, 목적, 정부의 이념에 따라 헌법을 해석하였다. 그러나 역사가들은 대체로 헌법의 제정과 비준에 대한 문제에 관심을 집중시켰다. 역사가들의 헌법에 대한 해석 가운데 가장 우리의 흥미와 관심을 끄는 것은 Charles A.Beard의 An Economic Interpretation of the Constitution of the United States라고 여겨진다. 1913년에 발표된 이 저서는 그 후 30여년간 학계와 일반의 많은 관심을 불러 모았으며 칭찬과 비난이 끊임없이 계속되었다. 본 논문은 첫째, 역사가들의 헌법해석의 경향을 알아보기 위하여 남북전쟁 이후 2차대전까지 세 학파-애국파, 혁신주의파, 수정주의파-의 헌법해석 경향을 살펴보고 둘째, Charles A.Beard가 헌법에 대한 경제적 해석을 하게된 지적(知的)인 토대를 고찰하였다. 거의 신성시(神聖視) 되어온 종래의 헌법에 대한 관념을 타파하고 그는 정치이념을 설명하는 가장 명백한 방법은 정치적 신념이 발달한 환경에 있어서의 경제적 요인을 연구하는 것이라는 신념을 기초로 하여 헌법에 대한 매우 새로운 해석을 시도하였다. Beard의 헌법해석의 요지는 헌법은 생명과 재산, 그리고 행복의 추구를 위해 애국자들에 의해 기초된 문서가 아니라 동산소유자(動産所有者)들에 의해 만들어진 "경제적 문서"이며 비민주적 사회에서 비민주적 방법에 의해 제정되었다는 것이다. 그의 해석은 두 차례의 세계대전과 전체주의(全體主義)의 도전이라는 격변하는 시대적 흐름에 직면하여 상대주의적 입장을 취하게 되었다. 첫째, Beard의 경제적 해석에 대한 비평은 무수히 많으나 본 논문에서는 Beard의 해석을 전적으로 그릇된 것으로 평가하는 Robert E.Brown의 비평과 부분적으로는 반대를 하면서도 Beard의 뛰어난 기량을 인정하는 Forrest McDonald의 입장, 그리고 위의 두 비평을 종합하여 새로운 자신의 비평을 이룩한 Lee Benson등 세사람의 비평을 각각 소개하였다. Beard의 헌법에 대한 경제적 해석은 광범위한 일반화(-般化)로 인하여 다소 무리가 없는 것은 아니었다. 그러나 그는 체계적이고 완벽한 과학적 방법과 폭넓은 지식으로 역사가들에게 역사를 보는 시야를 확대시키고 미국 역사학계에 큰 공헌을 하였다. 또한 많은 논란에도 불구하고 그의 저술의 논제(論題)는 미국의 역사서술에 흡수되어 폭넓게 받아들여졌다.;Of various interpretations of the Constitution presented by historians, Beard's economic interpretation appeared in his book entitled as An Economic Interpretation of the Constitution of the U.S. has been regarded as a great accomplishment, Since its publication in 1913, Beard's book has become the center of great interest among both general and academic people. In this thesis, I made a survey on three principal schools of interpretation of the Constitution, namely, Nationalist School, Progressive School and Revisionist School, This provides the background for the understanding of the changes witnessed in the interpretation of the Constitution in the period beginning with the Civil War through the Second World War. I also made the study on the intellectual foundations upon which Beard has become to rely in his economic interpretation of the Constitution, Beard's economic interpretation was made with his belief that the best way of explaining the political doctrines of the constitution is to book into the economic elements found i n the circumstances under which that political doctrine is developed. Thus he did away with the traditional notion that the constitution is a sacred document. According to Beard, the constitution was not ratified for its idealism expressed in the man's right to life, property and the pursuit of happiness, but as the economic document aiming to promote the interest of personalty owners. He further argued that the constitution was a product of undemocratic method in undemocratic society. However, he did not insist that his interpretation is final and subject to no changes. In fact, interpretation of t h e constitution underwent several changes since the Second World War and the rise of totalitarianism had an impact on Beard's interpretation. The main criticism on the work of Beard came from such scholars as Robert E. Brown, Forrest McDonald and Lee Benson. Brown's estimate of Beard's work is most unfavorable since he found much weakness in Beard's argument. McDonald, on the other hand, found in Beard's work both merit and demerit since he indicated same disagreement in Beard's argument. Benson, However, made us of both Brown's and McDonald's criticism and came up with his creative and synthetic analysis Beard could not escape criticism for his over-generalization. But his systematic and scientific method accomplished in the Economic Interpretation of the Constitution contributed toward a new vistas in the study of American History and broadening of American historiography. Amid much controversies since its publication, Beard's Economic Interpretation of the Constitution established a solid ground in American historiography. The American Constitution of 1787 is one of the most controversial objects among the scholars in American History. The Supreme Courts Justices, for instance, re-interpreted it in their judicial decisions according to their predilections whereas the politicians construed it according to their own interest, purpose and political doctrine. The American historians, on the other hand, showed their great interest in how it was made and ratified.
