Abstract
과거 오래전부터 아내학대는 심각하게 발생하고 있지만 그 동안 아내학대를 개인의 문제 또는 가정의 문제로 치부시하여 아내학대에 대한 사회적 개입이 거의 전무한 상태였다. 그러나 1997년 가정폭력범죄의처벌등에관한특례법과 가정폭력방지및피해자보호등에관한법률이 제정되면서 아내학대를 사회문제로 인식하게 되었고, 아내학대자에게는 법적개입이 행사하게 되었다. 아내학대자에 대한 법적 대응은 일반 폭력과는 달리 가정보호사건으로 처리하고 있는데, 보호처분 중에서 수강명령처분이 가장 많이 내려지고 있다. 하지만 아내학대자에 대한 법적대응이 행해진지 불과 2-3년밖에 되지 않기 때문에, 아내학대자에 대한 보호처분 특히, 수강명령처분이 아내학대자의 재범을 줄이는데 얼마나 기여하고 있는지에 대한 연구 결과가 거의 전무한 상태이다. 그래서 본 연구에서는 아내학대자에게 부과되는 수강명령처분의 효과성을 조사하고, 이 결과를 토대로 아내학대자에 대한 보호처분 특히 수강명령처분의 방향성을 제시하는데 이바지하고자 한다. 본 연구에서는 가정폭력범죄의처벌등에관한특례법을 위반하여 고소를 당하여 법원에서 수강명령처분을 부과받아 서울보호관찰소에서 2000년 8월부터 2000년 12월까지 수강명령처분을 이행하고 있는 아내학대자 중 55명을 대상으로 조사하였다. 본 연구에서는 다음의 몇가지를 조사하였다. 1. 아내학대자의 일반적 특성, 학대 특성 및 폭력에 대한 부정성을 조사하였다. 이를 조사하기 위해서 학대자를 대상으로 한 설문조사, 기존 자료활용, 피해자 전화설문조사를 하였다. 2. 수강명령처분 판결이 가해자의 행동변화 즉, 아내학대 행위를 얼마나 감소시켰는지를 조사하였는데, 학대자의 자신의 학대행위에 대한 부정성을 고려하여 피해자를 대상으로 전화설문조사를 실시하였다. 3. 수강명령교육을 통한 가해자의 행동변화(아내학대행위 변화), 지식변화(가정폭력법에 대한 지식), 인지변화(가정폭력에 대한 인지, 성평등에 대한 인지, 배우자에 대한 인지, 처분에 대한 인지)를 조사하였다. 이는 가해자를 대상으로 교육전과 후를 조사하였다. 4. 집단성원들의 수강명령교육에 대한 평가내용을 알아본다. 본 연구에서 도출된 결과는 다음과 같다. 1. 수강명령처분을 받은 아내학대자들은 대부분 나이가 많으며 학력수준이 낮았으며, 단순노동직이나 기술직 및 무직이 많았다. 뿐만 아니라, 연구대상자들의 22%가 범죄력을 가지고 있으며 심한 아내학대로 기소된 것으로 나타났다. 그리고 사건이 발생된 이후에도 학대자와 피해자가 함께 거주하고 있는 사례가 많았으며, 수강명령교육은 사건이 발생한 후 평균 8-9개월 후에 실시되는 것으로 조사되어 사건에 대한 법집행이 매우 지연되고 있음을 알 수 있었다. 아내학대자들의 또 다른 특성으로 자신의 학대행위를 부정하고 축소시키고 있는 것으로 조사되었다. 2. 수강명령처분을 받은 연구대상자의 학대행위 감소에 수강명령교육 보다는 법원의 수강명령처분 판결자체가 더 영향을 주었다. 이는 법 제재를 받는 것에 대한 두려움과 낙인 등에 대한 영향으로 추론된다. 3. 수강명령교육을 통해 본 연구 대상자들의 폭력인지도와 가정폭력법인지도만이 통계적으로 유의하게 높아졌다. 그러나 본 연구자가 연구대상자의 일부를 심층면접한 결과 모든 대상자들이 가정폭력법에 대해 부정적인 태도를 가지고 있어 이에 대해서는 좀더 심층적인 연구가 필요하다고 생각한다. 기타 가정폭력인지도와 성역할인지도 약간 증가하기는 하였지만 통계적으로 유의하지 않았다. 4. 한편, 연구대상자들은 교육전과 마찬가지로 교육후에도 신고자에 대해 부정적인 태도를 가지고 있었으며, 전체 대상자의 55%이상이 자신에게 부과된 보호처분이 자신의 잘못에 비해 과하다고 응답하여 수강명령교육이 연구 대상자의 신고자 및 부과받은 처분에 대한 태도에 영향을 주지 못한 것으로 나타났다. 5. 연구대상자들의 대부분이 수강명령교육의 총회수가 많았다고 보고하였고, 피해자도 함께 교육을 받길 희망한다고 하였다. 한편, 전체 55명 중 3명은 가정폭력을 하면 안된다는 것을 알게 되었다는 것에 그렇지 않다고 응답하였고, 6명은 자신이 변해야 한다는 것을 알게 되었다는 항목에 그렇지 않다고 대답하여 소수의 대상자들은 전혀 변화지 않았으며 변화고자 하는 의지가 없었음을 알 수 있었다. 이렇게 수강명령처분 판결자체는 학대행위 감소에 효과가 있었지만 수강명령교육은 효과가 낮게 나타난 원인은 수강명령처분에 대한 법적 문제점과 수강명령처분 집행의 초기시점에서 오는 실무상의 문제점 때문이라고 여겨진다. 그러므로 법 및 제도적 측면과 실천적 측면에서 아내학대자에게 부과되는 수강명령처분과 교육의 효과성을 높이기 위한 몇 가지 제언을 하고자 한다. 1. 피해자의 안전을 도모하기 위해서는 임시조치를 신속히 처리하여야 한다. 이를 위해서는 경찰이 검찰를 거치지 않고 임시조치를 법원에 직접 청구하므로써 처리과정을 단순화시킬 필요가 있다. 2. 사례관리자 도입으로 사례관리자가 사건출동부터 사건이 종료된 후 사후관리까지 지속적으로 관리하는 것이 필요하다. 이때, 사례관리자는 가해자와 피해자에 대한 지속적인 모니터와 자원연결로 재범의 위험요소를 제거하는 역할을 해야 한다. 3. 학대자가 보호처분을 불이행했을 때에 집행될 수 있는 좀더 엄격한 처벌조항이 마련되어야 한다. 4 . 수강명령처분의 시간을 연장한다. 5. 조사심리과정에서 학대자에 대한 심층적인 사정을 함으로써, 폭력유형 및 정도, 교육수준, 범죄력, 정신질환 등을 고려하여 학대자를 분류한 후, 그 분류에 따라 다른 개입을 하는 것이 바람직하겠다. 6. 법적 대응체계와 지역사회가 함께 협력함으로서 자원 및 정보를 공유하는 것이 아내학대 재범을 줄이는데 효과적일 수 있다. 7. 가정폭력법에 대한 교육을 통해 법과 사회에서 더 이상 가정폭력이 용인하지 않는다는 점을 강조하므로서 재범을 방지할 수 있다. 그러므로 가정폭력법을 중심으로 한 예방교육은 아내학대자 뿐만아니라 일반인을 대상으로도 효과적일 것이라고 예상된다. ; Wife abuse has been occurred for a very long time but it was considered to be a mere private or a family matter. Therefore, very little social intervention was done so far. But in 1997 Act on Prevention of Domestic Violence and Victim Protection and Special Act concerning the Punishment of Domestic Violence were passed and wife abuse became recognized as a societal problem. Through these laws, legal intervention could be done to wife abusers. Legal responses to wife abusers are different from those to general violence and they are dealt as family protection cases. Attending to the court-oder is the most common sentence that wife abusers receive. But since the legal responses to wife abusers were established about 2-3 years ago, there is not enough research done to find out how effectively the court-oder help reducing recidivism of wife abusers. Therefore, this study examines the effects of the court-oder and attempts to suggest ways to enhance and direct the programs for wife abusers based on the research results. Several points are invested in this study: 1. General characteristics of wife abusers, general abuse patterns, and tendency to denying violence are studied. In order to examine these, questionnaires to wife abusers, phone surveys to victims and review of literature were done. 2. Changes in wife abusers behaviors, in other words how much violence was reduced after having received the court-oder were examined. Since there was a possibility for abusers to deny their violence, phone surveys were done to the victims. 3. Changes in abusers attitudes (changes in wife abuse behaviors), changes in knowledge (knowledge on domestic violence laws), changes in cognition (awareness of domestic violence, gender equality, spouse and sentence) were studied. These were examined before and after the abusers attended programs. 4. Lastly, evaluations of the mandatory-treatment program by participants were reviewed. The results of this study are as followed: 1. Those wife abusers who participated in the mandatory-treatment programs are old, have low education level, are simple laborers or technicians or have no jobs. Moreover, 22% of subjects of this study had criminal records and were accused of severe wife abuse. And many couples still live together after the incidents. It is found that court-ordered programs were enforced 8-9 months after the incident happened so, it is clear that execution of law is very slow. Another characteristics of wife abusers are to deny and reduce their abusive behaviors. 2. Receiving the court-order was more effective in reducing abusive behaviors of subjects than actually participating in the mandatory-treatment program. This may imply that fears of being restricted by laws and of being stigmatized influence such behaviors. 3. Only were awareness of violence and knowledge on domestic violence laws statistically significant and enhanced. But from the results of interviews that I did with some of subjects, it was found that all subjects had negative attitudes toward domestic violence laws. Therefore, more research should be done about this. Awareness of domestic violence and gender equality were increased but they were not statistically significant. 4. The subjects had negative attitudes toward people who called the police even after having completed the program. More than 55% of the subjects responded that the sentence they received was not fair and that they did not deserve it. Therefore it was clear that the court-ordered program did not affect the attitudes of wife abusers toward those who called the police and toward the sentence they received. 5. Most of the subjects reported that the mandatory-treatment programs were too long and that the victims also wished to participate together. On the other hand, 3 out of 55 participants answered "no" to the question, "I learned that I should stop abuse my wife." 6 participants answered "no" to the question, "I learned that I should be changed." It is shown that a few participants did not change at all and that they were not willing to do so. The sentence itself has some effects on reducing abusive behaviors but the mandatory-treatment program did not have much influence. The reasons may be that there are legal problems about the sentence for the mandatory-treatment program and the practical problems due to lack of experience in conducting those programs. Therefore, I would like to give several suggestions to enhance the effectiveness of the mandatory-treatment program in legal, structural and practical aspects. 1. In order to maximize the victim s safety, the case should be handled promptly. It is necessary to simplify the procedures so that the police can ask directly for the court to grant temporary orders, without going through the prosecutors. 2. It is necessary to establish a case management system follow up on the cases from the beginning to the end. A case manager should continuously monitor the abuser and the victim and refer them to appropriate resources to remove dangerous elements for recidivism. 3. More severe punishments are necessary when a wife abuser violates protection orders. 4. Mandatory-treatment program should be extended. 5. During the investigation of a case, more complete assessments for abusers should be done so that abusers may be categorized, for example by types of violence that they use, severity of violence, education level, criminal history and mental status. It may be desirable to have distinct interventions according to the results of assessments. 6. It may be effective to have the legal response systems and the communities collaborate with each other to share information and resources in order to reduce wife abuse recidivism. 7. Through education about two domestic violence laws, it may be possible to diminish recidivism by showing that laws and society no longer overlook domestic violence. Therefore, it may be expected that preventive education that is based on domestic violence laws will be effective not only for wife abusers but also for the public.
