고용보장적 관점에서의 직업훈련법제의 검토

Abstract

지식·정보화사회로 일컬어지고 있는 현대사회에서 직업훈련은 국가의 고용정책이나 기업의 인적자원관리에서 중요한 위치를 차지하고 있다. 이와 함께 산업구조와 노동시장의 변화로 인해 근로자는 실업상태에 빠질 위험이 높아졌기 때문에 직업훈련에서 근로자의 고용보장적 측면이 강조되고 있다. 즉 직업훈련을 기업의 경쟁력 강화를 위한 수단으로만 여기는 기업주의적인 입장을 강조하고 있는 오늘날의 현실에서 직업훈련이 근로자의 고용보장을 위한 수단으로 작용할 수 있도록 함으로써 노동법의 한 영역임을 확인시켜야 한다는 점이 제기되고 있는 것이다. 이에 본 논문은 그동안 국민경제 발전의 객체와 기업의 경쟁력 확보를 위한 수단으로만 여겨져 왔던 직업훈련이 근로자의 고용보장을 위한 수단으로 작용해야 한다는 기본입장에서 논의를 전개하고 있다. 즉 국가의 고용정책의 일환인 직업훈련을 통해 근로자가 고용을 보장받기 위해서 직업훈련법이 어떻게 재정비되어야 하는 지에 대하여 논의하고 있다. 이를 위해서 먼저 근로권의 현대적 의의를 바탕으로 고용보장법의 일환으로서 직업훈련법제와 근로자의 직업훈련에 대한 권리에 대해 알아보고, 직업훈련이 근로자의 고용보장을 위해 중요한 역할을 하고 있는 선진외국(ILO규정, 독일, 프랑스, 일본)의 직업훈련법제에 대해 살펴보았다. 이러한 내용을 중심으로 현재 사업주에 대한 지원 중심으로 이루어져 있는 우리나라 직업훈련법제(고용정책법, 고용보험법상의 직업능력개발사업, 근로자직업훈련촉진법 등)의 내용과 문제점을 알아보고 근로자를 위한 직업훈련의 개선방안에 대해 검토하였다. 인간은 노동을 통해 자신의 가치를 발견하게 된다. 따라서 필연적으로 실업이 발생되는 자본주의사회에서 직업훈련은 실직한 근로자의 고용확보와 함께 취업한 근로자의 장기적 고용안정과 더 나은 고용으로 이동할 수 있는 기회를 보장해 주며, 이로 인해 근로자의 인간다운 삶을 보장해주기 때문에 직업훈련에 대한 중요성은 계속 증가할 것이다. ; In modern society, so called is a society of intelligence and information, vocational training stands in a important situation in employment policy of a nation or human resource management of enterprise. Also, owing to the industrial structure and change of labor market, workers are easily fall in unemployment. Therefore vocational training on the thought of employment security of worker is empathizing. So, we must have a thought of vocational training as a means of employment security because most of enterprises empathize only competitive power. Therefore vocational training becomes of an important problem of labor law on the thought of employment security of worker. A study is on developing in that vocational training was operated on employment security of worker. Namely, Vocational Training Act is how to reconsolidate through the vocational training and employment policy of nation. For this, first of all, I studied about a Vocational Training Acts and the right of vocational training of worker in a foundation of modern meaning of right to work and Vocational Training Acts of an advanced country(German, French, Japan). It was reviewed about problems and improvement plan of Vocational Training Acts of our nation(Employment Policy Act, Vocational ability development scheme of Employment Insurance Act, Workers Vocational Training Promotion Act etc), centering around for a employee. A man is found the value of oneself through a labor. Therefore vocational training in capitalism that bring about unemployment guarantees employment security of the unemployed, a long term employment security of the employee and an opportunity of the better working condition. So this guarantees a human life of workers. Continually the importance of vocational training will be increasing.
