MP3, finding the balance between copyright and the right to technologies

Abstract

인터넷을 통한 MP3 음악 파일의 유통은 처음 개발되어 사용이 시작되었을 때부터 그것의 지적재산권법 저촉 여부에 대한 논란이 끊임 없었다. 저작권을 무시한 채 놀라운 속도로 전달될 수 있기 때문이다. 새로운 법 조항들이 그 문제를 다루기 위해 만들어졌다. 국제 지적 소유권 기구(WIPO)는 WIPO 저작권 조약과 WIPO 공연과 음반에 관한 조약을 합의했다. 미국은 Digital Millennium Copyright Act를 통과시켰다. 대한민국 역시 저작권법에 새로운 몇 개의 조항을 덧붙였다. 미국 법원은 MP3 파일 공유와 전달의 합법성에 관한 소송을 몇 번 이미 다루었다. 하지만 이러한 판정들이 인터넷을 통한 비합법적인 혹은 편법적인 MP3 음악 파일 유통을 막을 수 있는지에 대한 의문은 계속 남아있다. 아마 그렇지 못할 것이다. 누구든 인터넷에 자료를 올릴 수 있기 때문이다. 그리고 또한 누구든지 그 자료들을 받을 수 있기 때문이다. 이러한 과정들이 쉽게 감독하기 힘들기 때문이다. 본 논문은 법이 MP3 파일 배포자들을 어떠한 눈으로 보는지, 그리고 그들이 음반업계에 어떠한 해를 미치는지를 알아본다. 또한 본 논문은 MP3 파일이 음반업계를 돕는지 해를 미치는지도 알아본다. 마지막으로 음반업계는 MP3 파일들을 그들에게 도움이 될 수 있는 방법을 모색 해야 한다는 결론을 내린다. 법체계는 또한 새로운 디지털 시대에 걸 맞는 저작권법을 만들어야 할 것이다. ; The distribution of MP3 music files over the Internet has been on the fringe of the intellectual property right law since its beginning. It pays no tribute to copyrights and can be spread at an amazing speed. The legal system has finally caught up with reality. Laws have been passed to cope with the problem. WIPO has agreed on the WIPO Copyright Treaty and the WIPO Performance and Phonograms Treaty. The United States has passed the Digital Millennium Copyright Act. Korea has made some changes in its Copyright Act to conform to the international trend. United States courts have been engaged in lawsuits regarding the legality of distributing or facilitating the sharing of MP3 files. But can these rulings eliminate improper MP3 music file distribution over the Internet? That doesn t seem likely because anyone can put information on it to be distributed. And anyone can get the data from it. It is not easy to monitor. This thesis looks into how the law sees the MP3 distributors and how they may have wronged the music industry. It also relates to whether MP3 files help or hurt the recording industry. Lastly, it concludes that music industry will have to find a way to make MP3 files work for them, instead of trying to squash them. The legal community will also need to form a new set of copyright laws for the new digital age.
