EU-Korea dispute on alcoholic beverage : the issue of national treatment on international taxation and regulation

Abstract

본 논문의 목적은 한국의 국내 주세법에 대한 EU와 한국 간의 분쟁사례를 고찰함으로써 WTO규범의 내국민대우 원칙이 해석되어 시행되는 방식을 알아보고자 하는 것이다 GATT 3조 2항의 국내 조세 및 규정에 관한 내국민 대우 원칙은 각국의 국내 세법파 잦은 충돌을 빚어 왔다. 이미 내국민 대우 원칙과 관련된 분쟁이 여러 차례 발생하였으며 그 분쟁해결 과정 중 GATT 3조의 법률적 해석이 시도된 바 있다. 동종으로 판단되어지는 상품에 대해서는 공정한 경쟁을 위해 국내 조세 및 규정상에서 공정한 대우가 주어져야 함을 규정하고 있는 GATT 3조의 내국민대우 원칙은 1조의 최혜국대우 원칙과 함께 현 WTO무역규범의 핵심이 되는 원칙이다. 여기에서 동종상품의 동일성 및 경쟁관계 판정의 방법과 기준에 대해 각국은 서로 다른 입장을 견지하고 있으며, 이로 인해 분쟁이 발생하는 것이다. EU와 한국간 그리고 EU와 일본간의 주세법 분쟁이 그 대표적인 사례이다. 이 두 사례에 대한 고찰은 현행 국제 무역 규범의 적용 실태와 분쟁 해결 메카니즘의 이해를 도울 것이다. 또한, 향후에도 한국을 상대로 하여 제기될 수 있는 분쟁에 대한 대응 기준을 제시할 수 있을 것이다. ; This thesis, by examining the EU-Korea and EU-Japan disputes on the domestic Liquor Tax Law, aims to see how “National Treatment” is interpreted and executed under GATT 1994. Usually, application of the GATT‘s Article III: 2, National Treatment of Internal Taxation and Regulation conflicts with domestic taxation law Several disputes have arisen in relation to legal interpretation of GATT Article III. Specifically, the criteria and methodology for determining likeness or direct competitiveness and substitutability between domestic products and imported products have been substantial issues in those disputes. Hopefully, the examination of the EU-Korea dispute over Korea’s Liquor Tax will enhance awareness of international trade norms and understanding the mechanism for dispute settlement through the application of current international trade rules. And, in the future, it will also give Korea a defend against future attacks from other trade partners, mostly industrialized countries, in dispute about domestic taxation on imported goods. Knowledge and analysis of the legal issues found in this paper will be based on international trend toward free trade.
