Abstract
이혼은 당사자인 부부의 문제이지만 그 틈에서 자녀는 부모의 이혼 후 부모 중 일방 또는 부모가 아닌 제3자에 의해 양육되며 적응의 어려움을 겪는다. 이러한 자녀들에게 부모의 이혼 후 가장 좋은 양육환경을 제공하여 주는 것은 부모와 사회의 최소한의 역할일 것이다. 그러나 이혼 후 어머니의 자녀 양육률이 외국에 비해 너무 낮다는 사실은 자녀 양육자 결정이 과연 자녀를 위한 최선의 선택이었는가 하는 의문을 갖게 한다. 본 연구는 이혼이라는 어려운 상황에서 자녀양육 여부를 결정할 때 어머니가 좀 더 긍정적이고 적극적인 태도를 가질 수 있도록, 그래서 어머니가 자녀에게 최선의 환경을 만들어줄 수 있는 결정을 할 수 있도록 도움을 주고자하는 의도에서 시작하였다. 그리고 이혼을 하려는 모(母)가 이혼 후 자녀양육 여부를 결정하는데 영향을 미치는 요인을 밝히려는 데 목적이 있다. 본 연구의 대상은 이혼을 결심한 상태의 어머니들로 1998년 10월 중 한국가정법률상담소 본부 및 전국 지부에 이혼상담을 하기 위해 찾아온 내담자들 114명을 상대로 설문조사를 하였다. 본 연구의 자료는 기술적 통계분석 방법과 추론적 통계분석 방법을 활용하여 분석하였다. 본 연구를 통해 나타난 주요 결과를 요약하면 다음과 같다. 첫째, 이혼 후 양육자에 대해서는 자녀를 전부 자신이 양육하고 싶다고 대답한 모(母)가 65.8%이었다. 면접교섭권에 대해서는 자신과 자녀의 면접교섭권은 대부분 허용되기를 원하며 남편과 자녀의 면접교섭권은 반 정도만 허용되기를 원했다. 둘째, 이혼과정에서 어머니들이 받고 있는 사회적 지지는 형제, 부모 등 가족으로부터 지지를 받는 경우가 가장 많고 지지점수도 높았다. 종교단체나 지역사회로부터 지지를 받는 경우는 적었고 점수도 낮았다. 물질적 지지에 비해 정서적 지지를 훨씬 많이 받고 있었고, 정보적 지지는 낮은 점수를 나타냈다. 셋째, 모(母)의 특성 중에는 종교, 직업유무, 이혼 후 남편으로부터 받을 수 있는 양육비가 유의미한 수준에서 자녀양육 여부와 관계가 있는 것으로 나타났다. 자녀의 구성에 있어 자녀의 수, 첫 자녀 연령, 자녀의 성별은 자녀양육 여부와 관계가 없는 것으로 나타났다. 넷째, 통계적으로 유의미한 수준에서 모(母)의 자녀양육 여부 결정에 중요한 영향력을 갖는 요인은 이혼 후 남편으로부터 받을 수 있는 양육비, 정보적 지지이다. 종교도 상당한 영향력을 갖는 요인으로 나타났으나 모(母)의 직업유무와의 상관관계 때문에 그러한 결과가 나타났을 가능성을 배제할 수 없으므로 종교나 직업유무에 의한 영향력은 심도있는 후속연구가 필요하다 하겠다. 이상의 연구결과를 토대로 이혼상담 과정에서 자녀양육 여부 결정과 관련하여 사회사업적 개입에 도움이 될 수 있는 제언을 하고자 한다. 첫째, 이혼과정의 모(母)에 대한 개입은 초기에 이루어지고 지속적으로 이어져야 한다. 둘째, 자녀양육은 이혼 후에도 부모가 함께 해야할 권리이자 의무임을 인식하고, 자녀양육 또는 면접교섭 여부를 결정지을 때 배우자에 대한 감정에 의해 영향받지 않도록 감정의 분리를 도와야 할 것이다. 셋째, 경제력이 자녀양육 여부에 큰 영향을 미치는 만큼 어머니가 경제력을 갖출 수 있는 방안을 강구해야 할 것이다. 어머니 자신이 경제력을 갖추게 하기 위해 직업의 알선, 취업교육을 하고, 공동 양육 의무자인 남편으로부터 양육비를 지급 받을 수 있도록 남편과의 협의 유도 또는 법률적 도움을 준다. 물질적 지지체계와 연결도 중요하므로 모자세대 지원 체계를 알려주고 사회복지전문요원과의 연결, 후원자 개발 등을 해야 한다. 넷째, 어머니에 대한 정보적 지지의 제공이다. 이혼과정의 어머니들은 자신의 권리 유무에 따라 이혼 또는 자녀양육 여부를 결정한다. 확실한 정보의 제공은 어머니의 판단을 도울 것이며, 특히 자녀양육 여부와 관련해서는 어머니의 권리나 의무가 아버지의 권리나 의무와 다르지 않음을 알게 될 때 자신감과 책임감을 동시에 느낄 수 있을 것이다. 또한 모자세대 가정을 위한 사회적 지원체계에 대한 정보도 유용할 것이다. 간단히 법적 및 정책적 제언을 덧붙이자면 다음과 같다. 첫째, 국가는 부모, 전문가와 함께 이혼 후의 자녀양육 문제를 논의해야 하며, 부모의 최종적 결정에 관여해야 할 것이다. 둘째, 자녀양육비의 문제는 국가가 양육비 지급 의무를 확실히 해주고 그 이행을 확보해 주어야 한다. 양육비 지급 의무 불이행자가 있을 경우 양육비 강제집행 제도의 간편화, 또는 국가의 양육비 우선 지급과 의무자에 대한 구상권 행사의 방법도 있다. ; Divorce is a concerns only between two parties, husband and wife. Yet, after the parents divorce, children are likely to be brought up by one of their parents or by a third party, and then they can suffer from adapting to their new life. Therefore, it may be the minimum role of parents and society to provide these children the best possible living condition after the divorce. Since we have a low rate of child custody typical by mother in contrast to other countries, I wonder whether the usual custodial outcome in Korea is the best way for the child. The purpose of this study is to help mother so that she has the affirmative and positive attitude when she decided herself as a custodian of her child in a difficult condition of divorce, and then she decides to provide the bet living condition to her child. This study also aims to manifest the factors that are affecting a mother s decision as to whether she will become the custodian for her child or not after her divorce. This study is made by way of the method of counselling from a question service on 114 women who had decided to divorce and sought the Korea Legal Aid Center for Family Relations and its branch all over the country, during October 1998. This study was analyzed through the application of technical statistical analysis and syllogistic statistical analysis. The main results of this study are summarized as follows: Firstly, 65.8 % of the above women answered that they want to bring up all of their children by themselves. With regard to the right of the mother to visit to the child after divorce, all of them want to be entitled to have such a right but only a half of them want their spouse to be entitled to have such a right. Secondly, during the divorce process, they are mostly supported by their family, that is, sisters, brothers and parents, and this kind of support occupied the high ranking in terms of support in the survey. The support from religious societies and local communities is rare and received a low grading in the survey rating in terms of sources of support. Emotional support is more plentiful than material support, and informational support is very rare. Thirdly, some factors in this study, including the mother s religion, existence of mother s job and possibility of child support benefits receivable from her husband after divorce, have an important influence upon the mother becoming a custodian of her child or not. However, other factors, for example, number of children, age of the first child and gender of the child have little or no affect on the decision. Fourthly, some factors such as the possibility of child support benefits receivable from the husband after divorce and informational support are meaningful factors affecting the mother s resultant possibility of custodianship. The type of mother s religion has proved to be an important factor on this decision too, but such a result may be derived from the conclusion that the mother s religion is closely related to the existence of her job. Therefore, we need further intensive study of the affect of religion and job on this custodial outcome. On the basis of the above results, I offer several proposals to promote the intervention of social welfare service in connection with the decision of a custody of child in the counsel for divorce. Firstly, such intervention shall be made at the first stage in divorce process and shall continued to be provided to the mother. Secondly, the custody of a child shall be considered the right and obligation of both parents, even after divorce. Further more, the public welfare service center etc. can help parents to control their emotions so that any unsavory feeling to the other spouse shall not influence the decision regarding custody of a child or the right of the mother to visit to the child after divorce. Thirdly, in so far as financial power is important to the decision of the mother becoming a custodian of her child or not, any plans or programs shall be prepared to give a mother financial power. For this purpose, a mother shall be provided legal assistance, including finding employment, employment education, counselling with husband as a joint custodian of a child to receive child support benefits. As a material support system or link is also important, a mother not only be informed of the support system for the mother and child but also receive help to contact to social welfare service staff. Supporters and sponsors shall be found and developed to support mother, too. Fourthly, information support shall be provided to a mother. During divorce, a mother choose to seek custody of a child on the basis of whether she has a related right or not. Providing factual and reliable information will help mother s decision. Especially, in connection with custody of a child, when a mother knows that her rights or obligations are not different from the father, she will have confidence and a sense of responsibility at the same time. The information offered by a social support system is also useful. In addition, I would like to add some proposals for policy making. First, the State shall discuss the custody of a child, after divorce, with the parents and an expert advisor, and shall intervene on the final decision of parents. Secondly, the State shall confirm the responsibility of child support payment and enforce it. For non-performance of the payment of child support, the compulsory execution of child support payment shall be simplified and the State can pay to one parent, in advance, the support benefits with maintaining the right to demand reimbursement to the other parent.
