송사형 고전소설 연구

Abstract

본 연구는 訟事라는 법적, 제도적 장치를 소설적 제재로 채택한 일련의 소설들의 특징과, 이러한 소설이 고전소설의 한 영역으로서 어떠한 의의를 지니는가를 살펴보기 위해 시도되었다. 송사는 삶의 현장에서 제기된 문제를 사법적 자격을 갖춘 판관에 의뢰하여 해결하는 것이다. 인간의 송사를 통해 당대 사회에서의 여러 문제점을 거론하고 그 해결을 모색하기 위해 노력한다. 서사문학이 삶의 현실을 재현하는 데 가장 적합한 쟝르라면 송사가 수용된 서사물은 그 의미와 특성을 잘 드러낼 수 있다. 따라서 서사문학의 특성을 밝히는 연구의 한 방향으로 송사를 수용한 소설의 연구는 긴요한 작업이라고 본다. 따라서 본 연구는 송사형 고전소설의 전반에 드러나는 보편적 의미를 심층적으로 분석하고 논리적으로 체계화함으로써, 고전소설의 한 영역으로서의 위치를 점하는 송사형 소설의 특성과 의미를 밝혀보고자 한다. Ⅱ章에서는 訟事話素의 성립과 그 배경을 살피고, 문학적 수용양상에 대해서도 언급하였다. 조선 조 후기의 사회, 경제적인 변화와 서민의식의 변화로 송사에 대한 관심이 증대되고, 송사화소가 지니는 흥미성은 인간의 성향을 강하게 자극시킬 수 있기 때문에, 서사문학에 적극적으로 수용될 수 있다. 문헌에 수록된 설화나 傳에는 송사에 얽힌 이야기가 많이 나타난다. 그런데, 송사가 작품의 주된 제재로 수용되게 되며, 설화나 傳이 소설적 성격을 많이 지니게 된다는 특성을 보인다. Ⅲ章에서는 訟事型 古典小說이 구체적으로 어떻게 전개되는가의 양상을 몇 가지 구성방식으로 나누어 살피고, 그것에서 공통서사구조를 추출했다. 또한 송사형 고전소설의 특성을 가장 잘 드러낼 수 있는 변별적 기준이 問題解決에 있다고 보고, 문제 해결에 결정적 역할을 하는 인물별 하위유형을 나누었다. 判官이 중심이 되어 문제를 해결하는 유형은 搜査型과 訓戒·稱頌型으로 세분될 수 있다. 수사형은 객관적이고 치밀한 수사에 서술의 초점을 모으고, 훈계·칭송형은 죄의 輕重·有無를 따지기 보다는 유교 이념에 입각하여 이를 잘 구현한 자를 높이고, 그렇지 못한 자는 훈계로써 敎化한다. 소송 당사자들이 송사에 적극적으로 개입하여 판결의 결과를 좌우하는 유형은 賂物供與型과 辯論型으로 나뉜다. 이들 유형은 뇌물과 변론이 판결을 誤導하거나 지연시키는 실상을 폭로한다. 제 3의 존재가 개입하여 문제 해결에 결정적 영향을 미치는 유형은 사건을 해결함에 있어서 판관이나 소송당사자의 능력이 한계에 부딪혔음을 보여준다. 이 유형은 寃鬼伸寃型과 女性解決型으로 나뉘는데, 둘 다 허구적 성격과 설화적 성격을 강하게 드러낸다. Ⅳ章에서는 송사형 고전소설의 文學的 意味와 機能에 대해 살폈다. 송사형 고전소설은 사건의 기복과 반전을 통해 서사구조의 역동성을 강화하며, 문제 제기와 그 문제의 해결방법을 긴밀하게 연결시킨다. 또한 작가가 경험하고 있는 세계를 소재로 다루고 이를 현실적으로 해결한다. 그리고 해결과정에서는 인간 중심적 사고와 사법제도에 대한 관심이 드러난다. 또한 송사형 고전소설은 독자들에게 서술적 역전을 통해서는 호기심을, 범인추격과정을 통해서는 긴장과 이완을, 충격적 사건을 통해서는 흥미를, 합당한 보상과 징계를 통해서는 심리적 정화를 제공하며, 권선징악의 현실적 재현과 법의 준엄한 적용을 통해서는 경계와 교훈을 준다. 또한 기존제도의 불합리성과 모순의 풍자를 통해서는 비판적 안목을 갖게 한다. Ⅴ章에서는 송사형 고전소설의 小說史的 意義와 位置를 밝혔다. 즉 송사형 고전소설은 설화적 차원에 머물던 송사를 소설의 주 제재로 삼아 본격적으로 소설로서 형상화했다는 점과, 시대적 변화에 따른 독자층의 감각에 부응한 다양한 소재와 구성기법을 작품에 도입시켰다는 점에서 소설사적 의의를 찾을 수 있다. 송사형 고전소설은 본격적 영웅소설이 쇠퇴되고 새로운 형태의 소설이 다량으로 등장하기 시작한 18C 중엽 이후에 대부분 성립되었다고 추정할 수 있다. 개화기에 들면서 현대적 재판절차의 도입으로 인해 법에 대한 관심이 더욱 증대됨으로써 송사형 소설은 보다 확대되게 된다. 신문연재소설과 잡지게재 소설은 前代小說的 요소를 계승하면서 한편으로는 다양한 변화를 시도하고 있다. 단행본 신소설에 이르면 탐색과 추리의 성격이 보다 강화되고, 罪刑法定主義를 강조한다. 또한 前代小說에서 미흡했던 부분이나 비현실적이고 우연한 요소들은 모두 현실적이고 합리적인 해석 하에서 수용한다. 그 밖에 다양한 구성기법과 흥미 유발적 요소를 통해 추리소설 내지 탐정 소설적인 성격에 보다 근접해가는 경향을 보인다. 以上의 논의를 통해 송사형 고전소설의 문학적 형상화의 실상과 내포된 의미, 소설사에서 차지하는 位相이 체계적으로 파악되었다고 본다. ; This study was attempted in order to examine the characteristics of the series of novels dealing with the legal, institutionalized device of lawsuit as their themes and the significance of these novels as one domain in classic fictions. Filing a suit is one way of solving the problems that arise in life by relying on the judgement of a person with judicial authority. Through lawsuits, man confronts various problems in the society of the times and endeavors to find solutions to these problems. When considering that narrative literature is the most appropriate genre for depicting the reality of life, then it is in the narratives dealing with suits that represent its significance and characteristics. Therefore, a study on novels containing lawsuits is indispensable to the study of the characteristics of narrative literature. Accordingly, this thesis probes into the characteristics and significance of lawsuit-type novels which dominate one sphere of classical novel by logically analyzing and systematizing the universal significance of classical lawsuit-type novels on the whole. In ChapterⅡ, the shape of motif of lawsuit and its background is studied and then the aspects of reception of it is examined. Interest in lawsuits greatly increased in the latter part of Chosun Dynasty due to social and economical changes as well as transition in public consciousness. And since the powerful appeal of the motif of lawsuit can greatly stimulate human nature, it might be positively accepted into narrative literature. In ChapterⅢ, the actual development of lawsuit type classic fictions are studied through some structural frame and then the common structure of narrative is derived. Since there is the distinctive standard in problem solving which best represents the nature of lawsuit type classic fictions, subordinate types are set up according to the importance of the role in solving problems. Type which solve the problems centering judiciary are divided into Inquest Type(搜査型) and Edification-Admiration Type(訓戒·稱頌型). The one focuses on the objective and intensive investigation in the narrative. The other sets a high value on the person who faithfully follows Confucian ideas, instead of judging the verdict of guilty or the gravity of the offence. Types which actively participate in a lawsuit and influence on the result of judgement are divided into Bribery Type(賂物供與型) and Defense Type(辯論型). These types disclose that bribery and defense mislead or delay the judgement. The type which decisively influences on solving problems through the interference of the third person shows the limitation of the power of judiciary or the parties in a lawsuit. This types are divided into Vengeful Ghost Redressing a Grievance Type(寃鬼伸寃型) and Women Solving Type(女性解決型). Clearly these types exhibits fictitious and narrative characteristics. ChapterⅣ deals with the literary meaning and function of lawsuit type classic fictions. These type of fictions are found to intensify dynamics of narrative structure through the rise and fall and reversal of the case in question, and closely connect the raise of problems with the methods of solving them. And these fictions deal with the world that writers are experiencing and try to solve problems practically. In the process of solving problems, independent human will and concerns about the judicial system are found. These lawsuit type classic fictions provide readers with following characteristics; curiosity through narrative reversal, tension and laxity through the process of suspect-pursuit, excitement through the shocking case itself, and psychological purification through appropriate reparation and disciplinary punishment. Thus it gives a warning and a lesson through the realistic revival of poetic justice and stern application of the law, and furthermore, provides a sense of critical judgement through its satiric portrayal of the established system’s irrationality and inconsistency. In ChapterⅤ, the significance of lawsuit type classic fictions in the history of novel is examined. The lawsuit type classic fictions gave full-scale form to lawsuit which has remained in the narrative level, as the main theme of novels, and introduced various themes and composition methods corresponding to the perception of the class of readers following the changes in times. The lawsuit type classic fictions are supposed to be formed in the middle part of 18th century when typical heroic novels were declined and new type of novels appeared.
