쓰레기수거 서비스 행정의 민간위탁에 관한 연구

Abstract

본 연구는 지방자치단체에서 쓰레기수거서비스를 민간위탁 하는데, 민주성이 얼마나 확보되고 있는가를 살펴봄으로써 보다 주민을 위한 서비스를 실시하게 하는데 그 목적이 있다. 민간위탁 과정을 계약과정과 집행과정으로 구분하고, 지방정부, 청소업체, 주민 3자간의 관계 속에서 민주성이 확보되는 것을 살펴보았다. 지방정부와 청소업체 사이에는 계약과정의 공정성, 공개성 입찰과정의 경쟁성, 계약집행 과정의 책임성을 살펴보았다. 고양시의 경우 수의 계약을 실시하고 있어서, 입찰과정의 경쟁성이 나타나 있지 않고, 허가된 업체만 약 20년 동안 청소를 실시하므로 기회균등의 측면에서 공정하지 않다고 볼 수 있다. 계약 집행과정 에서는 지방정부가 청소업체에게 민간위탁을 실시한 이후에도 감시, 감독을 적절히 해야 하는데 거의 하지 않고 있는 것으로 나타나서 민간위탁 후에 책임성이 결여되어 있다고 볼 수 있다. 지방정부와 주민사이의 관계에서는 보다 주민의 수요에 탄력적으로 대응하기 위해서 지방자치가 실시되었고, 보다 주민의 만족에 부응하는 서비스를 실시해야 한다. 그런데 주민의 만족을 알아보는 통로가 마련되어 있지도 않고, 재계약과정에서 주민들이 불만사항이 반영되어 서비스가 좋지 않은 업체도 한 번 허가만 받으면 계속해서 쓰레기수거를 할 수 있기 때문에 주민의 참여와 대응성이 이루어지지 않고 있다고 볼 수 있다. 주민과 청소업체의 관계는 이해당사자 이나 실질적으로 접촉하는 경우는 없으나 청소업체에서 주민의 불만사항이나 서비스에 관심을 가지고 주민만족을 위한 서비스를 해야 하지만 주민만족에 관심을 기울이고 있지 않다. 이것은 농촌지역의 경우에 더 심한데, 농촌지역은 서비스가 제대로 이루어지지 않아 불만사항이 많다. 그래서 민간위탁시 민주성의 확보되어야 한다.;Public services can be defined as services provided by central or local government. There are several types of public services such health services, social services, refuse collection and disposal and so on. There is growing belief that significant in the efficiency and effectiveness of public services can be achieved by making them delivered by private firms. this study, when local government contract out refuse collection and disposal service, democratic ideas need to ensure. How much democratic ideas assure to better services civilian. on privatization dived contract process and execute process, among local government, private firm, civilian, how much democratic ideas assured. between local government and private firm assure fairness, transparence, competition, responsibility. but these idea is not assured. between local government and civilian to better services, need responsiveness and civilian participation but there is no way. so it is need to hear the civilian's voice, we need channel to solve civilian's complaint. between private firm and civilian, also it is need responsiveness and channel to collect the civilian's opinion. It is need to democratic ideas in privatization, so we try to ensure it.
