미국의 이민정책과 다문화주의

Abstract

이민을 통한 인종적, 문화적 다양성을 국가가 어떻게 통합할 것인가 하는 물음에는 크게 동화주의 모델과, 다문화주의 모델의 시각이 존재한다. 동화주의 모델의 목표는 이민자들을 주류 사회에 흘러 녹아들게 하는 것임에 반해, 다문화주의는 다양성의 공존 가운데서 통합을 이루는 것을 목표로 한다. 이민국가인 미국은 전통적으로 이민자들이 앵글로-개신교 문화에 적응 하도록 동화주의 정책을 고수해왔다. 그런데 1965년 국가별로 할당되었던 이민쿼터제의 철폐 이후 미국 사회에는 기존의 백인 이민자가 아닌 다양한 유색인종이 대거 유입되면서 다원주의적 사회가 형성 되었다. 특히 지리적；경제적으로 밀접한 라틴아메리카로부터의 히스패닉 이민자의 대거 유입은 미국의 인종구성에 변화를 일으켰다. 이와 같이 다양한 이민자의 출현은 미국의 국가정체성을 어떻게 형성하고, 미국이라는 나라 안에 이들을 어떻게 포함시킬지에 관한 다양한 논쟁을 낳게 하였다. 특히 보수주의자들은 히스패닉이 잘 동화되지 않은 채 사회에 위협을 끼침으로써 미국 사회가 위기에 빠졌다는 비동화 위기설을 주장하면서 더욱더 강력한 동화주의의 강화를 외치고 있다. 본 연구는 비동화 위기설이 과연 얼마나 타당하며, 더 나아가 동화주의 자체가 얼마나 타당한지에 대한 의문을 제기하면서 시작한다. 본 연구의 목적은 미국의 히스패닉 이민자 동화주의에 관한 논쟁과, 최근의 히스패닉 이민정책을 분석하여 다문화주의적 시각에서 이를 비판하는 것이다. 그리고 더 나아가 미국이 동화주의의 강화를 통해 유색인종을 미국의 역사 안에서 지속적으로 차별하고 의도적으로 배제하고 있음을 밝히는 것이다. 본 연구의 주제는 다음과 같다. 첫째, 동화주의와 다문화주의는 미국의 이민자에 대해 각각 어떠한 태도를 취하고 있으며, 미국의 동화주의 개념은 어떠한 과연 얼마나 타당한 것인가 밝힌다. 둘째, 동화주의자들이 주장하고 있는 히스패닉 이민자의 비동화 위기설이 얼마나 타당한지 경험적 자료 및 역사적 자료를 통해서 검토 한다. 셋째, 미국이 히스패닉 이민자들에게 어떠한 전략을 취하고 있는지를 1990년 이후의 이민정책을 통해 분석한다. 연구 주제에 답하기 위해 다문화주의의 시각에서 동화주의를 인구학적, 규범적, 정책적으로 접근하여 다각도로 검토한다. 또한 미국의 1990년대 이후의 정책은 기존에 연구된 자료를 토대로 한 국가의 정책이 얼마나 동화주의적 시각인지 혹은 다문화주의적 시각인지를 구별하는 분석 지표를 재구성한다. 이 지표를 통해 1차 자료인 미국의 법안을 분석 한다. 실제로 미국의 보수주의자들에 의해서 주장되고 있는 비동화 위기설은 매우 과장되고 왜곡된 것이며, 동화주의라는 개념 자체에 많은 은폐와 차별이 함축되어 있다. 미국의 1990년대 이후의 이민정책은 동화주의의 경향을 강하게 띠고 있으며, 이는 앞으로도 지속 될 것이다. 본 논문은 이민 논쟁의 핵심에 있는 히스패닉 이민자에 관한 사례 연구를 통해서 다문화주의 시각에서 미국의 동화주의가 지금까지 수많은 차별을 함축 하고 있었음을 비판적으로 밝혀낸다. 또한 미국 사회에 팽배해 있는 히스패닉 이민자 비동화 위기설이 얼마나 타당한지를 다양한 자료를 통해 비판한다. 이와 같은 미국의 히스패닉이민자에 관한 연구는 다문화에 살고 있는 현재의 우리들에게 국가통합을 위한 다각적인 방법의 모색에 기여 할 수 있을 것이다.;How does the immigration integrate the racial and cultural diversity into the state? There are two possible explanations: assimilation model and multiculturalism model. The assimilation model aims to make the immigrants be permeated into the major society. The goal of the multiculturalism model is to achieve integration within diversity. The United States of America, the nation of the immigrants, has traditionally adhered to the policy based on the assimilation model, so that immigrants can be adapted into Anglo-protestant culture. However, since the immigration quarter ended in 1965, a great number of diverse non-white races came to the U.S., forming a pluralism society. Especially, the geographical and economical density of the Hispanic immigrants changed the U.S.'s racial composition. Diversity of the immigrants also arose numerous controversies on how to build the U.S.'s national identity and how to integrate immigrants into the nation. The conservatives claim that Hispanics have not fully adapted themselves into society, rather they have threatened the society. The conservatives think that America came to face social crisis because of the non-assimilation of Hispanic immigrants. For this reason, they demand that the assimilation model be strengthened. This research examines how reasonable the argument for the non-assimilation is, and whether the assimilation model itself is reasonable or not. The purpose of this research is to analyze the controversy over the assimilation model for the Hispanic immigrants and the recent immigration policy towards Hispanics from multicultural perspective view through analyzing them. Furthermore, this study intends to reveal that the U.S. has constantly discriminated and excluded non-white races by strengthening the assimilation model. Followings are the major topics of this research: First is to study people's idea about the assimilation model and multiculturalism model as an immigration policy as well as examining the reasonability of the assimilation model. Second is to examine the feasibility of non-assimilation of Hispanic discussion. It is conducted with practical and historical data. Finally, this study aims to analyze the U.S. strategy for Hispanic immigrants in the aspects of migration, employment and culture by studying the American immigration policy since 1990's. To summarize, this research aims to criticize the assimilation model through demographical, normative and political approach. Also to examine the policy since 1990, this research reconstructs the analysis indicators that reflects the changes in the policy, based on the indirect materials. Thereby the study tries to distinguish between assimilation model and multicultural model. The analysis indicators are also used to examine the federal statutes, which is a direct material. This study shows that the U.S. conservatives' non-assimilation argument is exaggerated and distorted. The concept of assimilation model itself includes exclusion and discrimination. Assimilation model, being generally accepted in America society, damages the spirit of national foundation and denies the whole history which is made with immigrants until today. It also conceals the historical fact that the U.S. invaded Latin America and encouraged the Latinos to America to make use of them. Lastly, this thesis analyzes four different immigration polices since 1990's from the perspective view of migration, employment and culture and describes how the U.S. immigration policy operates today. To explain the result California Proposition 187 excludes illegal immigrant from welfare services, PRWORA(The Personal Responsibility and Work Opportunity Reconciliation Act) controls immigrants by welfare services, H.R.4437(Border Protection, Antiterrorism, and Illegal Immigration Control Act of 2005) links the security issue with the immigration issue. This indicates that illegal immigration can be a crime. S.1348(Comprehensive Immigration Reform Act of 2007) makes a condition that only the people who has special skill or talent can migrate to the U.S. These cases clearly show that the U.S. has been strengthening the assimilation model. The U.S. immigration policy since 1990 has been biased toward assimilation model, and it does not seem to change in near future. The academic contribution of this research is as following. First, by studying the immigration policy for Hispanics is controversial. This research critically offers the opportunity to prove that the U.S's assimilation model has caused numerous discriminations so far. Also it criticizes the feasibility of Hispanic immigrant's non-assimilation model. In conclusion, this research clarifies how the U.S. has discriminated diverse races and groups. Moreover, this research would contribute to help people in finding the ways of achieving national integration.
