Abstract
1990年代以後EU, NAFTAなど地域經濟統合の流れのなかでも多者間貿易体制だけを通商政策の基本にしていた日本も2000年ごろ國內外的な圧力によって自由貿易協定(Free Trade Agreement, 以後FTA)を積極的に推進する政策を進めている。FTAの締結で國民の厚生の向上、効率的な資源配分という國際經濟的に肯定的な結果が予想されるが、市場を殆ど完全に解放するというFTAの原則を考慮すると、一國のなかで國際競争力が低い産業部門はFTAを通して被害を受ける可能性もある。國際競争力によって分けられる國內の利害関係の對立のため、交渉者は相對國の交渉者との國際レベル(レベルⅠ)の交渉とこの合意事項について國內的に批准(ratification) を得るべきの國內レベル(レベルⅡ)のツーレベルの交渉に置かれようになる。 日本の場合、農業部門が脆弱な産業構造を持っている状況でFTAを締結しようとするとき、農業部門の市場の開放は交渉者側からも負担になることに間違いない。日本ののFTA締結國であるシンガポールが非農業國家であるに反して、二つ目の交渉國であるメキシコの貿易構造は農産物は輸出して工産品は輸入するので、FTAが締結されると、不利益を得るのが明確に見える日本の農業部門で強力に抵抗した。一方、メキシコはアメリカ,カナダとのNAFTA以外にもFTAを数多く締結している。日本でメキシコに投資、輸出するㅗ日本の企業らはメキシコとのFTAの不在のため、相對的に不利な条件で競争して莫大な逸失利益が出ている。それで、日本經團連を中心にした日本の財界団体らは日本政府にメキシコとのFTAを進めるべきと強く求めた。 本硏究は國內の利益集団の選好と利害関係が甚だしく對立した日本とメキシコとのFTA 締結過程を硏究對象にした。國際レベルの交渉と國內レベルの交渉の連繋を重視したパトナムのツーレベル·ゲームの理論を適用した。まず,國內の利益葛藤構造のなかで利益集団らはどのような選好を持っているか、次は多様な利益集団らの選好と利害の連合関係が交渉者の選択にどのような影響を与えたか、三つ目に、交渉者たちは交渉を支持する集団と抵抗する集団をどのように利益を調整し、國際的に相對國の交渉者にはどのような戰略を利用したかを分析した。 パトナムのツーレベルゲームの理論は國を代表する交渉者ら間の交渉である國際レベルの交渉と交渉締結がもたらす損益によって國內でつくられる交渉の支持、また抵抗勢力は交渉者の交渉である國內レベルの交渉の構造をもっている。このツーレベル ゲーム理論で合意が算出されるためには両國のウィン·セット(win-set,合意可能領域)が重なる部分があるべきである。基本的にウィン·セットの大きさは國內の利害関係の選好と勢力分布、國內の政治制度、そして主要交渉者の戰略によって決められる。交渉者は自國と他國のウィン·セットを調整して交渉を自分に有利に導く事ができる。 実際に國內の利益集団としてFTA支持勢力である鉄鋼業界、自動車業界など産業部門とこれらを含める財界団体の日本經團連と、抵抗勢力のなかでも強い抵抗を見せた養豚業界、そして農業団体、全國農業協同組合中央會は利益對立の構造をみせている。その中で日本經團連はシンクタンクとして交渉者にメキシコとのFTAの必要性を提起して交渉予備機から主要な役割をし、交渉が進められる中にも他の財界団体と連合して交渉者集団に締結を求める共同声明を発表するなど、持続的な努力をしてきた。 その反面、抵抗勢力を代表すると予想された全國農業協同組合は交渉の始めに具体的な自分の懸案として受け入れるよりは交渉が終わってからFTAへの對策を整えるなど微温的な態度を取っている。その反面、養豚業界では業界內の連合は勿論、消費者との連帯、ひいては交渉者集団にも持続的な接触をした。それに、2003年9月にはメキシコのカンクンで交渉者集団を別々訪問して同一業界の実態を把握するとともに相對國の交渉者に會い,世論,國民に訴えるなど超國家的ロビーと超國家的提携の戰略を用いていた。 本論文で日本∙メキシコFTA交渉過程を硏するにおいて、注目したのは上述したのように交渉者ばかりでなく、利益集団らの主体的な役割が目立ったことである。交渉者側からにはパトナムが一つの主要交渉者を設定したが、日本の特需性に照らし、交渉者集団という概念と用いた。集団の內には對立した利益の調整において首相の役割が目立ったことが分かった。 交渉者集団は三つに分れる。まず、主要交渉者としての首相、二つ目は、交渉締結文書に乗っている関係4省(外務省、経済産業相、財務省、農林水産省)、三つ目は、間接的な交渉者としての自民党である。首相は交渉者集団の中で、FTA抵抗をしている勢力、特に自民党の農水族議員を牽制するために閣僚の人事問題を戦略的に利用し、自民党の組織での変化を図った。複合的な利益関係をもとめる農林水産省の場合、その両分している点のため、むしろウィンーセットの縮小と拡大の機能を同時にできるようになった。自民党の場合も農水族と経産族との対立する軸でFTA特命委員会という話し合いの'場'を通して利益調整ができたと言える。 FTA交渉の経験が豊富なメキシコは交渉過程で国内の利益集団と一緒にした反面、日本は決裂した2003年10月交渉の以後、首相の官邸FTAチームをメキシコに派遣するなど、官邸主導の様相をみせた。また、対国民戦略として農業部門はもう保護の対象ではなく、構造改革の対象であることを強調し、一般大衆に消費者としての認識させた。特に日本の産業界の損害について周知させたのである。 日本においてメキシコとのFTAは農業部門でのある程度の譲歩でアジア諸国とのFTAが可能であることを示す転機的な意味をもっている。 国際的にみると、アジア地域は散発的な地域貿易協定の締結と、関税の自由化の範囲や、速度、原産地規制においても違う基準を適用しているため、貿易手続きがより複雑になる可能性もある。そのなかで、日本の積極的なFTA推進の戦略は日本の国内の政治経済的な条件を交渉者集団の内部と利益集団らの調整を経て整えていることが交渉過程でみられた。 国際競争力が低い農業部門、またFTAの不在で損失を受けている産業部門をもってい韓国は日本のFTA締結と関連した利益集団の葛藤構造と類似な利益構造をもっている。2006年の現時点、アメリカのはじめ、アジア諸国とのFTAに直面、準備すべきであることを考えてみると、日․墨FTAでみられる利益葛藤構造と、これを交渉過程で政府がどのように調整し、解決していたかは注目する必要があるだろう。;1990년대 이후 EU, NAFTA등의 지역경제통합의 흐름 속에서도 다자간 무역체제만을 통상정책의 기본으로 삼고 있던 일본도 2000년을 전후하여 국내외적인 압력에 의해 자유무역협정(Free Trade Agreement, 이하 FTA)를 적극적으로 추진하는 정책을 펴나가고 있다. FTA체결로 국민 후생의 향상, 효율적인 자원 배분이라는 국제경제적으로 긍정적인 결과를 예상할 수 있지만, 시장을 거의 완전하게 개방해야 한다는 FTA의 원칙을 고려해 볼 때, 한 국가 내에 국제 경쟁력이 낮은 산업부문은 FTA를 통해 손실을 입을 수도 있다. 국제 경쟁력에 따라 분열되는 국내의 이해관계의 대립으로 말미암아, 협상자는 상대국 협상자와의 국제레벨 (레벨Ⅰ)의 협상과 이 합의사항에 대해 국내적으로 비준(ratification)을 얻어야 하는 국내레벨(레벨Ⅱ)의 투 레벨의 협상에 놓이게 된다. 일본의 경우, 농업부문이 취약한 산업구조를 가지고 있는 상황에서 FTA를 체결하려고 할 때 농업부문의 시장 개방은 협상자 측에서도 부담스러운 일임에 틀림없다. 일본의 첫 FTA체결국인 싱가포르가 비농업국가이었던 데 반해, 두 번째 협상국인 멕시코의 무역구조는 농산물을 수출하고, 공산품을 수입하는 것으로서, FTA가 체결될 경우, 불이익을 감수해야 하는 일본의 농업부문에서는 강력한 저항을 하였다. 한편, 멕시코는 미국, 캐나다와의 NAFTA이외에도 FTA를 매우 많이 체결하고 있는 국가이다. 일본에서 멕시코에 투자, 수출하는 일본의 기업들은 멕시코와의 FTA가 부재함으로 인하여 상대적으로 불리한 조건에서 경쟁함으로써 막대한 손실을 입고 있으므로, 경단련을 중심으로 한 일본 재계단체들은 일본 정부에게 멕시코와의 FTA를 추진해야 할 것을 강력히 요청하였다. 이에 본 연구는 국내의 이익집단들의 선호와 이해관계가 극심하게 대립되었던 일본과 멕시코와의 FTA 체결과정을 연구대상으로 삼았으며, 국제레벨의 협상과 국내 레벨의 협상의 연계를 중시한 퍼트남의 투 레벨 게임 이론을 적용하였다. 첫째, 국내의 이익갈등구조 속에 이익집단들은 어떠한 선호를 갖고 있었는지, 둘째, 다양한 이익집단들의 선호와 이해의 연합관계가 협상자들의 선택에 어떠한 영향을 미쳤는지, 셋째, 협상자들은 협상 지지 집단과 저항 집단을 어떻게 이익조정하고 국제적으로 상대국 협상자에게는 어떠한 전략을 이용하였는지를 분석하였다. 퍼트남의 투 레벨 게임 이론은 각 국가를 대표하는 협상자들간의 협상인 국제레벨의 협상과, 협상체결이 가져오는 손익에 따라 국내에 형성되는 협상 지지 세력과 저항 세력들과 협상자의 협상인 국내레벨의 협상이라는 구조를 갖는다. 이 투 레벨의 게임에서 합의가 이루어지기 위해서는 각 국의 윈셋(합의가능영역)이 서로 겹치는 부분이 생겨야 한다. 기본적으로 윈셋의 크기는 국내 이해관계의 선호와 세력분포, 국내 정치제도, 주요협상자의 전략에 의해 결정된다. 협상자는 자타국 내의 윈셋을 조정하여 협상을 자신에게 유리하게 이끌어갈 수 있다. 실제로, 국내이익집단으로서 FTA지지세력인 철강업계, 자동차업계 등 산업부문과 이를 포함하는 재계단체 일본경단련과, 저항세력 중에서도 강한 저항을 보였던 양돈업계, 그리고 농업단체인 전국농업협동조합 중앙회는 이익대립의 구조를 보이고 있다. 그 가운데 경단련은 싱크탱크로서 협상자에게 멕시코와의 FTA의 필요성을 제기하여 협상예비기부터 주요한 역할을 하였으며, 협상 진행 중에도 타 재계단체와 연합하여 협상자집단에게 체결을 촉구하는 성명을 발표하는 등 꾸준한 노력을 해왔다. 한편, 저항세력을 대표하리라 예상되었던 전국농업협동조합은 협상 초기에 구체적인 자신의 현안으로 받아들이기보다는 협상이 종결되고 나서 FTA에 대한 대책을 마련하는 등의 미온적인 태도를 보이고 있었다. 이에 반해 양돈업계에서는 협상 전반기에 자신들의 이익의 침해에 대해 성토하며 이를 국익과 연관시켜 업계내의 연합은 물론, 소비자와의 연대, 나아가 협상자집단에게도 지속적 접촉을 하였다. 이에 더하여 2003년 9월에는 멕시코 칸쿤에서 멕시코의 양돈업계의 이익단체를 방문하여 동일 업계의 실태를 파악하고 상호 이해의 폭을 넓히는 한편, 상대국 협상자들과 만나고, 여론, 국민에게 호소하는 등 초국가적 로비, 제휴 전략을 사용하고 있었다. 본 논문의 일·멕 FTA협상과정에서 주목한 점은 상술한 바와 같이 협상자 뿐 아니라 이익집단들의 주체적 역할이 두드러졌다는 점이다. 그리고 협상자 측에서는 퍼트남이 하나의 주요한 협상자를 설정한 반면, 일본의 특수성에 비추어 보아 협상자집단이라는 개념을 사용하였다. 집단 내에 대립되는 이익들의 조정에 있어 수상의 역할이 매우 중요하였다는 것이 협상과정을 통해서 드러난다. 협상자집단은 크게 셋으로 분류가 가능하다. 첫째, 주요협상자로서의 수상, 둘째, 협상체결문서에 등재되어 있는 관계4성청 (외무성, 경제산업성, 재무성, 농림수산성), 셋째, 간접적 협상자로서 자민당을 들 수 있다. 수상은 협상자집단 내에서 FTA저항세력이라고 할 수 있는 자민당의 농수족을 견제하기 위해 각료의 인사문제를 전략적으로 이용하고, 자민당의 조직에서 변화를 도모하기도 하였다. 관계4성청 중 복합적 이해관계를 내포하고 있는 농림수산성의 경우, 양분되어 있는 부분 때문에 오히려 윈셋의 축소, 확대의 복잡한 기능을 동시에 할 수 있었다. 자민당의 경우도 농수족과 경산족이라는 대립되는 축 속에서 FTA특명위원회라는 장(場)을 통하여 이익조정기능을 발휘할 수 있었다. FTA협상경험이 풍부한 멕시코는 협상과정 내내 국내의 이익집단들과 대동하여 협상에 임하였던 반면, 일본의 경우는 복잡한 이해관계 속에서 협상 후반기에 비공식적인 수상관저의 이익조정기능을 활성화함으로써 관저주도의 협상 양상을 보여주었다. 또한 대국민 전략으로서 농업부문은 더 이상 보호의 대상이 아니라 구조개혁의 대상이라는 것을 주장하며, 일반 대중에게 소비자로서의 인식을 일깨우고, 특히 일본 산업계의 어려움에 대해 주지시켰던 것이다. 특히, 일본에게 멕시코와의 FTA체결은 농업부문에 있어서의 어느 정도의 양보를 통하여 아시아 각국과의 FTA가 가능함을 보여주는 전기적인 의미를 가지고 있다. 국제적으로 볼 때, 아시아지역은 산발적인 지역무역협정의 체결과, 관세 자유화의 범위나 속도, 원산지 규제에 있어서도 서로 다른 기준들을 적용하고 있기 때문에, 무역절차가 더 복잡해질 가능성도 있다. 그러한 가운데 일본의 적극적인 FTA 추진 노력은 이러한 동아시아 지역주의의 추구라는 국제적 목표를 달성하는 데 저해요인이 되었던 일본 국내의 정치경제적 조건들을 협상자들과 이익집단들의 조정을 통해 풀고 있음을 일·멕FTA 협상과정에서 볼 수 있었다. 취약한 국제경쟁력을 가진 농업부문, 그리고 FTA 미체결로 인한 손실을 입고 있는 산업부문을 가진 한국은 일본의 FTA 체결과 관련한 이익집단의 갈등구조와 유사한 이익구조를 갖고 있다. 현재 미국을 비롯하여, 멕시코, 아세안 국 들과 차후 중국과 일본과의 FTA에 직면해 있으며, 또 준비해야 한다는 것을 고려해볼 때, 일·멕FTA에서 보이는 이익갈등구조와 이것을 협상과정에서 정부가 어떻게 조정하며 해결하고 있는지에 대한 함의는 클 것이다.;Since 1990s, Japan, who set only a multi-trade system as a principle of its trade policy, even amidst the trends of regional economic unity such as EU and NAFTA, adopted a policy that actively promotes the Free Trade Agreement (FTA), around 2002, by the domestic and international pressure. Entering the FTA expects to bring positive effects at the international economic level, such as the improvement of public welfare and effective distribution of resources. However, given a FTA rule that a country must open a market almost completely, the industry that is comparatively disadvantaged compared to its international competitors can be damaged by FTA. Due to the conflicting interest in national level, disrupted according to the international competitiveness, the negotiator comes to confront a two-level negotiation: a negotiation with a partner negotiator at the international level (level I); and a negotiation that aims at achieving the ratification on the mutually-agreed matters at the national level (level II). In the case of Japan, contracting the FTA under its industrial structure with weak agriculture sector would not permit the negotiating party to feel easy about opening of agriculture market. Different from Singapore, the first FTA partner of Japan, Mexico, the second negotiating party, has an industrial structure that imports agriculture and exports industrial products. Thus, Japan’s agriculture sector, who has to bear disadvantages after Japan contracts a FTA, strongly opposed the contract. Mexico is a country who actively contracts FTA with many partners, in addition to the NAFTA with the United States and Canada. Japanese companies who invest and export to Mexico from Japan has a relatively disadvantaged condition to compete with others, due to the absence of a FTA with Mexico, and thus suffer great loss. Accordingly, Japanese economic groups led by the Nippon Keidanren, demanded that the Japanese government should promote a FTA with Mexico. In this regard, this paper chose the FTA contracting process between Japan and Mexico as a research subject, where the preferences and interests of the national interest groups extremely opposed each other, then applied Putnam’s two-level games that laid stress on the linkage between a negotiation at the national level and at the international level. The paper analyzes: first, what preferences did the interest groups have in the structure of conflicting interests at the national level; second, how the combination of the above preferences and understanding influenced on the negotiators’ decisions; and third, how did the negotiator arranged the interest of the supporting party and the opposing party and what strategy did the negotiators use against the partner negotiators at the international level. Putnam’s two-level game theory has a structure of an international-level negotiation between negotiators representing each country, and a national-level negotiation between the supporting and the opposing parties that are formed at the national level according to profits and losses as a result of contacting the agreement. In order to reach a mutual agreement at this two-level game, each country’s win-set (a territory where an agreement is possible) should overlap. Basically the size of win-set depends on the preference of national interests and power distribution, national political system, and strategy of main negotiators. A negotiator can adjust win-sets of countries and lead a negotiation towards his/her own advantage. Actually, the steel and auto industries that support the FTA among national interest groups and the Nippon Keidanren, an economic group that includes the above party, shows a structure of conflicting interests with the pork industry that strongly opposes the FTA and the National Agricultural Cooperative Federation as its higher-ranking group. Among these, the Nippon Keidanren, as a think tank, played a main role by suggesting the necessity of contracting the FTA with Mexico, and put continuous efforts even in due course of the process by declaring a statement in league with other economic groups, that urges the negotiators to contract the FTA. As written above, this paper focuses on the important role played by the interest groups, not only by negotiators, while investigating the process of FTA contract between Japan and Mexico. While Putnam put the emphasis on the roles of the chief negotiator, the paper uses a concept of a negotiator group, given the particularity of Japan. It is shown through the negotiating process that the role of the prime minister was very important at arbitrating conflicting interest within a group. A negotiator group can be categorized into three groups. First, a prime minister as a chief negotiator; second, the concerning four Ministries (the Ministry of Foreign Affairs, the Ministry of Economy, Trade and Industry, the Ministry of Finance, and the Ministry of Agricultural, Fisheries and Food), recorded at the agreement contracting document; and third, the Liberal Democratic Party of Japan as an indirect negotiator. In the case of the appointment of ministers by the Prime Minister, aiming at arbitrating interests among a negotiator group, and the case of the Ministry of Agricultural, Fisheries and Food, among the concerning Ministries that has complex interests, the component of bisection rather allowed a complicated function to reduce and expand the win-set. In the case of the Liberal Democratic Party of Japan, among the opposing axis between the Agricultural-Fisheries group and the Economic-Industrial group, the Party could arbitrate the interests at the venue of the Special Committee of FTA. While Mexico, who had many experiences of the FTA contracting, was accompanied by the national interest groups in facing the negotiating, Japan, amongst its complicated interests, demonstrated a negotiating aspect led by the officials by activating the non-official function of the Prime Minister in arbitrating interests at the latter half of the negotiation. In addition, by adopting a national strategy that asserts the agriculture sector is not anymore an object of protection but is an object of a structural reform, they brought to the attention of the Japanese population the recognition as a consumer, and shed lights on the hardship of the Japanese Industrial field. Particularly, the case of FTA contract between Japan and Mexico serves as a milestone in a sense that Asian countries can conclude the FTA with other countries by compromising some agricultural parts. From the international point of view, the Asia region has a possibility of offering more complicated trade process, because different standards are applied as for rules of origin, the scope and pace of tariff free, and sporadic contracts of regional trade agreement. Amongst these circumstances, Japan’s active efforts at the process of Japan-Mexico FTA contract in promoting the FTA demonstrated that Japan is dealing with its political and economical conditions that impede the international goal, promoting regionalism in East Asia, by arbitrating the interest groups and negotiators. Korea, that has an agriculture sector with a weak international competitiveness and an Industry sector suffering a loss from the absence of a FTA contract, has a similar structure of interests to that of Japan. Considering the fact that Korea has to confront and prepare for a FTA with the United States, Mexico, Asian countries, as well as China and Japan, Korea has to learn the structure of conflicting interests and how the government arbitrated and solved it from the case of Japan-Mexico FTA contract.
