복지국가원리와 사회보장법제에 관한 젠더적 분석

Abstract

우리 헌법은 복지국가원리를 명문으로 규정하고 있지는 않지만 헌법 전문, 사회적 기본권조항(헌법 제31조 내지 제36조), 경제영역에서의 국가의 의무 조항(헌법 제119조 제2항 이하)등과 같은 구체화된 표현을 통하여 복지국가원리를 수용하고 있다. 또한 복지국가실현을 위하여 다양한 사회보장법제를 두고 있다. 이는 크게 사회보험 관련법과 공공부조 관련법, 사회복지서비스 관련법으로 나누어진다. 여기서는 주요 사회보험관련법과 공공부조 관련법을 중심으로 살펴보도록 한다. 사회보험 관련법은 크게 국민연금법, 산재보험법, 고용보험법, 국민건강보험법으로 공공부조 관련법은 국민기초생활보장법으로 분류할 수 있다. 그러나 이러한 사회보장법제를 통한 복지국가의 실현이 성평등한 복지국가를 정립하는 데에는 이르지 못하였다. 여성주의자들의 지적처럼, 복지국가의 법제와 정책은 성 중립적인 시민권개념에서 출발하였지만 전통적인 성역할체계를 전제하고 있었다. 그 결과 복지국가는 가부장적 이데올로기와 결합하여 오히려 젠더편향적으로 발전하게 되었다. 이 논문에서는 주류 복지국가론을 소개하고 이에 대한 여성주의자들의 비판과 새로운 복지국가 유형론을 살펴보았다. 또 이를 바탕으로 우리 사회보장법제를 개별적으로 분석하여 성 중립적으로 보이는 법 규정들이 어떻게 여성들에게 다르게 작용하는지를 분석하였다. 성 평등한 복지국가의 실현을 위해서는 복지국가의 젠더적 편향을 지적하고 사회보장법제에 대한 젠더적 분석이 필수적이다. 국민 모두에게 복지국가원리가 실현되고 여성과 남성 모두에게 성 평등한 복지국가를 이룩하기 위해서는 사회보장법제의 젠더적 분석이 전제되어야 하며 이 논문은 이러한 지점에서 의의를 갖는다.;The provision of welfare-state principles is not stated in the Korean constitution, but accepts the principles through various expressions embodied in social fundamental rights (constitution article 31-36), national obligatory provision (constitution article 119, section 2) and etc. Furthermore, to establish welfare state, we have many Social Security Acts, which are divided into three categories, social insurance laws, public assistant laws, and social work service. However, the realization of welfare state through the Social Security Act didn't reach to the establishment of gender equal welfare state. As feminists say, legislation and policy in welfare state started from the gender neutral citizenship, but presupposed traditional gender role. So, combined with patriarchalism, welfare state have developed in gender biased way. This paper introduces major welfare state theories, examines criticism of feminists against them and new welfare state typology and analyzes how gender neutral-looking laws differently are applied to women by examining the Social Security Act thoroughly. To establish gender equal welfare state and realize welfare-state principles, it is essential for us to clarify the gender biased aspects in the welfare state, and to analyze the Social Security Act in a gender neutral way. This paper has an important meaning on it.
