dc.description.abstractAs a member of WTO, Indonesia had to ratify the TRIPS Agreement and incorporate it into its national regulations. This resulted in the rigorous reformation of the Indonesian IPR laws. Despite the efforts, the implementation of the IPR law enforcement has remained very difficult. The goal of the laws, that is to boost the national innovation, is still far from being achieved. There has not been a significant improvement of the innovation created by the people. The situation get worse when the outbreaks of H5N1 AI pandemic spread in Indonesia., in which Indonesia contributed half of the world’s victim. This event has raised the concern over TRIPS Agreement in the developing countries especially in public health, as the patented AI drugs were patented. The delay in the innovation is also occurring as there is insufficient pharmaceutical manufacturer in Indonesia that is able to produce the medicine, once the patent has been removed. It would take some time before the companies manage to produce this medicine, while at the same time the pandemic started to spread very fast.;WTO의 회원국인 인도네시아는 TRIP 협정을 비준하고 이것을 국가 규제 사항에 통합시켰다. 그 결과 인도네시아 IPR법의 엄격한 개혁이 이루어지게 되었다. 하지만 그러한 노력에도 불구하고 IPR법 집행은 여전히 제대로 실행되고 있지 않다. 인도네시아 혁신을 추진하기 위한 이 법은 여전히 그 목적 달성이 요원하다. 국민들에 의해 만들어진 이 혁신제도에 대한 개선이 잘 이루어 지지 못하고 있다. 전 세계 환자의 반 이상이 인도네시아에서 발생했던 H5N1 AI이 전국에 퍼지게 되자 상황은 더 심각해졌다. 이 사건은 개발도상국의 TRIPS 협정, 특히 특허의약품인 AI 치료제를 사용하는 공공보건에 대한 우려를 야기시켰다. 인도네시아의 경우 의약품을 제조할 능력이 있는 제조업자들이 많지 않기 때문에 특허권이 만료된 이후에 의약품을 생산할 수 있는 기업이 생길 때 까지는 오랜 시간이 걸릴 것이고 한편 이 유행성 질병은 빠른 속도로 퍼져 나갈 것이다.-
