생명권과 생명가치에 대한 연구

Abstract

이 논문은 무의미한 연명치료중단에 있어 생명권과 생명가치가 어떠한 의미를 가지는지를 연구하는데 그 목적을 두고 있다. 최근에 있었던 무의미한 연명치료중단과 관련된 대법원의 생명권에 대한 해석은 다소 애매하다. 대법원은 한편으로는 인간의 생명이 불가침하기 때문에 생명권이 침해될 수 없다고 하면서, 다른 한편으로는 죽음에 이를 수 있는, 회복불가능한 말기 환자에 대한 치료중단의 권리는 인정한다. 이러한 면에서 대법원의 연명치료중단에 대한 대법원의 이러한 모습을 해명하기 위하여, 이 문제와 관련된 드워킨의 이론을 도입하여 생명권의 개념을 재해석 해보고자 한다. 드워킨은 생명의 가치에 대한 개념을 발전시켰다. 먼저, 그는 생명의 가치가 완성된 것으로 인정되는 것이 아니라 끊임없이 변화하고 형성된다고 하는 점에 주목한다. 그는 또한 형성되고 변화되는 생명의 가치는 정합적인 삶에 대한 존중에서 비롯된다고 주장하였다. 이러한 드워킨의 주장을 수용하여 무의미한 연명치료중단을 정당화할 수 있는 두 가지 조건을 제시하고자 한다. 생명권은 두 가지 조건이 충족되는 한도 내에서 환자의 연명치료중단을 철회하는 권리로 확장되어야 한다. 먼저 주관적인 조건이 있다. 매일의 일상적인 삶 속에서 사람들이 존엄하게 살아가기를 바라는 것처럼 존엄하게 죽음을 맞이하고자 하는 소망을 반영할 때 개인적인 요소가 고려한다면, 연명치료중단 철회에 대한 환자의 요청은 받아들여져야만 할 것이다. 다음으로 객관적인 조건이 있다. 연명치료중단은 환자가 드워킨이 제시하였던 자연적 창조력의 투여가 소멸된 불가역적 사망의 단계에 이르렀을 때 승인되어야 한다.;This thesis aims to reinterpret the right to life in relation to the issue of withdrawing life-sustaining treatment. Current interpretation of the Supreme Court on the issue of withdrawing life-sustaining treatment is ambivalent. The Supreme Court claims the right to life cannot be violated as the haman life is inviolable because of the sanctity of life in one hand, but it admits the right of the patient who is suffering from the irreversible unconsciousness to refuse treatment, consequently choose to have a decent death on the other hand. The decision of the Supreme Court decision itself reveals self-contradictory. To solve the contradictory position of the Supreme Court on the issue of withdrawing the life-sustaining treatment, I tried reinterpret and expand the concept of the right to life with help of the Dworkin's theory in relation to this issue. Dworkin advanced the concept of the value of life. First, he focuses that the value of life can not be completed, rather it is changing continuously. Second, he also claims that major criteria of evaluating the changing values of life should be based upon the human integrity. Accepting the Dworkin's idea of the changing values of life, I reformulated the right to life in relation to the issue of withdrawing the life-sustaining treatment. I claims that the concept of the right to life should be expanded to admit the patient's right to withdraw the life-sustaining treatment under two conditions being respected. First condition is subjective one. Considering nothing but the individual elements reflecting patient's hope to have decent death as well as decent life which has been shown during the heathy daily life, the demand of patient to withdraw the life-sustaining treatment should be admitted. Second condition is objective one. Withdrawing of life-sustaining treatment should be admitted when the patient is suffering from the irreversible unconsciousness as the natural creative investment is fading away.
