WTO SPS 협정의 조화, 동등성 및 투명성 조항에 대한 연구

Abstract

이 논문은 WTO SPS 협정의 조화, 동등성, 투명성 조항에 대한 연구이다. SPS 협정의 해당 조항에 대한 해석 및 논의 동향을 중점적으로 살펴보고자 한다. 과거보다 풍요로운 삶이 가능해졌고, 평균 수명이 연장됨에 따라 인간의 건강과 관련한 관심은 그 어느 때보다 높다. 또한 무역장벽 제거를 통해 원활한 세계 무역을 위하여 노력하는 WTO 회원국들의 인간 및 동식물의 건강과 관련된 SPS 협정의 준수에 대한 중요성은 점차 증대되고 있다. 인간의 생명과 직결되는 SPS 조치는 한미 간의 쇠고기 위생 검역 협정을 둘러싼 문제를 통해 경험했듯이, 문제가 발생하면 정치적인 문제로 확대되어 국가적 혼란을 야기하기도 하고 중국의 식품 멜라민 첨가 사건과 같이 전 국민의 염려를 불러일으키는 등 문제가 확산된다. 이에 따라 해당 SPS 협정의 올바른 이해를 통한 준수와, SPS 조치와 관련된 분쟁의 발생을 예방하는 것이 중요하다. 논문에서는 SPS 협정의 조항들 가운데 제3조 조화 조항, 제4조 동등성 조항 및 제7조 투명성 조항에 대하여 중점적으로 다룬다. 해당 조항은 SPS 조치의 분쟁 해결과 관련하여 주로 언급되는 조항은 아니다. 하지만 SPS 협정의 특성상 분쟁 발생 후 추후 조치를 취하는 것보다 조화, 동등성, 투명성 조항 등의 협정 이행을 통하여 사전에 예방하는 것이 보다 중요하다고 보여진다. 따라서 해당 조항과 관련되는 몇몇의 판례와 SPS 위원회의 논의를 통해 협정의 해석과 논의 동향에 대하여 분석한다. SPS 위원회는 해당 조항과 관련하여 이행을 위한 결정을 채택하였다. 제3조에 대한 국제적 조화 과정 감시를 위한 절차, 제4조에 대한 동등성 조항의 이행에 대한 결정, 제7조의 투명성 의무 이행을 위한 권고 절차가 이에 해당한다. 더불어 2회에 걸쳐 협정 이행에 대한 검토가 이루어졌고, 이 논문에서 다루어진 세 조항에 대한 검토가 포함되어 논의에 포함하였다. 판례와 SPS 위원회의 논의 및 결정 분석을 통하여 협정의 해석 및 논의 동향을 검토한 후, 향후 논의 방향과 협정 이행을 위한 정책 방안을 제시한다. 이를 통해 WTO SPS 협정에 대한 이해를 높이고 협정의 준수와 활용을 통하여 국민보건을 증진할 수 있기를 기대한다.;This paper examines the harmonization, equivalence and transparency provision of the WTO SPS Agreement. With the economic development, people now concern more on the well-being of one's life. The WTO SPS Agreement covers the measures on sanitary which is directly related to the health of human, animals and plants. Once the issue related to the SPS measures is raised, it can generate public fear of the health safety as we have experienced from the chaos caused by Korea-US Beef Protocol. Due to the nature of the SPS measure, its relation to the human's life, preventing the future dispute is more crucial to the dispute settlement. Therefore, it is necessary to understand the WTO SPS Agreement and measures in relation, and try to prevent dispute in advance. The provisions on the harmonization, equivalence and transparency are not the most frequent provisions that are referred on the dispute but carry great importance for the implementation of the Agreement. The SPS Committee has adopted Decisions on the provisions mentioned above. It has adopted the Procedure to Monitor the Process of the International Harmonization (Article 3), Decision on the Implementation of Article 4 of the Agreement on the Application of Sanitary and Phytosanitary Measures and Recommended Procedures for Implementing the Transparency Obligations of the SPS Agreement (Article 7). This paper examines the WTO Dispute cases that were raised in relation to the three provisions, mostly on the Article 3. In addition, it further analyzes the Decisions and two Reviews on the implementation of the SPS Agreement by the SPS Committee, in order to understand ongoing discussion of the provisions and further seek the aspects that need to be worked on. By understanding and implementing the SPS Agreement provisions on the harmonization, equivalence and transparency, countries can trust on the SPS measures of other Members, which will help prevent disputes and promote trade. Furthermore, The government's effort to inform the public of the SPS Agreement and SPS measures of other Members would help raise the condition of the people's health in the future.
