물레방아를 위한 慣行水利權

Abstract

Korean farmers have been farming through irrigation as well as operating water-mills to mill cereals. Water-mill owners still use water which is common property to operate their water-mills. The right to utilize this water for water-mills is recognized as customary in the customary law. Intrinsically it is an independent real right according to private rights. The customary right to utilize this water for water-mills comes into existence, as the custom of actual utilization of water is given by social acknowledgment. Water can normally be utilized by an individual, by people who share the right of irrigation in the busy farming season, but water utilization is usually conceded to others in the dry season. This water-right is an aspect of the right of utilization of water for industrial purpose. It sometimes conflicts with the right of utilization of water for irrigation. In this point of view, resolving the differences that arise when these two different rights conflict is a problem that must be dealt with to regulate the rights of water utilization.;우리나라에서는 오래 전부터 물을 利用하여 農事를 지어왔을 뿐만 아니라, 또한 물의 힘(水力)을 利用하여 물레방아를 돌림으로써 動力을 얻고, 그로써 穀物의 搗精 등을 해왔다. 그러므로 물레방아를 經營하는 者는 公水로부터 물을 引水하여 그 水力을 利用하여 물레방아를 돌리게 되는데, 이 물을 利用하는 것이 法律上 權利로 認定될 수 있을 것인가? 또 認定된다면 어떠한 性質의, 어떠한 內容 및 效力을 갖는 것인가, 또한 그 成立要件은 무엇인가 하는 점이 問題된다. 물레방아를 위한 慣行水利權의 性質에 관하여는 公權說의 反論이 있기는 하지만, 私權으로 보는 것이 妥當할 것이며, 私權중에서도 物權의 性質을 가진다고 하여야 할 것이다. 물레방아를 위한 慣行水利權을 慣習法上 成立하는 物權으로 봄으로써, 물레방아를 위한 慣行水利權이 成立하려면, 물레방아를 위하여 河川 등에서 물을 引水해온 慣行이 存在하여야 하고, 그에 대한 社會的 承認이 있어야 하며, 現實的으로 具體的인 물의 利用이 있어야 한다고 생각한다. 물레방아를 위한 慣行水利權의 內容 및 效力은 일정한 것은 아니며, 單獨使用의 경우와 共同使用의 경우에 그 差異가 있으며, 單獨使用의 경우에는 물을 優先的으로 使用할 수 있는 點 등에서는 灌漑水利權에 있어서와 類以하지만, 물레방아를 위한 慣行水利權의 경우에는 대개 小河川에서 小規模의 洑를 利用하며, 水利團體와 별로 關聯이 없으며, 旱魃時 물을 논에 讓步하기도 한다는 點 등에서 그 內容 및 效力에 있어서도 特色을 이루고 있다.
