韓國 法律學關係 參考資料에 關한 考察

Abstract

化學者와 物理學者에게 實驗室, 動物學者에게 自然史博物館, 植物學者에게 植 物園이 그 學問의 硏究上 重要性을 지니듯, 法律硏究者에게는 法律圖書館이 필수불가결한 作業場이다. 이처럼 法律硏究上 없어서는 안될 硏究施設이므로, 法律圖書館은 硏究作業의 進行을 원활하게 하기 위한 參考圖書館的 性質을 지니게 된다. 따라서 法律圖書館은 法律의 內容이 무엇인가를 發見·理解하며 適用하기 위한 必須的 도주인 各種資料,즉 法律을 記錄하고 說明, 批判, 評價한 資料인 法律學關係 參考資料를 充分히 갖추고 있어야 한다. 뿐만 아니라 이러한 資料들을 活用하여 利用者들에게 적극적으로 參考奉仕를 할 수 있는 法律司書가 반드시 있어야 한다. 이밖에 司書의 限定된 時間을 보다 效率的으로 活用할 수 있는 方案 역시 강구되어 있어야 한다. 一般圖書館과 獨立된 專門的인 特殊圖書館으로서, 이와같은 諸 要素를 구비한 法律圖書館이 우리나라에서는 아직 별로 눈에 뜨이지 않고 있다. 즉 法律關係機關에 附設된 圖書室이 있기는 하나, 外國의 參考資料는 물론이고 國內에서 出版된 參考資料조차 충분히 구비한 圖書館이 별로 없고, 法律에 관한 專門知識을 지니지 않은 一般司書가 法律參考奉仕를 擔當하고 있는 경우가 허다하다. 또한 法學敎育制度와 司法試驗制度의 非合理的 運營으로 因하여 法律硏究方法을 터득하지 못한 채 學校門을 나와, 圖書館의 利用 내지는 圖書館資料의 利用方法에 관한 敎育의 기회를 부여받지 못하는 例가 흔하다. 우리나라의 法律界가 直面한 圖書館關係 問題點의 解決에 조금이라도 보탬이 되도록 法律關係參考資料에 관한 案內香를 마련하고자 하는 것이 이 論文의 의도이다. 따라서 論文의 範圍는 解放以後 오늘날까지 國內에서 出版된 各種 參考資料를 類型別로 나누어 收錄하고 있으며 구체적으로는 書誌類, 辭典·事典·書式集·人名辭典, 註釋書, 便覽, 統計, 法令集, 法令解釋質疑應答集·例規集, 條約集, 國會會議錄, 官報·公報, 判例集, 決定集, 逐次刊行物등 13種의 類型으로 나누었다. 類似한 性質의 資料를 한곳에 모아 各類型의 資料가 공통적으로 지니는 一般的 性質, 法律的 性質 및 法律硏究上 차지하는 位置등 一般的인 面을 우선 槪觀하였다. 다음에 그 類型에 속하는 具體的인 資料의 檢索을 위하여 용도별로 그에 속하는 資料를 소개하였고, 가장 代表的·包括的인 資料에대해서는 資料의 利用方法을 案內할 수 있도록 收錄範圍, 收錄方法등을 紹介하고 그 資料가 지년 長短點도 때에 따라 批判的으로 指摘하였다. 나머지 資料에 대해서는 單純히 書誌事項만을 소개하여 特定資料의 利用에 도움이 되도록 하였다. 이와같이 本 論文은 法科大學學生, 法律學者, 實務家 및 一般司書들의 法律關係 參考資料의 利用에 도움을 줄 수 있도록 實用書誌의 作成을 모색하였다. 오늘날 文敎部가 高等敎育改善方案의 하나로서 大學校에 系列化敎育, 學點引下와 동시에 課題物을 통한 學習方法의 重視, 卒業論文의 義務化를 實施함으로써 圖書館資料의 利用이 倍加될 것이 예상되므로 이와같은 形態의 資料案內書가 특히 要請된다고 하겠다.;The law library is the essential workshop to legal researcher, as the laboratory is to the chemists and physicists, the museum of natural history to the zoologists, the botanical garden to the botanists. So the law library is basically a reference library that facilitates legal inquiries. Therefore, the law library must be stocked with sufficient reference materials which serve as tools to find, understand and use relevant legal information. These materials may be classified into records, interpretation, critiques and evaluations about law. It is necessary for the law librarian to furnish effective reference service to the library users. Besides, the limited time available to librarians must be used efficiently for all clienteles who come to the library. In Korea, we can hardly find the law library as a special library satisfying all the above mentioned requirements. There are a number of libraries attached to the legal institutions, but even those do not sufficiently hold the legal reference materials published outside and inside the country. In these libraries, it is common that the library work of legal nature is not done by the law librarian possessing the subject knowledge Moreover, most of law school graduates in Korea receive insufficient training about the method of legal research. Thus, many persons engaging in judiciary professions are not familiar with the use of the law library and its materials. The purpose of this thesis is to make a guidebook helpful in solving the problems for the law library users. All the legal reference materials published in Korea since 1945 to date are included. These materials are divided into 13 categories, namely, bibliographies, dictionaries, encyclopedias, form books, biographical dictionaries, commentaries, manuals, statistics, statute books, Attorney General's opinions, administrative rulings, treaties, the National Assembly records, official gazettes and reports, judicial reports, dicisions and serial publications. These materials are presented and explained in the beginning and then followed by specific titles. Evaluative comments are made on representative titles for the usefulness on the part of the users. The remainder covers bibliographical informations. This thesis purports to be a practical legal bibliography which facilitates the use of legal materials for the law students, legal researchers, lawyers and librarians in charge of legal collections. Recently, the country's educational policy has been so shifted as to broaden the scope of the college training, to reduce the number of credit points, and to improve the method of teaching. As part of its process the submission of thesis is recuired for college graduation. The great increase in the use of library materials is expected and therefore this type of guidebook may prove its usefulness as a basic reference and research tool.
