土地利用權에 관한 法理와 그實態

Abstract

무릇 사람의 生活關係란 直接 또는 間接으로 土地를 利用하지 않고는 이루어질 수 없다. 그런데 土地를 利用하는 法的手段으로서 가장 基本的인 것은 所有權을 取得하여 利用하는 것이다. 그러나 土地의 限定性으로 인하여, 土地利用을 願하는 者가 모두 土地를 所有할 수는 없다. 여기에서 土地를 所有하지 않는 者가 土地를 利用할 수 있는 法的手段을 講究할 必要가 생기게 된다. 이와 같은 土地利用權으로서는 賃借權과 같은 債權에 의하여 目的物을 利用하는 이른바 債權的利用權과 目的物을 排他的으로 直接 利用하는 이른바 物權的利用權이 있다. 그 中 物權的利用權이 곧 民法上의 用益物權이다. 本論文에서는 먼저 第2章에서 土地利用權의 强化傾向과 그에 關한 外國의 立法例를 살펴 본 후, 第3章에서 土地利用制度 중에서도 특히 地上權 地役權에 관한 法理論을 고찰하였다. 그리고 난 다음 第4章에서는 「他人의 土地에 建物 其他 工作物이나 樹木을 所有하기 위하여 그 土地를 使用하는 權利(第279條)」인 地上權을 調査하여 그 活用實態를 알아보고자 하였다. 마지막으로 結論部分에서는 第4章에서 나타난 地上權의 活用實態를 基礎로 하여 앞으로의 土地利用權에 대한 立法論을 提示하였다.;It can be said that human life cannot be led anywhere without the utilization of land, directly or indirectly. One of the most fundamental legal means for the use of land may be acquisition of ownership of land. But due to the characteristics of limitation of land, land cannot be owned by all who want to do. This particularity necessitates to provide a legal means for the use of land by those who do not own their land. This land utilization right involves what is called obligatory utilization that uses an object by an obligation such as the right of lease,and what is referred to as utilization by the Real Right directly using an object exclusively. This utilization by the real right is involved in the Real Right o n the Civil Law. Mention is made in Chapter Ⅱ of the intensifying tendency of land utilization and its legislative cases in foreign countries; in Chapter Ⅲ, of theories of law on Superficies and Easement in land utilization system. And Chapter Ⅳ, based on superficies, that is the right of utilization of land(Art. 279, the Civil Law) for a person to own building, structure or tree on another person's land, scans actual conditions of superficies registered on the Register Book to see how this system has served practically. Finally, conclusion suggests the theory of legislation for the land utilization for the future on the basis of the given actual condition of Superficies shown in Chapter Ⅳ.
