Abstract
本稿는 朝鮮 世宗代의 刑政을 判制度를 中心으로 다루어 보았다. 當時 京中에 本然의 同法機關인 刑曹가 있었음은 勿論 漢城府·義禁府(또는 司憲府) 等 三法司와 다시 刑曹·漢城府 및 都官이 詞訟衙門으로서 存在하고 있었다. 는 事實은 司法系統이 無秩序하였던것 같이 보인다. 그러나 王朝時代에 있어서의 三權의 未分化, 判決의 確定力에 對한 觀念의 稀薄性 또는 儒敎社會에 特有한 相避制度 및 强力한 전專制王權 等을 認識하고 나서 이 같은 諸法司의 成立가 職能의 변천을 檢討하여 보면, 그들의 職能이 無秩序한 것만은 아님을 알 수 있다. 卽 京中에서의 一般裁判은 그 性質에 따라 奴卑의 良□分□을 主로 한 訴訟은 形曹屬衙門인 都官에서 專擔하고, 田宇訴訟은 漢城府에서, 그外의 一般訴訟은 刑曹에서 各各 最小限의 分學原則을 가지고 行하였음이 밝혀진다. 義禁府에서의 王命에 依한 謀叛 및 其他 綱常罪에 對한 特別裁을 除外한 一般義判은 「實錄」內의 諸法典 引用 記事에서 審級制度의 規定이 會謂되는 바와 같이 司憲府에 上訴할 수 있고, 다시 申聞鼓에 依한 申星을 할 수 있었다. 그러나 該當官使가 遞代된 뒤에나 訴狀을 提出하게끔 되어 있는 星訴法의 繁端 때문에 司憲府에의 上訴는 活用되지 못하였고, 代身 載訴하여 擊鼓에 依한 申星을 하는 事例가 頻□하였다. 따라서 大部分의 官吏들은 이같은 □鼓事例를 禁하기를 數次 請하기도 하였으나 世宗의 配慮로 □鼓의 自由는 許用되어 있어 身分階級에 구애됨이 없이 自己訴寃을 할 수 있었는데 中外의 死因에 대한 三履은 一律的으로 刑曹에서 相考한 後 國王이 親決함으로써 人命을 重要視했던 것과는 달리 申聞鼓에 의한 曲直 分□은 大部分이 承政院에서 處理되었다. 訴訟에 있어 被告가 他地方에 있는 境通에는 元告가 그 地方으로 가서 裁判을 받도록 되어 있었으며, 判決은 原則的으로 正郞以下 3人 以上의 官員만 갖추게 되면 내려지게 되어 있엇으나 各 法司마다 增習上 조금씩 다르게 施行하였다. 그리고 農繁期에는 地方에서의 雜訟을 停正하였음은 農本國家로서의 性格을 보여주는 것이었다. 世宗은 百姓들에게 「大明作」等의 律文을 가르치게 하여 儒敎的인 立場에서 犯罪 및 爭訟을 미리 防止하는 것을 基本政策으로 하였다. 裁判節次上에 있어서는 判決이 遲滯되는 事例가 많았는데 그 理由로서는 行政과 司法事務가 分離되지 않았음을 根本的 要因으로 들 수 있다. 決訟官들의 資質과 品性을 重要視하여 私情에 치우치지 않은 判決을 하도록 하였고, 그들 自身도 審理의 愼重性을 期하였다. 地方에 있어서의 判決은 學食과 監司가 直接 行하도록 求되었으며 實際로도 履行되었던 것 같다. 이와 같이 世宗代의 裁判制度는 太宗年間에 具備된 制度를 根幹으로 하여 裁判過程과 基他 處罰에 있어 人道主義 政策이 많은 作用을 한 比較的이고 進一步된 面을 보여주고 있다.;This study, being based on the machinery of law, aims at, inquiring into the penal administration of King Se Jong period in Yi Dynasty. The legal system of that period comparises not merely Hyeong Jo(形曹) a judicial institution in Han Seong (漢城) but three main trial courts - Han Seong Bu (漢城府) Eui Geom Bu (義禁府) or Sa Heon Bu (司憲府) In addition to them Hyeong Jo, Han Seong Bu and Do Gwan (都官)are also funcitioned as courts of justice. A glimpse of these indicates that the judicial machinery of that period was somewhat confused. But a careful analysis of incomplete separation of the three powers, obscure concept on accuracy of judgement, Sang Pi (相避) system in a Confucian society and powerful absolutism may yield a suggestion that the legal system was not in chaos. For the general trials in the capital city, lawsuits for identifying the middle class and slave class were conducted at Do Gwan, a judicial institute of Hyeong Jo, lawsuits for estate and messuage at Han Seong Bu and the other legal proceedings at Hyeong Jo, respectively, with their own unique sphere. Except for special trials for rebellion, sin of morals(綱常罪) conducted by King's request, general legal proceedings were appeal to Sa Heon Bu and further to Sin Mun Go (申聞鼓) as shown in stipulations of codes from records of the dynasty. But an appeal to Sa Heon Bu was not widely used since a petition could be presented only after the official in charge was replaced. In stead, direct appeal to Sin Mun Go skipping Sa Heon Bu was frequently used. Accordingly most of public officials asked to close this Kyeok Go (擊鼓) procedure, which was made available in all classes owing to King Se Jong's measures. Any one who was unjustly being suspected of a guilt could utilize the Kyeok Go,. Condemned criminals throughout the country were minutely reexamined at Hyeong Jo being based on three-trial system, thus having final judgment by the king. In a lawsuit, if a defendent being in a local district, the judgment was conducted at the place. Though a final judgment could be made if more than three officials of Jong Rang (正郞) class level, the proceedings varied with courts. And suspension of all proceedings in the busy farming season is characterised by physiocracy. By the order of King Se Jong, the public officials taught the people such commandments as Dae Myung Yul (大明律) for keeping from committing a crime, which, was the King's basic policy, while almost all the judgments by Sin Mun Go were exclusively treated in Seung Jeung Won (承政院). In a judicial procedure, delay in judgment occasionally occured, because administration and judicature was not obviously separated. Keen considerations were rendered to putting priority to the quality of officials in charge and the personality, thus leading a right and correct judgment, and they carried out investigations with prudence. Local judgmento were forwarded to be implemented mainly by Soo Ryeong (守令) and Gam Sa (監司) It seems that a lot of cases were practically done so. It is shown that judicial proceedings under King Se Jong had a firm foundation on those previously established under Tae Jong (太宗) period, and had outstanding characteristics of humanism, realism in penalty and the proceeding itself, thus contributing to the advancement of judicial arena.
