戰國末 秦國의 「家」에 對한 硏究

Abstract

「家」에 대한 연구는 그 사회구조의 특질을 해명하는 하나의 실마 리로서 매우 중요한 과제이다. 中國 古代의 「家」에 대한 연구는 中國 의 사회구조와 전동문화의 틀이 새롭게 형성되는 春秋·戰國時代 및 秦·漢時代가 그 대상이 된다. 그러나 사료상의 한계로 이제까지의 연 구가 漢代에 집중되어 있어 이전 시대에 대한 연구는 실증사료의 부족 으로 가설정도에 머무르고 있는 실정이다. 1975년 12월 湖北省 雲夢縣 睡虎地에서 발굴된 秦基竹簡 (이하 「睡簡」으로 약칭 ) 의 출현으로 戰國時代 末期 秦國의 家에 대한 해명 작업이 진행되었다. 그러나 사료 해독 및 그 시대 사회구조에 대한 다 양한 견해에 따라 의견이 갈리고, 대체로 연구가 단편적 분산적인 경 향을 띠고 있어 家의 실체에 접근하기에는 미흡한 면이 있다. 본 연구는 『睡簡』에 나타나는 제 사례를 통하여 戰國時代 末期 (B.C. 3世紀末) 秦國의 家의 실체에 접근하고자 하는 시도이다. 이에 Ⅱ장에서는 「家」의 법적 단위 인 '戶' '同居'·'室人'의 개념분석을 시도하였다. 이에 따라 戶는 家의 국가파악 단위로, 同居는 家의 실제 가족구성원이며, 室人은 실제 거주공간에 의한 가족구성원으로 정의하 였다 Ⅲ장에서는 가옥구조 및 가족형태를 통하여 일반적 家의 형태를 고찰하였다. 이에 의하면 당시 평민의 가옥은 '1宇 2內'의 소형 가옥 구조이며, 일반적 가족형태는 夫·妻·子의 單婚家族 형태를 이룬다. Ⅳ장은 秦國의 통치구조인 編戶齋民體制 하에서 토지정책과 각종 징수 정책을 통하여 家의 기능을 고찰하였다. 이에 따르면, 1家당 1頃의 토 지를 분급하는 토지정책에 의해 家는 授田의 대상으로 그에 따른 조세납부의 의무를 지닌다. 또한 요역·兵役·戶賦의 징수 단위로 기능 한다. 그리고 1頃의 토지를 授田받는 1家의 구성 인편은 1頃의 생산량 에 의해 평균 5人정도라는 것을 알 수 있다. 따라서 編戶齋民體制의 통치구조에서 戶籍에 등재·파악된 民은 家를 단위로서 국가의 지배구조에 편입되었다고 할 수 있다. 그리고 夫·妻·子 5人으로 구성된 家의 기능은 授田의 대상이며 그에 따른 조세 납부 및 각종 징수의 대상 단위로서 작용하며 秦國은 이를 기반 으로 통일의 기틀을 마련하였다고 할 수 있다.;Many scholars have regarded the house-hold as the most important factor in determining the social-structure characteristics. The study of the the house-hold of ancient China focused on the Ch'in-Han Period as well as the Spring and Autumn Warring States Period, which were the newly formed structure of society and traditional culture of China. Many studies have been concentrated on the Han period, but studies on former times tend to be limited to only hypothesis because of the lack of documents. The Shui Bamboo-Slip-Documents were unearthed in Shuihudi Yu¨n -mong hsien Hupei in December, 1975, and as a result the house-hold of the ch'in Kingdom at the end of Warring States Period has been researching this base. However, there are various opinions which are divided due to the different views of the social structure as well as the discriminating interpretations of the document. Since opinions are fragmentary and divided, the study on the essence of a house-hold leaves more to be desired. Through many cases of the Ch'in Bamboo-Slip-Documents, I have tried to approch this study on the essence of a house-hold of the Ch'in Kingdom at the end of the Warring States. In Chapter Ⅱ, Ⅰ attempt to analyze the concepts of the house-hold(戶), the family (同居), and the living-together(室人) as the legal unit of a house-hold. Moreover, they could be defined as follows: A house-hold understood by the state as a house: a family is made up by the members of the house-hold: living-together is defined as members of a house-hold that are currently at the real residence. In Chapter Ⅲ, I study the form of the house-hold through the construction of the house as well as its family structure. On this base, a commoner's house in those days was constituted as a small-sized house of two rooms(一字二內) and the general family form was small, constituted by a husband, a wife and children. In Chapter Ⅳ, I analyze the function of a house-hold through the land policy and various tax policies under the state control in the Ch'in Kingdom. According to that. under the land policy, the state divided the land by one ching(1頃) a house-hold, the house-hold became the object of land dividing and thus, family was forced to pay tax. Also the house-hold served as a tax unit of a labour service, a military service, and a house-hold tax. The house-hold was made up of 5 members on average. Therefore under the ruling system of pien-hu-ch'i-min(編 戶齊民), the Ch'in Kingdom could form the foundation of unity on the house-hold.
