한미 FTA 조세 관련 조항에 관한 연구

Abstract

WTO 다자무역체제를 지향하던 우리나라는 IMF 경제위기 이후 2002년 한-칠레 자유무역협정(Free Treade Agreement : FTA)을 체결한 것을 시작으로 FTA에 적극적인 입장을 취하고 있다. 경제통합의 하나인 자유무역협정은 자유로운 상품거래와 교류의 원활화를 위해 관세 등의 무역보호 장벽을 철폐하는 형태이다. 자국의 취약산업을 더욱 취약하게 만드는 부정적 영향을 끼침에도 국가 간 사람과 자본의 이동을 촉진하는 긍정적 역할로 인하여 전세계적으로 자유무역협정의 체결이 가속화되고 있다. 현재까지 통상 측면에서의 자유무역협정에 관한 연구는 활발히 이루어져 왔으나, 조세에 관한 연구는 거의 이루어지지 않아 왔다. 따라서 이 논문에서는 자유무역협정문에 규정되어 있는 조세 관련 규정을 중심으로 하여 연구하였다. 기체결된 한·칠레 자유무역협정문, 한·싱가포르 자유무역협정문, 한·EFTA 자유무역협정문 및 이번에 타결된 한-미 자유무역협정문에 나타난 조세조항의 비교분석을 통하여 형식상, 내용상의 차이에 대하여 알아보았다. 또한 한-미 자유무역협정문에 나타난 특별 규정들-배기량 기준 세제 관련 조항 및 과세 및 수용에 관한 부속서 등의 분석을 통하여 한미 FTA 협정문의 특징에 대해서도 살펴보았다. 이외에도 자유무역협정의 체결 후 더욱 활발해지는 자본과 사람의 이동을 통해 주식과 부동산의 양도 차익에 대한 실무적 문제를 어떻게 해결해 나가야 하는지에 대한 해결방안의 모색을 이 논문의 연구목적으로 하고 분석하였다.;Korea that aimed at WTO(World Trade Organization) has had the positive policy about FTA(Free Trade Agreement) after the 1997-1998 financial crisis. At first, Korea and the Republic of Chile signed FTA in 2002. One type of Economy Communities is FTA that is for trading freely. Whereas FTA has the side effect like making own weak industry weaker, it has the advantage to move man and money harmoniously all over the world. From now, a lot of papers and theses mainly concentrated on international trade law concerned with FTA. It's very the time to begin a discussion about taxation concerned with FTA. Therefore, I prepared to study taxation about Korea-U.S. This thesis analyzed and made a comparative study of taxation Korea-Chile FTA, Korea-Singapore FTA, Korea-EFTA FTA and Korea-U.S. FTA. There are special provisions such as engine displacement taxes and annex about taxation and expropriation in KORUS FTA. Besides this paper contributes to substantial matters how to solve capital gains concerned with stock and real estate through the faster movement of man and money freely.
