政黨 內部秩序 民主化에 관한 硏究

Abstract

오늘날 대부분의 國家에서는 政黨을 인정할 뿐만 아니라 그 地位를 憲法的 次元으로 格上시키고 있다. 이것은 정당이 국가운영에 있어서 필수불가결한 존재임을 보여주는 것이다. 정당의 役割에는 여러가지가 있지만 國民의 無定型의 政治的 意思를 豫備形成하여 이것을 國家政策이나 立法의 形態로 나타나게 하며 民主國家의 政治內容을 정당화시키는 것을 주된 任務로 한다. 이러한 政黨의 任務를 제대로 수행하기 위해서는 우선 그 전제조건으로 정당내부질서의 民主化가 이루어져야 한다. 그러나 政黨內部秩序가 민주화되기란 그리 쉬운 일이 아니다. 오늘날처럼 社會가 分化되고 국민들의 要求가 多樣해진 경우에 이들의 요구에 따른 결과를 산출해 내려면 정당은 조직의 능률성을 확보해야 하기 때문에 소수 지도자의 支配權을 강화시키게 되며 B.Michels가 지적한 것처럼 政黨은 組織의 屬性上 寡頭化 경향을 갖기 때문에 이를 배제시키는 노력이 항상 필요 하다 할 것이다. 특히 우리나라처럼 유교문화국가로서 權威主義的 屬性을 가지고 있고 정당제도가 제대로 정착되지 못한 경우에는 더욱 이에 대한 관심과 주의가 필요하다할 것이다. 政黨內部秩序의 民主化를 실현함에 있어서 아주 중요한 위치를 차지하는 것중의 하나가 候補者公薦問題이다. 오늘날의 大衆民主主義에 있어서 政黨은 選擧와 議會를 완전히 좌우하고 있고 또한 選擧에 있어서 候補者는 자기 個人의 政治的 能力이나 努力에 의해서가 아니라 政黨의 所屬여하에 따라 거의 當遷이 決定되는 것이 오늘날의 추세이다. 그러므로 公薦은 政黨內部의 政治行使에 머무르는 것이 아니라 黨內民主主義와 나아가 전체국가의 民主主義의 정도를 가늠할 수 있는 징표라 할 수 있을 것이다. 따라서 국가의 民主主義 실현을 위해서는 정당내부질서의 민주화와 그 중에서도 특히 公薦의 民主化가 이루어져야만 할 것이다. 그러므로 本論文에서는 政黨內部秩序의 民主化와 그 중에서도 候補者公薦문제를 중심으로 하여 살펴보았다. 논문의 구성은 現代民主主義에서 政黨이 차지하는 중요성에 비추어 인정되는 憲法上의 地位를 살펴보고 다음으로 政黨의 憲法上의 지위에 의해 必然的으로 요구되는 政黨內部秩序의 民主化를 살펴보았다. 그리고 政黨內部秩序 民主化의 실현 방안중 가장 중요한 것이라 할 수 있는 候補者公薦에 있어서 절차와 그 운영의 慣行을 살펴보고 마지막으로 그 문제점을 지적하고 그 解決方案을 나름대로 제시해 보았다.;In the present, It is the function and role of political party that it gathers people's political opinions and make them reflect politics and law-making. In other words, political party links people and nation. First of all, it must accomplish democracy in inner-organization of political party so that the function and role of political party should be made to fullfill well In practice, it is not easy to democratize organization and operation of political party because political party tends to be oligarchical. Characteristics of organization, as R.Micjels has spoken, and citizen's various demands in modern society cause political party to become oligarchical . However organizational democracy in political party must be confirmed because it is pre-condition of realization of democracy when the position of political party is considered in modern state. It means death of democracy that the inner-organization of political party is not democtatic. Particularly, the nominating(candidats selecting) process has become the crucial process of the party. The nature of the nominating process determines the nature of party: he who can make nominations because the owner of the party. This is therefore one of the best points at which to observe the distribution of power within the party. So, in this treatise, organizational democracy in political party, particularly concentrated on candidate selecting procedure, is studied in relation to provisions and habitual practice. In chapter Ⅱ, not only the relations between democravy and political party, but also the concept and the function of the party is studied. Lately the status which the constitution has endowed political party with is looked into. In chapter Ⅲ, the reasons why the inner organization of political party must be democrtic and the doctrines of organizational democracy is studied. In chapter Ⅳ, the methods which are democratic in nominating candidates is studied. Foreign candidate selecting procedure is introduced in a standpoint of comparative analysis and The poblems of nominating process in our country is indicated. In conclusion, the devices to solve the problems is referred.
