Abstract
본 연구는 고등학교 청소년의 일탈 행동에 대한 차별적 처벌과 처벌의 결과로 일어나는 낙인의 과정에 대해서 알아보았다. 우선, 일반적인 비행의 경향을 알아보고 그대 대한 학생들의 인식을 알아보았다. 그리고 처벌이 차별적으로 이루어지는지 여부를 알아보고, 처벌에 영향을 미치는 요인이 무엇인지 알아보고자 한다. 세 번째로 학생들이 자신이 받은 처벌에 대해서 공정하다고 생각하는지, 불공정하다고 생각하는지 여부를 알아보고 처벌의 기준이 무엇인지를 알아보고자 하였다. 네 번째로 처벌로 인해서 자신이 문제아라고 생각하는지 여부를 파악하고자 하였다. 마지막으로 처벌 이후에 일탈 행동이 줄어들었는지, 늘어났는지 여부를 알아보고자 하였다. 이 모든 단계를 설문지를 통하여 조사하고 그 결과를 중다회귀분석을 하였다. 조사는 1072명의 고등학교 2학년 학생들을 대상으로 질문지 조사를 하였다. 그 결과를 요약하자면, 음주, 노래방, 당구장 출입과 비디오방, 음란 서적, 음란 비디오 관람과 같은 비행은 전체의 과반수 이상의 학생들이 경험한 것으로 나타났고, 비행을 한번도 경험하지 않은 학생이 3.9%에 불과한 것으로 나타났다. 각각의 비행 경험에 대해서 처벌 여부와 처벌 정도를 비교하면 그 처벌이 학생들의 비행 정도와 발각 횟수, 부모님의 선생님 방문 횟수, 학업 성적에 영향을 받는다는 것을 알 수 있다. 처벌이 공정하다고 느끼는지 여부는 친구들의 영향력이 클수록, 그리고 남학생보다 여학생이 더 처벌이 불공정하다고 인식하는 것으로 나타났다. 그리고, 선생님과의 친밀도가 좋을수록, 그리고 발각된 횟수가 많을수록 더 처벌이 공정하게 느끼는 것으로 나타났다. 처벌의 기준이 무엇이라고 생각하느냐는 질문에 자신이 한 나쁜 행동의 정도, 선생님의 당시 기분, 학업성적이 가장 중요한 것으로 나타나서 학업 성적이 학생이 가진 중요한 자원이라는 것을 다시 한 번 입증해주었다. 낙인의 효과에 대해서 알아보면 가장 유의미한 영향을 미치는 것은 처벌이 공정하다고 생각하는지 여부였다. 선생님께 문제아라고 인식되는 원인이 무엇이라고 생각하느냐는 질문에 대해서는 학업 성적과 친구들, 나의 나쁜 행동이 주요 원인으로 나타났다. 이 결과는 처벌의 기준이나 처벌에 영향을 미치는 요인과 비슷하다고 볼 수도 있지만, 특이한 것은 '나의 친구들'에 의해서 내가 낙인을 받을 수도 있다고 학생들이 생각하는 것이다. 낙인을 받은 이후 행동이 변화하였는지 여부에 대한 질문에도 처벌의 공정성 인식이 매우 중요한 영향을 미치는 변인으로 나타났고 친구들의 영향력과 성별이 중요한 변수로 나타났다. 본 연구에서는 우선, 학교에서 청소년 일탈에 대해 차별적인 처벌이 이루어지고 있다고 믿는 학생들이 많이 있고, 처벌의 공정성에 대한 주관적 인식이 청소년들의 처벌 후 행동에 영향을 미친다는 것을 보여줄 수 있었다는 점에서 의의를 찾을 수 있다. 처벌에 비행의 정도와 발각 횟수가 영향을 미치는 요인으로 나타나기는 하였지만, 학생들이 가지고 있는 자원으로 학업 성적이 차별적인 처벌에 중요한 영향을 미치는 요인으로 나타났다. 두 번째로, '처벌의 공정성 인식'에 대한 것이다. 처벌의 공정성은 처벌이 공정한가 그렇지 않은가에 대한 인식일 뿐 아니라, 낙인 인식 여부, 처벌 이후의 행동 변화에도 모두 유의미한 차이를 보이는 것으로 나타났다. 낙인론에서 처벌을 받을수록 행동이 점차로 나빠져서 일탈자로 전락하게 된다고 주장하고 있다. 그러나, 본 연구에서는 미약하지만 처벌을 받을수록 행동이 긍정적인 방향으로 변화하는 것을 보여주고 있다. 이는 아직까지 우리 나라 교육에서 처벌이 제기능을 발휘하고 있다는 것을 나타낸다고 볼 수 있다. 본 연구의 결과를 바탕으로 하여 우선 일탈에 대한 개념의 재정립이 필요하다고 보여진다. 거의 대다수의 학생들의 행하고 있는 것을 모두 일탈이라고 규정하는 것은 오히려 처벌의 기준을 흐리는 것과 같기 때문이다. 두 번째로 처벌이 보다 공정한 기준을 가지고 이루어져야 한다는 것을 알 수 있다. 그리고, 처벌의 공정성 인식이 각 단계에서 매우 중요한 요인으로 나타난 것으로 보아 학생들이 납득할만한 공정성을 가지고 처벌이 이루어 져야 하며, 공정한 처벌이 이루어질 때 비로소 처벌이 제 기능을 발휘할 수 있다는 것을 알 수 있었다는 점을 제시함으로써 보다 효과적인 처벌의 방향을 제시하는데 기여할 수 있으리라고 본다.;This study pertains to the practice of discriminatory punishment in high school and the process of labeling due to such a practice. First, the study examines the general trend in high school student's deviant activities and their perceptions of deviance and delinquency. Second, it addresses the question of whether or not the punishments given to students are, in fact, dscriminating and if so, what are the factors that contribute to discriminatory punishments. Third, the study inquires into whether or not the students view the school punishments to be fair and just, and what they consider to be the basis or standards of punishments. Fourth, it attempts to understand if student's consider themselves to be a deviant or a delinquent as the result of the punishment received, and finally, whether their deviant activities have increased or decreased after having received the punishment. The necessary data of this study were collected through questionnaires and it was analyzed by statistical methods of frequency distribution, reliability, factor analysis, multiple regression, etc. The selected respondents of questionnaire were 1200 sophomores in high school. The main findings are as follows; Most of students have had the experience of going to drinking joints and karaoke bars, reading or watching pornographic materials, smoking and etc, which are considered to be deviant behaviors. Only 3.7 percent of the students have answered as never having had such an experience. By scrutinizing the austerity of the punishment and the deviant activities under discussion, it can be inferred that factors such as the number of deviant activity that went noticed, the number of visits made by the parents to the teachers, students' school grades affect the sternness of the punishment. The students' perception of fair and just punishment differs depending on one's sex and on influence of friends. In simple terms, girls are generally more likely to regard a punishment given to be discrimination than boys. Also, the greater the influence of friends, the more likely it is for a student to feel that a punishment is unfair or unjust. On the other hand, the closer the student-teacher relationship, the more likely it is for a student to view the punishment as justified. Also, as the deviant activity that went noticed increases, it is more likely that a student will feel the punishment received to be fair. As to the question of what the basis or standards of punishments are, the students name deviant behavior, school grades, and the teacher's mood of the time to be most important, which suggests that school grades are an important asset to students. The main effect of the labeling is the perception of punishment received as fair. Students answered that school grades, friends, and deviant activities are some of the factors that they believe will label themselves as a delinquent in the eyes of their teachers. However, what is unique in their answers is the fact that they consider it possible to be labeled as a delinquent because of their own friends. The most important factor in bringing about a change in the student's behavior after the deviant activity is the student's perception of punishment as fair and just, as well as variables such as one's sex and influence of his/her peers. This study first, clearly indcates that many view school punishment to be discrimination and unfair and that a student's perception of the punishment received is a dominant factor in bringing about changes in student's behavior there after. The most important variable that is related to the practice of discriminatory punishment is school grades, even more so than the number of deviant activities that went noticed. Second, the study shows that the perception of fairness of the punishment affect the perception of labeling and thus, contribute in bringing changes to the student's behavior. The labeling theory maintains that deviant behavior increases after the punishment, which in reality encourages delinquency as a career. But this study contradicts such an argument and indicates that students ' deviant behavior rather decreases after receiving a fair punishment. This means that punishment does serve its rightful purpose in the Korean school system. As the results of this study suggest, revision of the definition of deviance or delinquency is necessary because its broad definition even covers some of the harmless activities and behavior of the students, which in turn blurs the standard basis for school punishments. Another point to be made is that school punishments must be practiced under an objective and fair system and criteria since students' perception of fair and just punishment proved to be important. Moreover, it is only through a fair punishment system that its positive function can be actualized.
