인공 유산에 대한 기독교 윤리적 이해

Abstract

인공 유산은 실천 생활에 있어서 제기되는 윤리 문제들 중의 하나이다. 인공 유산의 역사는 오래되었지만, 최근 들어 그 찬반 논쟁이 더욱 가열되고 있다. 그러나 이러한 논쟁들은 지금까지는 여성의 경험과 의견을 무시한 채 이루어져 온 것이 사실이다. 본 논문에서는 인공 유산의 문제를 다룸에 있어서 여성의 권리(Women's Rights)라는 측면에서 기독교 윤리적 이해를 도모하는 것을 목적으로 한다. 제 Ⅰ장 서론에서는 인공 유산의 상황이 무조건 반대할 수도 없고, 그렇다고 찬성할 수도 없는 하나의 딜레마임을 밝히고, 인공 유산에 관한 문제를 제기하며, 본 논문의 연구 방법인 기독교 사회 윤리 방법론과 진행 방식에 대하여 언급하였다. 제 Ⅱ장은 인공 유산에 대한 전반적인 이해를 도모하였다. 첫째, 인공 유산의 개념과 역사를 간단하게 살펴보았다. 둘째, 인공 유산의 윤리적 논쟁은 주로 인공 유산의 합법화를 통해 드러나게 되었음을 인식하여 각 나라들의 인공 유산에 대한 법적 허용 범위를 알아보았다. 마지막으로 인공 유산의 실태를 분석하고 우리 나라에서 독특하게 나타나는 특징으로써 성감별(性鑑別)에 의한 여아 선별 인공 유산, 가족 계획적 차원에서의 강요된 인공 유산, 성(性)의 무지(無知)와 사회적 통념 등에 의한 미혼 여성의 인공 유산, 그리고 실용주의적 물질 문화와 편의주의의 영향으로 인해 이루어지는 인공 유산 등, 4가지로 구분하여 분석하였다. 제 Ⅲ장에서는 인공 유산을 둘러싼 다양한 논쟁들에 대해서 고찰하였다. 첫째, 성서에 나타난 태아 생명의 지위와 인공 유산의 언급에 대하여 살펴보았다. 둘째, 태아의 인간성을 고찰하기 위하여 바루흐 브로디(Baruch Brody)와 다니엘 칼라한(Daniel Callahan)의 견해를 알아보았다. 셋째, 인공 유산을 반대하는 입장인 가톨릭의 견해와 간접 유산 허용의 근거가 되는 '이중 효과의 원칙'에 대해 서술하고 개신교의 근본주의적인 견해를 폴 램지(Paul Ramsey)의 입장을 고찰하였다. 찬성하는 입장으로는 여성 해방 운동의 원조격인 시몬느 드 보봐르(Simone do Beauvior)의 견해와 여성 신학자를 대표하는 비벌리 해리슨(Beverly W. Harrison)의 견해, 그리고 상황 윤리적 접근으로써 조셉 플레쳐(Joseph Fletrher)의 견해를 알아보고 비교적 절충주의적 접근을 보여주는 제임스 구스타프슨(James M. Gustafson)의 견해를 살펴보았다. 마지막으로 양극화되어 있는 인공 유산의 찬반론을 화해시키기 위한 맥코믹(Richard Mccormick)과 다니엘 칼라한(Daniel Callahan)의 지침들을 제시하여 인공 유산의 논쟁을 향상시키기 위한 시도를 하였다. 제 Ⅳ장은 인공 유산에 대한 관계적 접근을 통하여 공동체 속에서 책임적으로 인공 유산을 여성의 권리 측면에서 결단할 수 있도록 비전을 제시하였다. 또한 인공 유산의 증가를 부추기고 있는 성윤리(性倫理)의 문제점을 기독교 전통 안에서 찾아 분석하고 새로운 해결책을 모색하고자 하였다. 그리고 책임 있는 선택의 권리를 위한 제언을 하였다. 제 Ⅴ장은 본 논문의 내용을 정리하면서 논자의 인공 유산에 대한 입장을 제시하고 문헌 연구를 중심으로 하여 이론적 측면에 치우친 연구와 그 범위에 대해 언급하고, 본 논문에서 미흡한 인공 유산에 대한 기독교 윤리적 대안을 다음의 연구자들에게 부탁하면서 글을 마친다.;The artificial abortion is one of the ethical issues of our society. Although it has a long history, arguments for and against it have become a heat in the recent years. It is true that these arguments, however, have somewhat disregarded women's experiences and opinions. The purpose of this study is to contrive Christian Ethical Understanding of the Artificial Abortion as it deals with that problem in the aspect of women's right. In the first chapter, i. e., introduction, I reveal the fact that the problem of the artificial abortion is a kind of dilemma to us which we can not blindly oppose or approve, raises questions about it and mentions the Christian social, ethical methodology and methods in progress as a practical approaches for this study. In the second chapter, general understanding of the artificial abortion is sought for. First, notion and history of abortion is simply defined and investigated. Second, recognizing ethical arguments about abortion came to the surface mainly through the legalization of it that the ranges of many nations' legal allowance and Korea's peculiar abortive features categorized into four such as abortion of female fetus through sex discrimination, forced abortion on the family plan level, unmarried women's abortion due to their ignorance about sex and the common ideas of society and those abortions under the influence of practical materialized culture and opportunism, are examined and analyzed. In the third chapter, various opinions about abortion are investigated. First, status of fetus in life and abortion mentioned in the Bible is reviewed. Second, opinions of Baruch Brody and Daniel Callahan are discussed to know the fetus' humanity. Third, Catholic views opposing abortion and 'the Principle of Double Effect' as a ground of allowance of indirect abortion are described and the Protestants' fundamentalist views are investigated through Paul Ramsey 's thinking. As there has been people who approved abortion, opinions of Simone de Beauvoir the founder of feminism movement and Beverly W. Harrison a representative feminism theologist are investigated together with Joseph Fletcher's view as one of approach of 'the Situation Ethics' and James M. Gustafson's view as one of relatively eclectic approaches. And finally propositions of Richard McCormick and Daniel Callahan to negotiate extreme pros and cons of the artificial abortion are presented to get to near a solution. In the fourth chapter, a vision is presented to abortion in the aspect 'A Relational Approach' to judge it in the light of women's right and make society to take common responsibility. Also some controversial points in the sexual morality that abets the increase of abortion are discussed in the context of tradition to seek new solutions. And suggestions for responsible right of choice are made. In the fifth chapter, I presents my own view of abortion as I summarize the details mentioned above and mentions about certain limitations of theoretical studies and their ranges focused only on the literature reference, and finally makes an end of my study as I hope further studies could get over theoretical limitations and make alternative plans for understanding the artificial abortion with Christian ethcis.
