디지털도서관에서의 저작권관리 모형에 관한 연구

Abstract

본 연구에서는 디지털도서관에서의 저작권관리를 위한 모형을 구축함으로써 저작권관리의 방안을 제시하고자 하였다. 저작권관리의 모형을 수립하기 위해 먼저 문헌연구를 통해서는 디지털도서관의 정의와 특성, 디지털도서관에서 발생하는 저작권의 문제, 디지털 저작물의 저작권 보호를 위한 기술을 고찰하였다. 사례연구를 통해서는 디지털도서관 프로젝트의 일부로 저작권관리를 하고 있는 연구사례를 조사하여 저작권관리 방법의 특징을 분석하였다. 그리고 이용자가 텍스트 저작물을 이용할 때 발생하는 저작권의 문제를 해결하는 것으로 연구범위를 정하였다. 본 연구에서는 저작권관리의 모형을 구축하는 데 있어서 먼저 저작재산권, 저작 인격권, 그리고 이용자의 정보이용권을 보호할 수 있는 방안을 고려하여 기본원칙을 수립하였다. 그리고 저작권집중관리체제와 개별관리체제를 적용한 분산디지털도서관 환경에서 이용자와 저작권관리를 담당하는 기관 간에 저작권의 문제가 발생하는 관계를 규명하였다. 이를 기반으로 디지털도서관의 역할과 각각의 이용자에 따른 저작권관리 방법을 제안하였다. 이와 같이 본 연구에서 제안한 저작권관리 모형은 다음과 같은 특징을 갖는다. 첫째, 센터디지털도서관에 디지털 저작물을 등록하게 하였다. 본 모형에서 디지털 저작물을 등록한다는 것은 2가지의 의미를 갖는다. 저작권자가 저작권의 집중관리를 위해 디지털 저작물의 全文을 등록하는 것과 로컬디지털도서관이나 정보제공자가 개별관리하는 디지털 저작물의 서지정보와 저작권관리정보를 등록하는 것이다. 이를 통해 센터디지털도서관은 저작권의 집중관리체제와 개별관리하는 디지털 저작물의 소재정보체제를 구축할 수 있게 하였다. 둘째, 이용자가 센터디지털도서관에서 저작권관리정보를 참조함으로써 디지털 저작물의 전문을 이용하기 전에 이용여부를 판단할 수 있게 하였다. 셋째, 저작권관리를 위한 디지털도서관의 역할을 제시하도록 하였다. 본 모형에서는 저작권의 관리를 담당하는 각 디지털도서관의 기능을 제안하였으므로 이를 통해 디지털도서관의 역할을 제시할 수 있다. 넷째, 분산디지털도서관과 로컬디지털도서관 모두에 적용할 수 있게 하였다. 본 모형은 분산디지털도서관 환경에서 저작권관리 모형을 수립하였지만 센터디지털도서관을 중심으로 각 이용자에 따른 관리 모형을 제시한 것이다. 그러므로 하나의 단위도서관에서 로컬디지털도서관을 수립하는 데에도 저작권관리의 기본개념을 고려하여 적용할 수 있다. 다섯째, 저작권의 집중관리와 개별관리방식을 이용하여 정보의 이용 뿐만 아니라 생산 측면에서도 적용할 수 있도록 하였다. 여섯째, 디지털 저작물에 저작권관리 단위에 따라 식별번호를 부여하도록 하였다. 저작권관리 단위에 따른 디지털 저작물의 식별번호는 저작물 이용의 통제와 관리를 가능하게 한다. 또한 본 모형에서는 텍스트 저작물에 대해 식별번호를 부여하였으나, 이는 텍스트 저작물 외의 음악이나 미술 저작물 등에도 적용될 수 있다. 이와 같이 본 논문에서 제시한 저작권관리 모형은 개념적인 설계이므로 본 모형의 개념을 고려하여 저작권관리시스템을 구축할 수 있다. 또한 센터디지털도서관과 로컬디지털도서관을 포함한 저작권 문제의 발생관계를 나타낸 개념은 디지털 저작물의 유형에 따라 다양한 센터디지털도서관을 포함한 다른 분산디지털도서관 환경으로 확장할 수 있다.;The purpose of this study is to develop a model for copyright management under the recently evolving digital library environment. To establish the model, desktop literature research and case studies were performed. The literature research included investigation of definitions and functions of digital library, copyright issues arising from digital libraries, and technologies developed for copyright protection, Through case studies, methods of copyright management were examined by looking into existing digital library project around the world. Establishing a model for copyright management required determining underlying principles employed in the model. The principles were initially derived from concepts employed in protecting economic rights, moral rights, and users' rights. By using both collective and individual approaches of copyright administration, the inter-relationship of participants in distributed digital library environment were defined. The roles of digital libraries and methods of copyright management were also proposed. The proposed model has the following implications. 1) In distributed digital library environment, the center digital library can collectively administer copyrights and users can obtain bibliographic and copyright ownership information. This is possible through required registration at the center digital library of full-text, collectively administered at the center digital library, as well as bibliographic and copyright management information, individually administered at local digital libraries. 2) Users can determine the availability of digital work by searching through copyright management information database in the center digital library from anywhere. 3) The roles of the digital library as a copyright administerer were presented. 4) The model applies to local digital libraries as well as to digital libraries operating under distributed digital library environment. 5) The model provides some useful implications on digital work authoring as well as digital work using, since both collective and individual approaches of copyright administration were employed. 6) Unique identification of digital work was proposed according to copyright This identification method can also be applied to non-text management unit. digital work including music, art, and so forth. The model for copyright management in digital library environment presented in this study is conceptually designed. System architects in practice can apply the concepts and philosophies developed in this study in designing copyright management system. Also, the center digital library concept presented in this study can be further developed into other distributed digital library environments including multi-center digital library system according to digital work type.
