自治警察制度에 관한 法的 考察

Abstract

위험의 발생을 예방하거나 이미 발생한 교란의 제거를 통해 公的安全과 秩序를 보호하려는 국가작용을 警察이라 부른다. 경찰은 어떠한 국가에서도 필수적이고 기본적인 국가기능의 하나를 구성한다. 인간생활의 기본적인 욕구가치로서의 安定, 즉 사회질서확립의 保障裝置는 국가에 따라 정도의 차이는 있으나 그 제1선의 기능을 경찰에게 담당시키고 있는 것이 현대국가의 공통적인 현상이다. 경찰이 해야 할 일은 국가와 사회의 상황에 따라 달라져 왔다. 오늘날 경찰을 둘러싼 환경은 급격하게 변하고 있다. 國際化·地方化·고도의 産業化·情報化 추세와 함께 국민의 삶의 질이 높아지면서 경찰에 대한 사회적 욕구도 급격히 증가하고 있다. 경찰이 이에 대응하여 막중한 임무를 바로 수행하기 위해서는 급속히 변화하는 국내외 정세를 예견하여 경찰의 조직과 기능을 적절하게 조정해 나가야 하며 이를 위한 法的·制度的 뒷받침이 필요하다고 하겠다. 그동안 정치권에서는 警察의 政治的 中立化를 둘러싸고 간간이 논란을 벌여왔지만 지방자치와 경찰제도의 관계에 대한 본격적인 언급은 드물었다. 여기서 경찰이 다시 생각해야 할 중요한 문제가 있다. 경찰의 중립화가 경찰발전의 지름길이라고 인식하고 있는 것도 부인할 수 없는 현실이나 그 과정속에서 국민과의 신뢰와 협력체계를 뿌리내리게 하는 정성과 노력이 병행되어야 비로소 원숙한 성장이 이룩된다는 것이다. 그러므로 본격적인 지방화시대를 맞이하여 경찰이 그 본연의 임무인 주민의 생명과 재산의 보호에 충실할 수 있는 방안으로서 自治警察制度를 체계적으로 고찰해보아야 한다고 생각한다. 경찰의 自治化는 경찰발전의 기본방향이 되어야 한다. 自治警察制度란 지방분권의 정치사상에 따라 지방자치단체에 자치권을 인정하여 경찰의 설치·운영의 책임을 자치단체에 위임하는 제도이다. 따라서 자치경찰제하에서 경찰은 지방자치단체에 의해 임용되고 유지되므로 중앙정부를 의식하기 보다는 지역주민 개개인의 신변과 재산의 보호라는 민생치안에 주력하게 될 것이다. 국가와 지방자치단체 양자의 요청을 충족시키고 양자의 이해를 조정하기 위해서는 우리 나라의 현실에 비추어 볼 때 경찰조직을 國家警察과 自治警察로 이원화하는 自治警察制度의 도입이 바람직하다고 생각한다. 그리고 자치경찰은 경찰이 국민에게 진실로 봉사하고 능률적인 운영을 하기 위하여 일정 규모의 광역성과 활동의 유기적 일체성이 필요하므로 광역자치단체를 기준으로 조직되는 것이 바람직 할 것이다. 우리 나라는 지금까지 전통적으로 국가경찰제도를 취하고 있기 때문에 자치경찰제도에 관한 논의를 하기 위해서는 각국의 경찰제도속에 나름대로 정착하고 있는 자치경찰제도에 대한 연구가 중요할 것이다. 외국의 경찰제도를 그대로 도입하기보다는 현행제도의 특징에서 출발하여 궁극적으로 민주주의 이념이 구현될 수 있는 자치경찰제도의 논의가 있어야 할 것이다. 경찰의 변화는 총체적이어야 한다. 정찰의 제도뿐만 아니라 의식·관행·능력·활동의 모든 측면에서 개혁이 이루어져야 한다. 자치경찰제도의 도입과 정착에 있어서는 경찰행정 전반에 관한 재고도 함께 있어야 할 것이다.;Police is called the national action to protect public security and order through eliminating disturbance that already has happened. Police consists of one of the national funtions which are essential and basic in every country. It is a common phenomenon in modern nation that police takes responsibility the front roles to protect "Safety" as the basic needs in human life, that is the action for establishment of the society order. The role of police has changed at the conditions of the nation and society situation. Today, the circumstances surrounding police changes rapidly. As the quality of life get higher, which is accompanied by the current of internationalization localization·high industrialization·informationizinig, the social needs for police is on the rapid increase. Therefore police has to control the police structure & funtion appropriately foreseeing the internal and external situation changing rapidly in order to accomplish important duty and police is supported legally and institutionally. Sometimes until now the political neutralization of police has been in controversy. But there was little reference to the relationship between local autonomy and police system. Though it is important opinion that the neutralization of police is the short-cut for police progress, first of all, the thing is that the efforts for establishing cooperative relationship between police and civilian have to be accompanied. At the beggining of localization era, therefore, it is necessary to study autonomous police system as a plan that police has to protect the inhabitant's life and possesion as the primitive duty. Autonomous police is a basic precondition toward police progress. "Autonomous Police System" is a system that entrusts local government the responsibility for police installment and administration by recognizing the right of local autonomy on the basis of the political idea of localization. Under the autonomous police system, the police are appointed and maintained by the local government, thus they are going to concentrate their efforts on public secuity for local inhabitants, rather than considering the central government. In order to contol interests between centural government and local government, it is desirable that we introduce autonomous police system dualizied national police and autonomous police. And autonomous police needs organized relation in its activity and broading the scale appropriately to serve its people and administrate efficently. Since Koera has maintained national police system conventionally, for this study on autonomous police system the study about other countries' autonomous police system has to be preceded. The autonomous police system of Korea has to seek ulitimate realization of democracy idea from the character of its own current system, rather than the blind introduction of foreign police system. The change in police ought to be as a whole. Such as the consciousness, pratice, ability, activity as well as the system of police, change needs in every respect. Also reviewing police administration as a whole needs in introducing and settling autonomous police system.
