이혼원인 및 과정에 관한 사례 연구

Abstract

A growing number of Korean families today are experiencing severe conflicts between husband and wife. If no steps are taken to alleviate such serious marital discord, the situation will lead to a significant increase in the number of divorce in Korean society. In light of this reality, the researcher has looked at the reasons for and content of the conflict between married couples, studying the process through which it results in divorce in an attempt to find the main cause of the decision for divorce. To define this main cause, a study was conducted on the cases of 18 women to determine what it was that led to the divorce as an unavoidable reality as a result of the conflict development process. The thesis is made up of five chapters, the first of which presents the reason for the study, its goals, the problems of such research and the methodology used. The second and the third chapter explores the roots of conflict within the Korean family: First, the ideology of the patriarchal system provides for the rule of the man over the woman from which stems the troubles with the husband's family, notably the conflict between mother-in-law and daughter-in-law, as well as the husband's indiscreet extra merital affairs and his physical violence against his wife, the social structure in which man and woman are not in a balanced situation of equality which results in unequal relationships of power and the disharmony that results, according to the cases studied here: Secondly, attention is given to the husband whose drinking habits, morbid suspicion of his wife's chastity, gambling, personality disorders, alcohol ism, combined with an excessive attachment of dependence on his own family and subsequent dysfunctional personality disorders, have given rise to conflicts between the couple. An analysis of this present reality is done through an explanation of its background as seen through the theory of social change and conflict as well as against the background of patriarchy. A brief review of the research carried out heretofore on the issue of divorce looks at the problem and various proposals advanced for alleviating it. Then, an examination is made centered on materials produced by the Korea Legal Aid Center for Family Relations and the Administrative Office of Courts in an effort to describe the circumstances of divorce in Korea during the previous year and by way of background for the actual cases analyzed in the present study. The Fourth chapter presents overall analysis of the reasons which cause the conflicts between husband and wife, and the process of how the deteriorated conflicts lead to divorce: premarital family backgrounds of the couples: the causes of conflicts and the efforts to isolate the immidiate reason in the process of making decision to divorce: the particular factor that appear to have forced the divorce to occur: and post divorce plans. In sum, after reviewing the overall analysis of this chapter, the researcher found out that the too leading causes for divorce are extra marital affair by husband and family violence. The concluding chapter states that the relationship between husband and wife in the present Korean family which is a part of a larger societal and systemic reality, may not be as ideal as one would desire in terms of a relationship of equal partners resulting in a wholesome family situation. At the same time it is proposed as a significant goal toward which both women and concernd men should work together. However, the often-made suggestion that the usual on man/one woman family should be a thing of the past is no more than a vague option far from the experience of Korean people and thus not yet to be seriously considered in this society. In view of any other variable alternative, though, cash woman in her marriage relationship must have a firm will to develop a marital relationship of equality and to work toward the fullest humanization of both partners. When this occurs, significant changes in the family itself may be anticipated and the goals desired by all women will come closer to realization.;현재 한국가족에 있어서 부부간 갈등이 그 어느 때보다 첨예하게 들어나고 있으며 이렇듯 심각하게 들어나고 있는 부부간 갈등을 해소할 수 있는 대처방안이 마련되지 못하는 한 이것은 곧 한국사회에서 이혼의 증가를 의미하게 될 것이다. 연구자는 이와같은 상황을 전제로 부부관계에 있어서 갈등이 일어나게 되는 원인과 배경 즉 부부간 갈등이 "이혼의도"를 야기시켜 이혼을 생각케하는 요인으로 작용한다고 보고 이러한 갈등이 어떠한 과정을 거쳐서 이혼으로 가게 되는지, 즉 이혼을 생각하고 결심하기까지 그 과정에 있어서 이혼을 생각케 하는 원인은 무엇이며 또 그것을 지연 내지 억제시키는 요인은 무엇인가? 그리고 결국은 이혼을 할 수 밖에 없는 불가피한 요인 즉 이혼을 결심할 수 밖에 없는 요인이 무엇인지를 18명의 여성을 대상으로 한 사례연구를 통해 여성의 입장에서 알아보고자 한다. 전체 5장으로 구성되어 있는 본 논문은 1장에서 왜 이 논문을 쓰게 되었는지 그 목적과 연구방법 그리고 연구의 문제점에 대해서 기술하였다. 2장에서는 현재 한국의 부부관계가 평등하고 원만하게 그리고 가족성원간 상호협력하는 이상적이고 바람직한 상황에서 유지되고 있지 못함을 전제로 이러한 상황에서 발생하는 이혼의 원인과 이혼의 과정을 설명하는데 있어서 이론적 배경으로 거시적으로는 가부장적 가족관을 그리고 개인적 차원에서 미시적으로는 사회교환론과 갈등론을 적용시켜 설명하였다. 3장에서는 사례연구에 앞서 작년 한 해동안 우리나라 전체의 이혼실태를 법원행정처, 가정법률상담소에서 발간된 자료를 중심으로 분석해보았다. 4장에서는 사례를 통해 부부간 갈등의 요인과 갈등이 심화되어 이혼을 결심하기까지 그 과정을 조사분석하였다. 즉 결혼전 두 사람의 가족배경 그리고 부부간 갈등의 원인, 이혼을 생각했지만 그것을 억제시키는 요인, 그러나 결국은 이혼을 할 수밖에 없는 이혼을 촉진시키는 직접적인 요인, 나아가 이혼후 계획 등을 종합적으로 살펴보았다. 5장에서는 지금까지 분석한 내용을 토대로 거기에서 객관적으로 들어나는 여러가지 이혼의 원인 중 가장 많은 비율을 차지하고 있으며 오늘날 한국사회의 병리현상으로 들어나고 있는 남편의 외도와 가족폭력에 관한 문제를 중점적으로 다루면서 이에 대한 해결방안을 연구자 나름대로 제시해보았다. 끝으로 이혼에 대한 생각을 정리하면서 앞으로 한국가족의 가족제도와 가족관계가 어떻게 변화되어야 할 것이며 양자간의 균형있는 발전을 꾀하기 위해서는 남성과 여성 모두가 그리고 이 사회가 다함께 어떻게 노력해야 할 것인가를 연구자 나름대로 제시해보았다.
