Abstract
지금까지 가정폭력에 대한 많은 연구들의 초점은 가해자의 직접적인 신체적·심리적 폭력에 맞추어져 있었다. 반면 '가전폭력의 통제과정'이나 '피해자 여성들이 어떠한 경험'을 하게 되는지에 대한 규명은 거의 이루어지지 못했다. 이에 본 연구는 '가정폭력과정에서의 피해자의 경험'과 '가정폭력 통제과정에서의 피해자의 경험'을 통해 '단계적 피해자화'에 대한 연구를 하였다. 본 논문은 가정폭력 과정에서 단계적 피해자화에 대한 구체적인 설명을 제공하려는 목적으로 시작되었다. 이를 위해 본 연구에서는 먼저 피해자화를 직접적인 가정폭력으로 인한 '제1차 피해자화와 통제의 개입과정에서의 부정적 결과로 인한 '제2차 피해자화로 나누어 단계적 피해자화가 진행되는 과정을 살펴보고자 하였다. 면접 결과 가정폭력의 피해자들은 크고 작은 신체적·심리적 폭력으로 인해 신체적으로는 타박상에서부터 골절상에 이르기까지, 심리적으로는 자존감의 저하부터 우울증과 환청의 정신적 이장증세까지 다양한 수준의 제1차 피해자화 과정에 있는 것으로 밝혀졌다. 또한 대부분의 피해자들은 더 나아가 제2차 피해자화를 경험하고 있었는데 이는 가정폭력 통제의 실패 때문이다. 그렇다면 가정폭력의 통제과정에 개입하게 되는 여러 요소들은 무엇이며, 이들은 어떤 역할을 하는지에 대해 살펴볼 필요가 있겠다. 그 결과를 정리하면 다음과 같다. 첫째, 가장 먼저 가정폭력에 통제기제로 개입되는 것은 '피해자 개인의 대응'이다. 그러나 이들의 대응은 '소극적·제한적인 대응'이기 때문에 실질적인 통제자로서의 역할을 하지 못하고 있었다. 피해자들의 대응이 소극적이고 제한적일 수 밖에 없는 것은 이들이 지속되는 가정폭력의 '학습된 무기력 상태'에 있거나 '폭력의 외부노출에 대한 두려움'이 있기 때문이다. 둘째, 그럼에도 불구하고 피해자의 가정폭력피해 사실은 곧 피해자가 보유한 피해자 주변의 사회적 지지체계에 알려지게 되고, 이러한 '비공식적 통제집단'의 통제개입을 부르게 된다. 그러나 비공식적 통제집단으로 가정폭력과정에 개입하게 되는 피해자의 사회적 지지체계는 가정폭력피해사실에 대해 '이중적 태도'를 갖고 있다. 이는 '가족구조의 특수성' 과 '폭력에 대한 허용적 태도'에 기인한 것으로서 이와 같은 "왜곡된 사회적 지지"로 인해 피해자들은 마음의 상처를 받고, 궁극적으로는 가해자의 폭력에 대해 체념하게 되는 제2차 피해자화의 과정에 놓이게 된다. 셋째. '공식적 통제'는 피해자를 보호하고 가정폭력의 중지를 이끌어낼 수 있는 보다 적극적이고 직접적인 통제이지만 많은 경우 '폭력의 외부노출에 대한 두려움'이나 '통제효과에 대한 부정적 인식'으로 인해 공식적 통제의 개입을 미루고 있었다. 공식적 통제가 개입하더라도 '미숙한 업무처리', '정서적 지지의 부재', '이원적 처벌구조, '정확한 정보제공의 부족'으로 인해 피해자들은 올바른 대처방직을 알지 못한 채 현실의 문제와 타협해 적당히 대처하게 되며 신고를 해도 적절한 도움을 받지 못한다는 무기력감에 빠져 가정폭력에 대해 무감각해지고 이를 인내하게끔 하는 2차 피해자화의 부작용을 초래한다. 넷째, 가정폭력에 개입되는 통제의 실패로 인해 피해자들은 제1차 피해자화와 제2차 피해자 화의 단계에서 계속해서 폭력에 노출되는 폭력의 악순환을 경험하게 된다. 이러한 폭력의 악순환은 개인적 대응, 비공식적 통제, 공식적 통제의 개입내용에 따라서 5가지의 유형으로 나누어 볼 수 있다. 본 연구는 가정폭력과 그 통제과정에서의 피해자 여성들의 경험을 밝히기 위한 탐색적인 연구로서 그 의의를 가지며 후속연구에서 가정폭력의 피해자가 제2차 피해자화의 과정에서 공식적·비공식적 통제에 대해 어떻게 대응하고 수용하는지에 관한 보다 깊이 있는 연구가 이루어진다면 더욱 풍부한 논의를 이끌어 낼 수 있을 것으로 기대한다.;Since most studies on domestic violence have been mainly focused on direct physical and mental violence, those studies have been failed to determine the control of domestic violence and various experience of the battered wives in the process of the control. Examining various experience of the battered wives in the process of domestic violence and of the violence control, this study focused on the victimization of the battered wives by stages. The purpose of this study is to provide specifics about victimization by stages. To examine the process, victimization should be divided into two categories, which are "the first victimization" due to direct domestic violence and "secondary victimization" due to bad results of the control process. From the interviews, we could see the results that the victims of the domestic violence (interviewees) were in the various level of the first victimization. They suffered from a contusion to a fracture physically, and from low self-esteem to mental disorder like hypochondria and an auditory hallucination mentally. With this first victimization most of the battered wives also experienced a secondary victimization resulting from a failure of the domestic violence controls. Then we need to look into elements that intervene in control process and their roles. The results are as follows. First, a personal confrontation of a victim is the first element intervened as a control mechanism. However this opposition failed to act as a substantial control agency, because victims reacted passively and restrictedly. The reason their reactions are so passive and limited is they are in the state of learned helplessness or they have a fear for exposing their domestic violence. Second, nonetheless the fact of domestic violence become known to victim's social support systems, and draw an intervention of unofficial control agency such as their family, friends and neighborhoods. But those social support systems that intervene in the violence control take a dual attitude toward victims and assaulters. It is caused by 'special characteristics of the family' and 'permissive attitude for violence'. Such 'distorted social supports' hurt the battered wives and finally set them in the process of secondary victimization. Third, although an official control is a more of active and direct control that can lead the closing stages, it is often delayed because of the victims' fear of exposition of the violence and a bad recognition of controls. Since it has its own problems with 'poor management of service', 'lack of emotional support', 'dual punishment structure' and 'lack of offering precise information', even though it intervenes, victims do not know to deal with all the problems they have and finally compromise with the reality. In the end all of these factors lead a secondary victimization making the victims put up with domestic violence. Forth, The failure of control intervention cause a vicious circle which makes victims to experience domestic violence in the state of the first victimization and also in the secondary victimization. This vicious circle could be divided into 5 categories according to the intervention of personal confrontations, informal controls, and official controls. This paper is meaningful because studied on the control of domestic violence and various experiences of the battered wives in the control process have not yet been actively carried out. With based on this study, we can expect following studies more abundant including how the battered wives react in the process of official and unofficial controls.
