Abstract
검사 또는 사법경찰관이 피의자를 신문하여 그 진술내용을 기재한 조서를 피의자신문조서라 한다. 현행 형사소송법상 피의자신문조서는 작성주체에 따라 그 증거능력의 요건에 차이를 두고 있다. 즉 검사가 작성한 피의자신문조서는 성립의 진정이 인정되면 그 증거능력을 인정하는 반면에, 사법경찰관이 작성한 피의자신문조서는 피고인이나 변호인이 내용을 부인하면 증거로 할 수 없게 된다. 따라서 그 조서의 성립의 진정과 자백의 임의성이 입증되는 경우에도 증거능력은 부정된다. 과거 일제하에서는 사법경찰관이 작성한 조서에 증거능력이 인정되고 있었다. 그러나 일제하에서 사법경찰관은 자백을 얻기 위한 고문이 빈번했었고 피고인의 인권보호를 위해 신 형사소송법은 제312조 제2항에서 사법경찰관작성의 피의자신문조서에 원칙적으로 증거능력을 부정하고 다만 피고인이 법정에서 그 내용을 인정하는 경우에 한하여 증거능력을 부여하게 된 것이다. 이런 차별에 대해서 일부 견해는 합리적 근거가 없다는 이유로 제312조 제1항이 위헌성이 있다고 주장하고 있다. 나아가 피의자신문조서는 조서재판의 원인으로 직접심리주의와 공판중심주의의 실현에 걸림돌이 된다는 이유로 폐지론까지 제기되고 있다. 또한 최근에 선고된 대법원 전원합의체판결에서 피의자신문조서의 증거능력 인정하는 요건을 강화하는 경향을 볼 수 있다. 2005년에 사법제도개혁추진위원회에서는 ‘공판중심주의적 법정심리절차의 확립’을 표방하여 증거법 규정에 개정 시안이 제안하였는데, 이 중에서도 각 계의 견해가 첨예하게 대립하고 있는 부분이 바로 피의자신문조서의 증거능력에 관련된 것이다. 사개추위는 5월에 제안한 개정시안은 피의자신문조서의 증거능력을 전반적으로 부정하는 내용을 담고 있었는데, 이에 대해 검찰은 수사현실을 무시하고, 사실상 검찰의 수사권을 부정하는 내용이라고 반박하였으며, 학계 또한 현행법규정과 판례보다 공판중심주의의 실현에 더 적합한가, 개정안으로 자백중심의 수사와 조서재판의 관행을 불식시킬 수 있는가 등 비판을 하였다. 이런 반대에 부딪혀 7월에 다시 개정안을 제안하였으나 이 또한 여러 문제점을 지적받고 있다. 전문법칙을 채택하고 있는 미국, 직접주의를 채택하고 있는 독일, 일본의 경우를 살펴보면 수사기관이 작성한 조서에 대한 증거능력을 인정하는 요건을 까다롭게 적용하고 있지만 수사기관이 작성한 조서의 증거능력을 완전히 배제하는 입법례는 찾아보기 힘들고, 부족한 사법 인력으로 많은 사건을 해결하여야 하는 현실에서 피의자신문조서가 소송경제를 도모하는 역할을 충실히 수행하고 있음은 부정할 수 없는 사실이다. 피의자신문조서의 증거능력은 피고인의 인권보장과 직결되는 문제로서, 형사소송법의 개정에 앞서 개정안에 대한 학계와 실무에서 제기하는 문제점을 검토하고 개정의 필요성과 그 방향에 대한 재고가 필요하다.;The record of the suspect's statement when interrogated by a prosecutor or police is called an interrogatory. According to the current code of criminal procedure, there is a difference in the condition of evidential admissibility based on who writes the interrogatory of the suspect. For example, when the interrogatory written by a prosecutor is approved, the evidential admissibility is approved. However, in the case that the interrogatory written by the police is denied by the suspect or counsel, this interrogatory cannot be used as evidence. Therefore, even if the interrogatory is approved and the voluntariness of the suspect's confession is proved, this report does not have evidential admissability. In the past, under the Japanese colonial rule, even interrogatory reports written by the police are approved of evidential admissibility. However, under the colonial rule, the police often adopted torture as a means to get a confession. In order to protect the humans rights of the suspect, the new code of criminal procedure states in Article 312, Clause 2 that 'In principle, the interrogatory written by the police is denied the evidential admissibility. The evidential admissibility is given only when the suspect admits of the details of the report in court.' Some claim that the first clause of Article 312 is unconstitutional because there is no reasonable grounds for such discrimination. Furthermore, the abrogation of the interrogatory has been suggested for the reason that it is the cause of protocol-based trials and this acts as a setback in realizing public-trialism and direct-trialism. Also, we can find the trend to strengthen the conditions of evidential admissibility of the interrogatory in the a judicial precedent recently announced by the Supreme Court. In 2005, the Judiciary Reform Committee advocated 'Public Participation in the Judicial Process' and suggested an amendment in the Evidence Law. Among many items, it is the evidential admissibility of the interrogatory that shows acute differences in opinion. The draft of the amendment that the Judiciary Reform Committee proposed in May contained mostly negative contents against the evidential admissibility of the interrogatory. To this, the Prosecutor's Office rebutted that the proposal was intended to ignore the reality of case investigation, and deny the Prosecutors' right to investigate. In addition, the academia criticized whether the realization of public-trialism is more appropriate than the current law and judicial precedents, and whether the amendment could truly get rid of confession-based investigation and protocol-based trials. In reaction to such oppositions, the Committee proposed another amendment in July, but this amendment is also receiving much criticism. In the case of the United States and Germany and Japan, the conditions on admitting the interrogatory as evidence is quite complex, it is difficult to find cases in which interrogatories written by investigators loses its evidential admissibility. The reality is that there are many cases to be solved but a limited number of judicial administrators and it is undeniable that the interrogatory is faithfully playing its role as promotor of legal proceedings. The admissibility of evidence on the interrogatory of the suspects is an issue that is directly linked with the human rights of the suspect. Before making any amendments in the code of criminal procedure, it is necessary to examine the criticisms proposed in practice and by the academia. Also, it is necessary to reconsider the necessity and direction of the amendment.
