Abstract
Forced treatments are performed to the mentally-ill patient and the patient’s rights are denied more frequently in mental health service than any other health carel field. Mentally-ill patients are in potential danger by yielding their rights to the hands of therapists, while therapists experience to bear ethical burdens of always judging and reconsidering whether their own decisions and actions do right/good or not to patients. The study is aimed at figuring out what kind of ethical problems occur in mental health and what ethical conflicts each problem has. But ethical problems in mental health are so wide to study, this research will focus only on ethical problem perceived by nurses at psychiatric inpatient setting where is usually expected to have the most serious ethical conflicts. In that regard, data were collected from september in 2004 to february in 2005 by conducting semi-structured interviews with eight nurses at psychiatric inpatient setting, and the ethical problems which pertain only or particularly to the patient with mental illness were found and categorized by open cording of grounded theory. As a result those were separated into nine categories and 21 cases and are as follows. The first category involves the application of seclusion and restraint including 3 cases such as (Case1) application of seclusion and restraint as a kind of punishment by means for therapists’ convenience and of behavior modification, (Case 2) unethical attitude of therapists and unethical method when seclusion and restraint are applied, and (Case 3) equality in the application of seclusion and restraint. Second one is related to ward regulations including 3 cases. they are (Case 4) a restriction on the clients’ personal belongings, (Case 5) a ban on their telephoning, and (Case 6 )an infringement on their privacy. Third one covers coercion and excessive persuasion of care, such as (Case 7) involuntary medication which is not appropriate and (Case 8) forced persuasion in having meals, taking bath, and in therapeutic activities. A disclosure of client information falls on the fourth category. For instance. (Case 9) Whether therapist informs psychiatric history, of the client’s confidential record against his/her will or not, and (Case 10)whether therapist lets parent know information of client without any consent or not. Besides, (Case 11) client’ personal information is publicly circulated both online and off-line through the website and magazine of hospital and community center where the clients receive treatment. Fifth one is related to admission to and discharge from hospital. (Case 12) Client’s family and psychiatric hospital discourage the recovered client to be discharged from hospital or (Case 13) client’s family persists in asking therapist to discharge the client who still need treatment. And (Case 14) client is involuntarily admitted to a hospital even though the carer’s statements suggest that their conditions do not warrant immediate hospitalization. Sixth one involves the client's relationship with the opposite sex, marriage, and pregnancy. (Case 15)They are not allowed to date with the opposite sex and (Case 16) therapist has conflicts over decisions on their marriage and childbirth. Seventh category pertains to therapists’ incompetence and unethical attitude. (Case 17) therapist offers low-quality service due to incompetence (Case 18) lacks respect and empathy of their clients and family. Eighth one is relevant to quality of care provided by psychiatric hospital. (Case 19)The medical staffs and facilities offer poor service and (Case 20) the psychiatric hospital gives poorer service to the client covered by Medicaid than they do to those covered by Medical insurance Lastly ninth category involves clinical trials. (Case 21) Clinical trial has turned out to inflict medical injury and financial loss on clients. If we divide the ethical problems based on ethical values and principles, each divided problems will be boiled down to four principles: the principle of respect for autonomy, of beneficence, of nonmaleficence, and of justice. In particular, the first and second principles are mixed in paternalism, which is well shown in eight out of 21 cases. paternalism seeks to ensure the safey of the client in circumstances where the individual is at risk of injury or of injuring another person, protect them from problematic situations, and help their recovery. And therapists’ behaviors displayed as a means of paternalism are divided into coercion and interference with the ability of a client to make decisions, which is less coercive. Of 10 cases, coercion is applied to six cases: (Case1) application of seclusion and restraint as a kind of punishment by means for therapists’ convenience and of behavior modification, (Case 4) a restriction on the clients’ personal belongings, (Case 5) a ban on their telephoning, and (Case 6)an infringement on their privacy, (Case 13) client’s family persists in asking therapist to discharge the client who still need treatment and (Case 15) They are not allowed to date with the opposite sex. Meanwhile, interference is illustrated in four cases; (Case 8) forceful persuasion in having meals, taking bath, and in therapeutic activities. (Case 9) Informing a client’s spouse, who is totally ignorant of the client’s psychiatric history, of the client’s confidential record against his/her will, (Case 10) letting a client’s parent know his/her sickness without any consent or not, and (Case 16) conflicts over their marriage and childbirth. The principle of nonmaleficence is shown in 9 cases in which clients were damaged by therapists and psychiatric hospital. The cases related to personal problem of therapists are 7 cases ; (Case 2) unethical attitude of therapists and unethical method when seclusion and restraint are applied, (Case 7) involuntary medication which is not appropriate, (Case 11) informing about client publicly through the website and magazine of hospital where the client receive treatment, (Case 14) involuntary admission even though the carer’s statements suggest that their conditions do not indicated warrant immediate hospitalization, (Case 17) rejecting to treat certain client, (Case 18) offering low-quality service and lack of respect and empathy to their clients and family and. (Case 21) performing clinical trial which has turned out to inflict medical injury and financial loss on clients. The cases related to psychiatric hospital are 2 cases; (Case 12) discourage the recovered client to be discharged from hospital by Client’s family and psychiatric hospital and (Case 19) offering poor facilities and staff services. (Case 3) equality in the application of seclusion and restraint and (Case 20) the organizations give poorer service to the client covered by Medicaid than they do to those covered by Medical insurance suggest the last principle, the principle of justice. Particularly, Case 3 related to criminal justice and Case 20 illustrates the problem of distributive justice, Most of the ethical problems perceived by nurse at psychiatric inpatient setting amount to moral distress which is triggered in a situation where they have to comply with doctor’ orders, hospital’s guidelines, practices and atmosphere in the ward, and decisions made by client’ family and yet their ethical judgments are completely different from what they should follow. First of all, we should find a guideline to solve these conflicts in the light of above-mentioned four biomedical ethics- the principle of respect for autonomy, of beneficence, of non-maleficence, and of justice. We also should take a step further to reconcile therapists’ virtue which helps keep themselves ethical, a mindset of devoting themselves to helping clients sincerely, and ethics of care seeking sympathy with their client. All these efforts will surely lead us to resolve the ethical problems.;정신보건영역은 정신질환을 앓고 있는 대상자의 특성으로 인해 다른 어떤 의료분야보다 강제성을 띤 처치들이 많이 수행되며 대상자의 권리가 자주 제한되는 분야이다. 정신질환자는 자신의 권리와 이익을 많은 부분 치료자의 손에 내맡김으로써 늘 잠재적인 위험 상황에 처해 있고 치료자 또한 자신의 결정과 행위가 대상자에게 선한 행위인지, 옳은 결정인지를 매순간 판단하고 반성해야하는 윤리적 부담을 크게 경험하게 된다. 간호는 개인적 관계를 통해 보살핌을 제공함으로써 환자의 안녕을 증진하기 위해 윤리적인 요구에 바탕을 둔 윤리적 실무이다. 따라서 양질의 간호를 제공하는 것은 과연 내가 대상자를 위해 옳은 일은 하고 있는가하는 윤리적 배려와 깊이 연관되어 있다고 할 수 있다 따라서 본 연구는 정신보건 영역에서 어떠한 윤리 문제가 발생하고 있는지. 각 문제는 어떠한 윤리적 갈등 내용을 포함하고 있는지 파악하기 위해 시도되었다. 그러나 정신보건 영역에서 발생하는 윤리 문제는 너무 넓은 범위를 포함하므로 그 중 가장 윤리적인 갈등이 클 것으로 예상되는 정신과 병동 간호사가 지각한 윤리 문제로 한정하였다. 이러한 주제에 따라 2004년 9월에서 2005년 2월까지 질적 인터뷰를 통해 정신과 병동 경험이 1년 이상인 간호사 8명을 대상으로 정신과 병동간호사가 경험한 윤리 문제를 수집하였다. 분석은 근거이론의 개방 코딩에 의해 인터뷰 내용에서 윤리 문제를 포함한 사례를 추출한 다음 그 중 윤리 문제이고 또한 대상이 정신질환자이기 때문에 발생하거나 정신질환자와 관련하여 두드러지게 나타나는 문제들만을 골라 유사한 문제를 범주화한 결과 모두 9개의 영역과 21개의 사례로 나타났으며 각각의 영역과 사례는 다음과 같다. 첫 번째 영역은 억제와 격리 시행과 관련된 문제로 <사례 1>벌의 의미로, 치료자의 편의와 행동 수정을 위한 억제와 격리 시행 <사례 2>시행 과정에서의 비윤리적인 태도와 방법, <사례 3>억제와 격리 시행에 대한 형평성의 문제가 포함되었다. 두 번째 영역은 병동 규칙 및 관행과 관련된 문제로 <사례 4>소지품을 제한하는 규칙, <사례 5>입원 초기에 모든 환자의 전화를 금지하는 규칙, <사례 6>개인의 사생활을 침해하는 규칙이 포함되었다. 세 번째 영역은 치료 및 간호를 강제적으로 제공하거나 강요하는 문제로 <사례 7>적절하지 않은 강제 투약, <사례 8>거부하는 환자에게 식사, 씻기, 프로그램 참여에 대한 과도한 권유가 포함되었다. 네 번째 영역은 환자에 대한 정보 노출과 관련된 문제로 <사례 9>배우자에게 환자의 병력을 알리는 문제, <사례 10>부모에게 환자가 원하지 않는 정보를 알리는 문제, <사례 11>홈페이지나 소식지를 통한 환자의 신상 노출이 포함되었다. 다섯 번째 영역은 입원 및 퇴원과 관련된 문제로 <사례 12>호전된 환자에 대한 가족과 병원의 퇴원 제지, <사례 13>치료가 필요한 환자에 대한 가족의 퇴원 결정, <사례 14>가족의 정보에 의존한 부적절한 강제 입원이 포함되었다. 여섯 번째 영역은 이성관계, 결혼, 임신과 관련된 문제로 <사례 15>병동에서의 환자들 간의 이성 관계 규제, <사례 16>환자의 결혼과 출산에 대한 치료자의 갈등이 포함되었다. 일곱 번째 영역은 치료자의 역량과 태도와 관련된 문제로 <사례 17>치료자의 역량 부족, <사례 18>환자와 가족에 대한 존중과 공감이 결여된 태도가 포함되었다. 여덟 번째 영역은 의료기관에서 제공하는 서비스 질의 문제로 <사례 19>의료기관이 물리적 또는 인적으로 질 낮은 서비스를 제공하는 것과 의료보호 환자에게 의료보험 환자에 비해 질 낮은 서비스를 제공하는 것이 포함되었다. 아홉 번째 영역은 약물임상시험과 관련된 문제로 <사례 21>약물임상시험으로 인해 환자에게 치료적, 재정적 피해 제공이 포함되었다. 상황에 따라 분류한 문제들을 다시 관련된 윤리적 원칙으로 분류해보면 첫째 자율성의 원칙과 선행의 원칙이 갈등하고 있는 온정적 간섭주의가 관련된 경우인데 모두 21개의 사례 중에서 10개의 사례가 포함되었다. 온정적 간섭주의의 목적은 자해와 타해로 부터 환자의 안전을 확보하고, 환자를 문제 상황으로부터 보호하고, 회복을 돕기 위한 목적으로 나타났다. 그리고 온정적 간섭주의의 수단으로 나타나는 치료자의 행동은 강제 행위와 그보다는 약한, 결정에 대한 간섭 행위로 나누어 볼 수 있는데 10개의 사례 중 6개의 사례가 온정적 간섭주의로서 강제 행위를 사용하고 있는 경우에 해당되었으며, 여기에는 <사례 1>벌의 의미로 치료자의 편의와 행동 수정을 위한 억제와 격리 시행, <사례 4>소지품을 제한하는 규칙, <사례 5>입원 초기에 모든 환자의 전화를 금지하는 규칙, <사례 6>개인의 사생활을 침해하는 규칙, <사례 13>치료가 필요한 환자에 대한 가족의 퇴원 결정, <사례 15>병동에서의 환자들 간의 이성 관계 규제가 포함되었다. 간섭 행위에는 모두 4개의 사례로 <사례 8>거부하는 환자에게 식사, 씻기, 프로그램 참여에 대한 과도한 권유, <사례 9>배우자에게 환자의 병력을 알리는 문제, <사례 10>부모에게 환자가 원하지 않는 정보를 알리는 문제, <사례 16>환자의 결혼과 출산에 대한 치료자의 갈등이 해당되었다. 다음으로는 악행금지의 원칙과 관련한 것으로는 치료자 개인과 가족 및 의료기관에 의해 환자가 피해를 입는 9개의 사례가 포함되었다. 그중 치료자 개인의 문제로는 7개의 사례로, <사례 2>시행 과정에서의 비윤리적인 태도와 방법, <사례 7>부적절한 강제 투약, <사례 11>홈페이지나 소식지를 통한 환자의 신상 노출, <사례 14>가족의 정보에 의존한 부적절한 강제 입원, <사례 17>치료자의 역량 부족, <사례 18>환자와 가족에 대한 존중과 공감이 결여된 태도, <사례 21>약물임상시험으로 인해 환자에게 치료와 재정에 피해를 제공하는 것이 포함되었다. 가족 및 의료기관의 문제는 모두 2개의 사례로 <사례 12>호전된 환자에 대한 가족과 병원의 퇴원 제지, <사례 19>의료기관이 물리적 또는 인적으로 질 낮은 서비스를 제공하는 것이 포함되었다. 마지막으로 정의의 원칙과 관련된 것으로는 2개의 사례가 포함되었는데 처벌적 정의로서 <사례 3>억제와 격리 시행에 대한 형평성의 문제와 분배적 정의로는 <사례 20>의료보호 환자에게 의료보험 환자에 비해 질 낮은 서비스를 제공하는 것이 해당되었다. 정신과 병동 간호사가 지각하는 윤리 문제는 대부분이 의사의 지시나 기관의 지침 또는 병동의 관행이나 분위기, 때로는 가족에 의한 의사결정을 따라야 하는 입장에서 그러한 결정이 자신의 윤리적 판단과 다른 상황에 많이 노출되어 있고 그로 인한 윤리적인 갈등, 자신 또는 다른 치료자의 비윤리적인 행동에 대해 갈등 하는 도덕적 고민(moral distress)에 해당하였다. 이러한 윤리 문제는 자율성 존중의 원칙, 악행금지의 원칙, 선행의 원칙, 정의의 원칙이라는 네 가지 생명의료윤리의 원칙에 준하여 갈등을 해결할 수 있는 지침을 찾고 동시에 윤리적으로 민감한 태도를 유지하려는 치료자의 덕성과, 대상자와의 관계에 전념하여 진심으로 돕고자하는 마음과 이해하고 공감하고자 노력하는 돌봄의 윤리를 보완적으로 적용함으로서 보다 원만하게 해결할 수 있을 것으로 보인다.
