An Analysis of the Precautionary Principle and Challenges to Korea's LMOs Policy

Abstract

사전예방원칙은 주어진 measure의 리스크 측정시 과학적 평가가 부재한 상황에서 취해지는 예방 또는 보호차원의 개념이다. 이 개념은 많은 국제법 중에서 국제환경법에 의해 처음으로 포용되었다. 국제통상체제에서 국제무역기구(WTO)의 위생식물검역조치 적용에 관한 협정(SPS협정)은 인간, 동물, 혹은 식물의 생명과 건강을 보호하기 위해 필요한 조치는 국제기준과 리스크 평가에 기준을 두어야 함을 규정하고 있다. EC-Hormones(EC-호르몬)과 EC-Asbestos(EC-석면)의 두 사건에 대한 분쟁해결기구(Dispute Settlement Body)의 판정은 생명과 건강에 대한 리스크 평가시 사회경제적 여건을 고려하는 것의 중요성을 말하고 있다. 이러한 선례에도 불구하고 분쟁해결기구는 계속해서 국가들에 대해 비과학적 근거 혹은 사전예방원칙을 기반으로 하는 조치를 취하는 것을 제지하고 있다. 이 논문은 사전예방원칙을 기반으로 만들어진 국제 생물 다양성 협약인 Cartagena 협약의 실행을 위해 비준된 한국의 유전자변형생물체(LMOs) 관련 법률이 사전예방원칙과 관련한 국제무역기구의 판정과 마찰할 수 있는 요인이 있음을 발견하였다. 분쟁해결기구는 사전예방원칙을 기반으로 한 조치를 모두 받아들이는 것이 아니므로 한국 정부는 유전자변형생물체의 국가간 이동시 국제통상분쟁을 피하기 위해 리스크 평가 절차를 철저하게 준수해야 할 것이다.;The precautionary principle is the concept of taking preventive or protective actions in the absence of scientific assessment that gauges the risk of the given measure. This concept was first stipulated in the international environment law among any other international rules. Within the international trade regime, the Agreement on the Application of Sanitary and Phytosanitary Measures (the SPS Agreement) of the World Trade Organization stipulates that the measure necessary to protect human, animal or plant life or health should be based on international standards and risk assessments. The rulings of the Dispute Settlement Body in two cases, the EC-Hormones case and the EC-Asbestos case, point out the importance of considering socio-economic concerns when assessing the risk of the given life or health measure. However, the Dispute Settlement Body still restricts countries from taking measures based on non-scientific evidence. This thesis found that Korea’s LMOs regulations were ratified in order to implement the Cartagena Protocol—an international biodiversity treaty that is largely based on the precautionary principle—which contains elements that may conflict with the rulings of the WTO concerning the precautionary principle. Since the Dispute Settlement Body does not fully accept measures based on the precautionary principle, the Korean government should strictly adhere to the risk assessment procedures in order to avoid international trade disputes when trading LMOs.
