한국형 기업연금제도의 도입방안에 관한 연구

Abstract

Korea's rapidly increasing population amid greater urbanization and disintegration of the extended families and rapid national economic progress have intensified the need for some sort of social welfare system. The government-sponsored national pension system which is designed as a social safety net, however, does not provide adequate financial security for most, and the existing retirement benefits system increases the investment burden for corporations while failing to provide a sufficient guarantee of post-retirement income for the workers. Therefore, the need to extablish a privatized corporate pension system has become more urgent. A privatized corporate pension system is fashioned by the society's economic and political influences, customs and mores. In the United States, the system has naturally evolved from years of negotiation between the labor and the management. In Japan, the efforts to systematize the traditional custom of offering severance pay has led to the currently existing pension system. Utilizing thorough analyses of these economically-advanced nations' pension systems as a basis for further study, Korea needs to reform the existing retirement benefits system and adopt some sort of a privatized corporate pension system to remedy the problems that are inherent in the existing national system. In Korea, the concept of retirement pay, or severance pay, is confined to the individual and is not viewed in terms of its societal impact; each worker views the lump-sum severance pay as a fundamental right that he or she is entitled to and consideration of the systematic, aggregate impact on the society is neglected. The privatized corporate pension system in Korea, therefore, must be designed as an extension of the existing lump-sum severance pay system and the funds for the privatized corporate pension system should be contributed solely by the employer. Simultaneously the government should do its part to assist in the adoption of the new privatized pension system. First, the government should create a supportive legal and regulatory framework such as the U.S.'s ERISA to dispel any public mistrust about the corporations' ability to guarantee payments years after the retirement. Second, the new laws governing the retirement pay in Korea must recognize the vested rights of the existing workers and present them with a choice to either continue under the traditional system or opt for the new privatized system. Third, the new workers must be given tax relief to create incentives for choosing the privatized corporate pension system. The privatized corporate pension system should become part of a three-tier senior citizen's welfare system. As the privatized corporate pension system in Korea approaches the models employed by more advanced nations, it will also provide a means of revitalizing the capital and labor markets.;우리나라는 급속한 인구의 고령화와 산업화 그리고 인구의 도시집중화와 핵가족화로 인하여사회보장의 필요성이 각별히 요구되고 있다. 그러나 공적연금으로서의 사회보장적 성격을 가진 국민연금제도로는 소득보장역할이 부족하며, 현행 퇴직금제도에서는 기업의 투자부담이 가중되고 근로자의 수급권 보장이 미흡한 상황이다. 이에 기업연금제도의 도입필요성이 한층 강조되어진다. 각국의 기업연금제도는 나라마다 경제·사회적 여건과 제도 및 관습의 차이에 따라 다양하게 나타나고 있다. 미국의 경우에는 노사간의 자조적인 정신을 바탕으로 자생적으로 발전하였으며 일본의 경우에는 이미 전통적으로 존재해온 퇴직일시금제도를 보다 합리화시킨다는 측면에서 실시하여 오고 있다. 이들 선진각국의 제도를 기초로 한 심층적인 분석을 통해 우리나라는 공적연금제도를 보완하고 현행 퇴직금제도의 구조적인 문제점들을 개선하기 위한 방안으로 기업연금제도를 도입해야 한다. 한국에서 현재 퇴직금은 임금후불적 이미지를 강하게 가지고 있어 근로자들의 개별 기득권 의식이 강하고 사회적 제도로서의 개념은 약한 상황이다. 그러므로 한국형 기업연금제도의 설계는 기본적으로 기존의 퇴직일시금제도로부터 유도될 수 있어야 할 것이다. 또한 기존 근로자의 경우는 기득권을 인정하여 선택권을 부여하도록 하며 신규 근로자에 대해서는 세제혜택 등을 조정하여 연금형 기업연금제도를 정착시켜가야 한다. 갹출의 주체는 비갹출제도(사용자 부담)로 하며 근로자의 수급권 보장을 위해 미국의 ERISA와 같은 기업연금제도의 법제화가 전제되어져야 할 것이다. 기업연금제도의 도입·운용은 종업원의 노후생계보장제도의 하나로 3층 사회보장제도의 완성이라는 측면에서 선진국형 사회복지체계로 가는 시금석이 될 수 있을 것이며 자본시장이나 노동시장을 더욱 효율적으로 운영하고 활성화시키는 계기가 되리라 본다.
